McDonald’s Sued Over AI Tool That Recommends Prices to U.S. Franchisees

A newly filed lawsuit challenges McDonald’s AI-enhanced price recommendations. The allegations remain unproven, and the company says franchisees set prices.

McDonald’s faces a proposed federal antitrust class action over a tool that recommends menu prices to U.S. franchisees. Filed October 2, 2026, in the U.S. District Court for the Northern District of Illinois, the case alleges that recommendations based on nonpublic information can coordinate prices among competing restaurants and harm consumers. Those claims have not been proven. McDonald’s says the tool is optional and that franchisees—not AI—set menu prices.

What the lawsuit alleges

Michael Thomas filed Thomas v. McDonalds USA, LLC et al., No. 1:2026cv12149, against McDonald’s USA, LLC and McDonald’s Corporation. The docket lists the complaint as filed October 2, 2026, as a 15 U.S.C. § 1 antitrust action. The Justia docket listing is a snapshot retrieved October 3, 2026; it should not be read as a complete account of later filings.

As described in news coverage, Thomas alleges that McDonald’s pricing system uses nonpublic information, including store-level sales, to recommend prices across restaurants that may compete with one another. The complaint argues that the system facilitates unlawful coordination and raises prices. These are the plaintiff’s allegations, not findings by a court. The Associated Press and Reuters, syndicated by Investing.com, describe the case as a proposed class action.

What McDonald’s says about the tool

McDonald’s calls the suit inaccurate and says it will defend itself. In a statement quoted by the AP, the company said: “AI does not set menu prices at McDonald’s restaurants – McDonald’s franchisees do.” It describes the tool as an optional aid that neither automates nor coordinates or fixes prices. A spokesperson also said, “All we do is provide the context of what’s going on.” Those statements represent the company’s position; they do not independently settle how recommendations affect pricing decisions in practice.

According to the AP’s account of McDonald’s statements, the AI-enhanced recommendations have been used for more than a decade and consider a restaurant’s sales, location and other factors, including competitors’ prices. McDonald’s also says it collected data and recommended prices before adding AI. The reporting does not establish the model’s precise design, the full set of inputs, or how often franchisees follow its recommendations.

Who sets prices—and what remains disputed

The central dispute is whether an optional recommendation system that draws on information from multiple restaurants can influence prices in a way that violates antitrust law, even if franchisees formally choose their own prices. The complaint says the system enables coordination; McDonald’s says its tools support independent business decisions. The available reporting does not resolve the tool’s actual effect on individual menu prices or the legal merits of that disagreement.

The AP reports that franchisees own and operate 95% of McDonald’s roughly 14,000 U.S. restaurants. That figure helps explain why the company and the plaintiff emphasize different aspects of the franchise relationship, but it does not establish whether franchisees are free in practice to reject recommendations or how much influence the tool has.

What the plaintiff is asking the court to do

Thomas asks the court to certify a class, award damages and prevent McDonald’s from enforcing agreements alleged to restrict competition. These are requested remedies, not orders. The sources available for this account do not show that the court has certified a class, found liability, awarded damages or issued an injunction.

Does the case mean McDonald’s uses personalized prices?

No conclusion about customer-specific pricing follows from the allegations described in the reporting. The case concerns recommendations to restaurants, not verified evidence that McDonald’s changes a customer’s price based on who is ordering. The available sources do not establish customer-level personalization.

What the case does—and does not—show about menu prices

The lawsuit puts the use of pricing recommendations and shared business data at issue; it does not establish how much the tool has changed prices, whether it caused prices to rise, or whether any recommendation was adopted at a particular restaurant. The AP separately reported on McDonald’s value-menu plans: at the time of an August investor call, 60% of U.S. restaurants were offering a proposed menu of 10 items under $3. That is a snapshot of a promotion, not evidence about the tool’s accuracy, adoption rate or legal effect. In discussing the rollout, CEO Chris Kempczinski said it was not something the company could “just flip the switch on” and that it “requires conversations with franchisees.” The remarks concern implementing the value menu, not necessarily the pricing tool.

For readers, the key distinction is between an allegation that recommendations can coordinate prices and a court finding that they did. The docket confirms that a complaint was filed; it does not determine whether the alleged conduct occurred or violated antitrust law.
