Maternity Leave by State: Pay, Job Protection, and 2026 Changes

Maternity leave may mean medical leave, postpartum recovery, bonding time, pay, or job protection. Learn what FMLA covers, what 2026 state changes establish, and how to check your eligibility.

There is no single U.S. maternity-leave entitlement that guarantees every worker a set number of paid weeks. What you can take—and whether you receive pay or job protection—depends on federal eligibility, your state’s laws and programs, and your employer’s benefits. “Maternity leave” can mean pregnancy-related medical leave, recovery after childbirth, time to bond with a new child, or some combination of those.

What does “maternity leave” include?

Leave for pregnancy and a new child can involve several distinct rights and benefits. A medical condition related to pregnancy or childbirth may qualify for medical leave; bonding leave is for caring for a new child. Wage replacement is a benefit that can provide income while someone is away. Job protection is a separate right to return to a job or an equivalent one. One program may cover one of these needs without covering all of them.

That distinction matters when comparing states: a headline number of paid weeks does not necessarily mean every worker qualifies, that every week is paid at full wages, or that the benefit itself guarantees job restoration.

How the state comparison looks in 2026

The U.S. Department of Labor’s Women’s Bureau reports that 13 states and the District of Columbia have enacted paid family and medical leave programs. It separately notes paid temporary disability leave laws in Hawaii and paid temporary disability and maternity leave laws in Puerto Rico. These categories are not interchangeable: a temporary-disability benefit may address a worker’s medical leave without providing the same benefit for bonding.

The Department’s overview does not establish a current 50-state comparison of benefit weeks, wage-replacement formulas, eligibility, job protection, and deadlines. Those details must be checked with the relevant state agency; other state protections and employer benefits may also apply. The state-specific 2026 developments confirmed by state agencies include:

Minnesota Minnesota Paid Leave began offering payments and job protections on January 1, 2026. The Minnesota Department of Labor and Industry describes protections for time away for a worker’s own health or family care. Eligibility, benefit amount and duration, application requirements, and how the program coordinates with other leave. The cited agency information does not establish a universal maternity-leave duration or payment amount.
Maine For eligible workers, the Maine program allows up to 12 weeks of paid time in a benefit year. Benefits apply to qualifying leave occurring on or after May 1, 2026. Covered reasons include parental leave, medical leave, family care, military family, and safe leave. Whether you qualify, your payment amount, applicable notice or certification rules, and how job protection applies to your circumstances.
Other states and the District of Columbia The Women’s Bureau reports enacted paid family and medical leave programs in 13 states and the District of Columbia. Its overview also identifies the separate temporary-disability laws noted above. Whether your state program covers pregnancy-related medical leave, postpartum recovery, bonding, or more than one; the current eligibility, payment, duration, protection, and filing rules. The cited overview does not provide a complete current state-by-state benefit matrix.

A state without a broad paid family and medical leave insurance program may still have pregnancy accommodations, temporary disability coverage, paid sick leave, or other parental and job-protection rules. Check the state labor department or paid-leave agency for the state where you work rather than inferring your rights from whether it has a broad program.

What federal FMLA provides—and who qualifies

The federal Family and Medical Leave Act (FMLA) can provide eligible employees of covered employers up to 12 workweeks of unpaid, job-protected leave during a 12-month period. Qualifying reasons include birth and care of a newborn during the first year, placement and care of a child for adoption or foster care, the employee’s own serious health condition, and care for a spouse, child, or parent with a serious health condition. It can cover prenatal care, pregnancy-related incapacity, and a serious health condition following childbirth. Eligible mothers and fathers can use it for birth and bonding; bonding leave generally must end within 12 months of the birth or placement.

For standard private-sector coverage, the employer must have at least 50 employees for at least 20 workweeks in the current or preceding calendar year. The employee generally must have worked for that employer for at least 12 months, have at least 1,250 hours of service in the 12 months before leave, and work at a location where the employer has at least 50 employees within 75 miles. Public agencies and local educational agencies are covered regardless of employee count. Special rules apply to some workers, including airline flight crew.

During FMLA leave, an employer must maintain group health benefits on the same terms and conditions as if the employee had continued working. FMLA itself does not provide wage replacement: the Department of Labor’s Women’s Bureau says, “There is currently no federal law providing or guaranteeing access to paid family and medical leave for workers in the private sector.”

How paid benefits and job protection can overlap

A state benefit that replaces some wages and a law that protects a worker’s job are separate questions. Do not assume that receiving a paid benefit automatically provides job restoration, or that a state’s paid weeks are additional to FMLA weeks. FMLA and state or employer leave may run at the same time when the applicable rules allow; paid leave from an employer or accrued paid time may also run concurrently with FMLA under governing rules. Intermittent bonding leave under FMLA is subject to employer agreement.

Ask the state agency and employer how each applicable program treats your dates, reason for leave, and eligibility. The interaction depends on the individual facts and governing law.

How to find out what you can take

  1. Identify your work state and expected leave dates. Start with the official state labor department or paid-leave agency. Use its current benefit guide, eligibility information, calculator, or application instructions where available.
  2. Separate medical leave from bonding leave. Ask whether pregnancy-related care or recovery and time to bond with a child are handled under the same program or different ones.
  3. Check your FMLA facts. Confirm the employer’s coverage and your months of employment, hours worked in the prior 12 months, and worksite employee count within 75 miles. Ask HR how to request leave and what certification may be required.
  4. Ask HR about employer benefits. Find out whether the employer offers paid parental leave, short-term disability, accrued paid time off, or a more generous job-protected leave policy, and whether those benefits run at the same time as state or federal leave.
  5. Confirm deadlines and coordination before filing. Ask the state agency and employer about notice, medical certification, claim timing, and how benefits and leave protections coordinate. Eligibility or payment under one program does not by itself establish eligibility under another.

State rules and procedures can change. For an individual claim, use the current official state guidance and your employer’s plan documents; this guide is general information, not a determination of legal rights or benefit eligibility.
