Maryland Data-Center Executive Charged Over Alleged Tier IV Certificate in $10.7 Million SEC Deal

The DOJ alleges that Deepak Jain used purported “Uptime Council” letters to support a Tier IV claim for an SEC data-center contract. The case highlights why buyers must verify a certificate’s issuer, scope, facility, and status independently.

Federal prosecutors allege that Maryland technology executive Deepak Jain used a fictitious certification body to make a Beltsville data center appear to meet Tier IV requirements for a U.S. Securities and Exchange Commission contract. The SEC paid the unnamed company about $10.7 million from 2012 through 2018, according to the Justice Department. Jain was indicted in October 2024; an indictment is an allegation, not a conviction.

What prosecutors allege happened

The Justice Department says the SEC sought a highly resilient data center and that Jain’s company represented its Beltsville, Maryland, facility as Tier IV. Prosecutors allege Jain created a fictitious organization called “Uptime Council,” which purported to inspect and audit data centers, and used its purported certification letters to support the Tier IV claim.

  1. The company pursued an SEC data-center contract that required a facility meeting a high Tier rating.
  2. Jain allegedly established “Uptime Council” and presented letters purporting to certify the facility as Tier IV.
  3. The SEC awarded the contract. Prosecutors say the agency later encountered security, cooling, and power problems.
  4. The company allegedly continued misrepresenting the facility’s qualifications during the contract period. The SEC paid approximately $10.7 million between 2012 and 2018.

The DOJ described the employer as “Company A” and did not name it in its indictment announcement. Contemporary reporting linked the unnamed company to AiNET, whose founder and CEO was Jain; that identification is a reported connection, not one established by the DOJ release. What Tier IV means—and what it does not

Tier IV is the highest level in the Uptime Institute’s data-center Tier classification system. It concerns infrastructure resilience: a Tier IV design is intended to be concurrently maintainable and fault-tolerant, with multiple independent distribution paths designed to withstand certain individual equipment or distribution failures without interrupting operations.

A Tier rating is not a blanket promise of uninterrupted service. It does not prove that staff will follow procedures, maintenance will be performed correctly, or every incident will be avoided. Nor is it equivalent to a contractual uptime service-level agreement (SLA), a security certification, or a government authorization to operate. A commonly repeated uptime percentage should not be treated as a guaranteed result for any individual facility.

  • Tier certification: Evidence about a facility’s infrastructure design or verified condition, depending on the certification scope.
  • Operational availability: The service a customer actually experiences over time.
  • SLA: Contract terms that define service commitments and remedies.
  • Security and compliance: Separate controls and assessments, such as SOC 2, ISO 27001, FedRAMP, or PCI DSS where applicable.

A design certification is not automatically proof that the completed facility was certified, and a facility’s rating does not establish the security or compliance of every service hosted there.

Who issues a legitimate Tier certification?

Formal Uptime Institute Tier Certification is associated with Uptime Institute, not an entity called “Uptime Council.” The DOJ alleged that Jain created “Uptime Council” to pose as an inspection and audit organization. A vendor’s claim that a site is “Tier IV-equivalent,” or a consultant’s engineering opinion, is not by itself formal Uptime Institute certification.

Certification applies within a defined scope. Buyers should establish whether a certificate covers the exact facility address and building, the relevant data hall or expansion phase, and the design, completed construction, or operations. They should also confirm whether it remains current and whether limitations or exclusions apply.

What the SEC contract problems do—and do not—show

The DOJ identified alleged problems involving security, cooling, and power. Prosecutors presented those issues as evidence that the facility did not meet the requirements represented to the SEC; the existence of an incident alone does not prove a facility lacked Tier IV status. The DOJ announcement does not report a data breach or say that SEC data was lost or compromised.

Jain’s lawyer told Network World that the company performed fully under the contract, that there was no evidence data had been lost or compromised, and that Jain maintained his innocence and intended to contest the charges. Those are the defense’s statements, not findings by a court. (Network World)

Charges and legal status

A federal grand jury in the District of Columbia returned the indictment on October 15, 2024; the DOJ announced it the following day. Jain, 49 at the time of the announcement and from Potomac, Maryland, was charged with six counts of major fraud against the United States and one count of making false statements to the SEC.

The DOJ said each major-fraud count carried a potential maximum sentence of 10 years and the false-statements count a potential maximum of five years. How procurement teams can verify a facility certification

A certificate PDF supplied by a vendor is a starting point, not independent verification. For a government or mission-critical contract, check the claim against the issuer and the facility, then test whether the documented rating matches the service being purchased.

  1. Verify the certifier independently. Use the issuer’s official directory or verification channel. Confirm its legal name, web domain, contact details, and personnel; do not rely only on contact information printed on the certificate.
  2. Match the certificate to the site. Check the street address, building, data hall or phase, and the services in scope. Do not assume that a provider’s other facilities have the same rating.
  3. Check the document’s scope and dates. Request the certificate number, issuing organization, certification type, issue and expiration dates if applicable, and any exclusions. Distinguish design certification from certification of a constructed facility or operational practices.
  4. Commission an independent inspection when the stakes warrant it. Review electrical single-line diagrams, UPS and generator redundancy, cooling capacity, maintenance records, generator load-bank testing, incident reports, physical-security controls, access logs, and change-management procedures.
  5. Evaluate security separately. Request evidence for the controls and compliance requirements that apply to the contract, such as SOC 2 Type II, ISO 27001, FedRAMP, FISMA or agency-specific requirements, and PCI DSS where relevant. None substitutes for a Tier certification, and a Tier rating does not substitute for them.
  6. Make the claim enforceable. Contract for authentic, current certifications; notice of changes; audit and inspection rights; incident disclosure; records retention; subcontractor and facility-change notification; remedies for misrepresentation; and cooperation with government audits.

Red flags in resilience claims

  • A certificate comes from an organization that cannot be independently located or verified.
  • The document lacks a verifiable number, exact facility address, clear scope, or relevant dates.
  • The provider offers only screenshots or marketing PDFs, or refuses a reasonable inspection.
  • Claims differ across a proposal, website, certificate, and contract.
  • “Tier IV-equivalent” is used without identifying the standard, requirements met or not met, assessor, independence of the assessment, and whether it covers design, construction, or operations.
  • A single vague label is presented as proof of Tier rating, cybersecurity, compliance, and guaranteed uptime.

A certification records a defined assessment; it cannot by itself establish how a site performed on every day of a contract. Procurement decisions should combine authenticated documents with operational evidence and contractual rights.
