Marketplace GST TCS vs. Regular GST Payments: What Online Sellers Need to Know

Marketplace GST TCS is a cash-ledger credit on qualifying sales, not the seller’s full GST payment. Learn how section 52, section 9(5), GSTR-1 Table 14, and portal payments differ.

Marketplace GST TCS is not a substitute for paying your own GST. When the conditions in section 52 apply, an e-commerce operator collects tax at source on qualifying taxable supplies and the amount is credited to the seller’s Electronic Cash Ledger. The seller still has to report outward supplies and settle applicable GST liabilities through the normal return and payment process. A separate rule, section 9(5), makes the operator—not the seller—the person liable to pay tax on specified notified supplies.

What GST TCS and a regular GST payment mean

GST TCS is a collection mechanism for certain sales made through an e-commerce operator (ECO), such as a marketplace, when the operator collects the consideration. Section 52 of the Central Goods and Services Tax Act refers to the “net value of taxable supplies” made through the operator. The operator collects the applicable amount and reports it; the seller receives the resulting credit in its Electronic Cash Ledger. Section 52 of the CGST Act and the CBIC’s e-commerce FAQ describe this framework.

A regular GST payment is the seller’s settlement of its own applicable tax liability. It follows the seller’s return and payment process: the seller determines what it owes, uses available ledger balances as permitted, and deposits funds through a GST Portal challan when needed. Successful deposits are credited to the Electronic Cash Ledger, which is used for specified payments under the GST Payment Rules.

Who collects or pays? The ECO collects TCS on qualifying supplies where it collects the consideration. The seller settles its own applicable GST liability through the return and payment process.
What does it cover? A statutory collection on the net value of qualifying taxable supplies through the ECO—not the seller’s entire GST bill. The seller’s applicable tax liability, based on its transactions and return position.
Where does the amount go? To the seller’s Electronic Cash Ledger as a credit. A successful portal deposit is credited to the Electronic Cash Ledger; ledger balances are applied to liabilities as permitted by the rules.
Where is it reported? Marketplace-related information is reported in GSTR-1 Table 14, with separate treatment for section 52 and section 9(5). Through the seller’s normal return and GST Portal payment flow.

When marketplace TCS applies—and what it does not mean

Do not assume every marketplace order attracts section 52 TCS. The statutory conditions matter, including whether the ECO collects the consideration and whether the supply is within the section’s scope. The Act sets a maximum rate boundary and permits the applicable rate to be notified. The CBIC FAQ contains older rate language; it does not establish the rate applicable to every current tax period. Check the current notification and the relevant portal guidance before relying on a rate.

Most importantly, a TCS credit is not the same as input-tax credit. TCS appears in the Electronic Cash Ledger, not the Electronic Credit Ledger. It can contribute to payment of applicable liabilities through the cash ledger, but it does not itself calculate the seller’s liability, complete a return, or discharge more than the amount available and properly applied.

Section 52 TCS is different from section 9(5)

Some notified categories of supplies fall under section 9(5), under which the ECO is liable to pay GST as if it were the supplier. That is a different responsibility from collecting TCS under section 52. The GST Portal separates the two in GSTR-1 Table 14: section 52 reporting belongs in Table 14(a), while section 9(5) supplies are reported in Table 14(b). How the reporting and payment pieces fit together

For a practical reconciliation, keep three records distinct: the marketplace settlement statement, the seller’s outward-supply figures and filed returns, and the GST Portal’s Electronic Cash Ledger. Match marketplace sales and adjustments to the seller’s outward-supply reporting, then check that the portal shows the TCS credit. A settlement deduction and a ledger credit are related, but they are not the same record.

Report marketplace supplies in GSTR-1

The GST Portal provides Table 14 for supplies made through ECOs. Under the portal’s GSTR-1 guide and outward-supplies return instructions, the relevant table distinguishes ECO supplies reported under section 52 from those for which the operator pays tax under section 9(5).

  • Table 14(a), section 52: The operator-wise summary is for supplies whose taxable value and tax liability have already been reported in other GSTR-1 tables. The portal advisory says Table 14(a) does not itself auto-populate taxable value or tax liability into GSTR-3B. Reporting here alone does not pay the seller’s tax or complete the return.
  • Table 14(b), section 9(5): This is for the distinct category in which the operator pays tax on the covered supply. The advisory says these values populate the relevant GSTR-3B field. Do not treat these supplies as section 52 TCS.

Check the cash ledger and pay any remaining liability

After filing and reconciling, determine the seller’s actual liability under the applicable rules and account for available ledger balances. If a cash deposit is needed, create a challan on the GST Portal and select from the payment modes currently offered there. The portal’s online payment modes guide explains the process; available options can change, so use the live portal rather than relying on an old list of banks or channels. Successful deposits are credited to the Electronic Cash Ledger, and the payment rules govern how relevant liabilities are debited.

Common mistakes to avoid

  • Counting TCS as the whole GST payment: TCS is a credit related to qualifying marketplace supplies, not a substitute for the seller’s return or its own tax settlement.
  • Calling TCS input-tax credit: The credit is in the Electronic Cash Ledger, not the Electronic Credit Ledger.
  • Assuming Table 14(a) completes the tax reporting: The section 52 summary does not by itself populate the relevant taxable value and tax liability in GSTR-3B.
  • Mixing up sections 52 and 9(5): Under section 9(5), the ECO pays the tax on notified supplies as if it were the supplier; that is not a seller’s TCS credit.
  • Using an unverified rate: Confirm the rate applicable to the period and transaction from current official notifications rather than relying on an older FAQ.

What depends on your circumstances

The rules summarized here do not determine a particular seller’s registration status, output tax rate, exemption eligibility, return frequency, due date, input-tax-credit position, or net amount payable. Those depend on the seller, the transaction, and rules in force for the relevant period. For a filing decision or disputed reconciliation, check current GST Portal guidance and obtain advice from a qualified tax professional.
