Maharashtra’s 10-Hour Workday: What the 2025 Shops and Establishments Ordinance Changed

Short answer: Maharashtra Ordinance No. VIII of 2025 raised the daily work ceiling from nine to ten hours for workers covered by the Maharashtra Shops and Establishments Act, 2017. The ordinance’s statement retains a maximum of 48 hours in any week, so it does not create a 50-hour weekly allowance. Its later legislative status and the status of final implementing rules are not established by the official material cited below; check the latest Maharashtra legal texts before treating the ordinance as the rule currently in force or relying on it for an individual employment dispute.

Who is covered by the change?

The amendment concerns shops and establishments governed by the Maharashtra Shops and Establishments (Regulation of Employment and Conditions of Service) Act, 2017. It should not be read as changing working-hour rules for every private-sector job, or as an amendment to the separate rules governing factories. The ordinance is Maharashtra Ordinance No. VIII of 2025.

For a particular job, the key first question is whether the employer and workplace fall within this Act. The daily ceiling described here is not a universal permission for any employer in Maharashtra to schedule a ten-hour workday.

What did the ordinance change?

The Government of Maharashtra’s ordinance statement describes changes to daily hours, weekly hours, spread-over, breaks, overtime and registration requirements. The figures below compare the prior statutory baseline with the ordinance as described in that instrument; they are not a confirmation that the ordinance remains operative on 8 October 2026.

The comparisons are drawn from the ordinance’s statement of objects and reasons and the Act provisions it identifies. Its statement says overtime will not be mandatory for workers, and that other statutory worker protections remain when the registration threshold changes. These are the government’s descriptions of the amendments, not a finding about how any employer has implemented them.

Why a 10-hour day is not a 50-hour week

A daily ceiling and a weekly ceiling set separate limits. The ordinance raised the daily figure to ten hours while its statement retained the weekly maximum at 48. It therefore did not authorize a schedule of five ten-hour days on the basis of the daily figure alone.

Spread-over is also different from hours actually worked. It is the overall span in which work and intervals are scheduled; a 12-hour spread-over cap does not mean 12 hours of work, nor does it replace the separate daily and weekly limits.

How the break and overtime provisions read

Continuous work and rest

Before the amendment, section 12 required an adult worker to receive a break of at least half an hour before continuing beyond five continuous hours. The ordinance substituted six for five in that threshold. That change should not be described as eliminating the 30-minute duration: the cited description identifies the threshold change, not a removal of the break requirement.

Overtime

The ordinance raised the stated overtime ceiling from 125 to 144 hours in a three-month period. The prior Act provided overtime wages at twice the ordinary rate for work beyond daily or weekly limits. The interaction of those provisions under the current consolidated law should be checked before drawing a conclusion about an individual roster, pay calculation or claim; this overview is not individualized legal advice.

What changed for smaller establishments?

The ordinance raised the threshold for specified registration and related provisions from ten to twenty employees. Its statement says establishments with fewer than twenty workers would give an intimation instead of obtaining a registration certificate, while other statutory protections for their workers remain the same. This is a change to registration requirements, not a statement that workers at smaller establishments lose the Act’s other protections.

When did the ordinance take effect, and is it still the law?

The ordinance text is dated 1 October 2025 and says it came into force immediately; its promulgation date at the end of the text is 28 September 2025. The Maharashtra Law and Judiciary Department’s listing gives the ordinance a date of 31 October 2025. Those different dates appear in the official materials and should not be mistaken for proof of a later commencement date.

A Maharashtra Gazette published in November 2025 contains draft amendment rules and provides a 45-day period for comments before the draft would be considered. A draft notice is not evidence that final rules were notified. The Maharashtra Law and Judiciary Department lists the ordinance, but the cited official material does not establish whether later legislation replaced or continued it, or whether final implementing rules were subsequently issued.

Accordingly, as of 8 October 2026, the 2025 ordinance is evidence of the change it proposed and put into effect at its commencement—not, on the material cited here, a verified statement of the current consolidated law. Employers and workers should consult the latest enacted amendment and consolidated Act through Maharashtra’s official legal sources. For an individual case, the workplace’s coverage, applicable current text, schedule and pay records all matter.
