Legislation Looks to Limit Crop Protection Lawsuits

The Supreme Court’s Roundup ruling narrows one failure-to-warn claim, while state and federal lawmakers debate whether EPA-approved pesticide labels should limit more lawsuits.

Yes, pesticide manufacturers can still face lawsuits, but the legal path for some failure-to-warn claims changed on June 25, 2026. In Monsanto Co. v. Durnell, the Supreme Court held that federal pesticide law preempted the specific state claim that Roundup should have carried a cancer warning. That ruling is not a blanket ban on pesticide lawsuits, and state and federal lawmakers are debating how far protections for federally approved labels should go.

What the Supreme Court decided in the Roundup case

John Durnell alleged that he used Roundup for about 20 years and developed non-Hodgkin’s lymphoma. A Missouri jury found for him on a failure-to-warn claim and awarded more than $1 million. On June 25, 2026, the Supreme Court reversed the state appellate judgment and remanded the case, holding that the claim was preempted by the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA). The case history and ruling are set out in the Court’s opinion.

The Court’s decision turned on what Durnell’s claim would have required: a cancer warning on Roundup’s label. FIFRA bars states from imposing labeling or packaging requirements “in addition to or different from” federal requirements. The majority treated EPA’s approval of the label without that warning as a federal labeling requirement, so the state claim would have imposed a different one.

The decision resolves the preemption issue for the failure-to-warn claim before the Court. It does not establish that every pesticide-related claim, every warning theory, or every form of liability is barred. Nor did the Court decide whether glyphosate causes cancer; its holding addressed the relationship between FIFRA and the state claim.

Why EPA-approved pesticide labels matter

FIFRA gives the Environmental Protection Agency a central role in registering pesticides and approving their labels. Manufacturers generally must use the approved label unless EPA approves or requires a change. Section 24(b) of FIFRA, 7 U.S.C. § 136v(b), states: “A State shall not impose or continue in effect any requirements for labeling or packaging in addition to or different from those required under this subchapter.” The Supreme Court opinion explains how the majority applied that provision to Durnell’s requested cancer warning.

The dispute is about the boundary between that federal labeling system and state tort law. A failure-to-warn lawsuit can ask a court to hold a manufacturer liable for not providing a warning. When the warning sought would differ from the label EPA approved, FIFRA preemption may become central. The Court’s ruling addresses the claim and label at issue; it should not be read as deciding claims based on different conduct or legal duties.

How state proposals would limit lawsuits

State measures do not all create the same defense or cover the same claims. They can differ in which labels qualify, whether the rule reaches only failure-to-warn claims or a broader set of labeling-related claims, and whether it depends on EPA risk assessments or carcinogenicity classifications. Exceptions for alleged concealment or other misconduct also vary. The National Agricultural Law Center’s 2026 overview describes those differences and should not be treated as a current, definitive status tracker for every bill.

Florida SB 518 illustrates a conditional defense

Florida SB 518’s filed text would bar a specified pesticide-related products-liability action based on failure to warn if the federally registered pesticide’s label meets at least one of three conditions: it is EPA-approved, consistent with the most recent FIFRA human-health risk assessment, or consistent with EPA’s carcinogenicity classification.

The filed text also includes an exception where EPA determines that a manufacturer knowingly withheld, concealed, misrepresented, or destroyed material information about health risks or carcinogenicity to obtain or maintain label approval. The text lists July 1, 2026, as an effective date, but a date printed in a filed bill does not establish that the bill was enacted or took effect. The cited document alone does not verify its later status.

State enactments and proposals require state-by-state checking

The National Agricultural Law Center reports that Georgia and North Dakota enacted measures in 2025 to make a federally registered pesticide label a complete defense to state failure-to-warn claims. Its 2026 overview also describes proposals in Florida, Kansas, Kentucky, Missouri, and Tennessee, among other states. Because legislative sessions can end and bills can change, those descriptions do not establish the status of each measure as of October 2026. A bill’s status and effective date should be checked in that state’s official legislative history before relying on it.

What Congress is proposing

Congressional proposals reflect opposing views about whether federal label approval should limit state tort claims. They are proposals, not enacted changes to FIFRA based on the cited materials.

The People Over Poison Act would preserve state tort claims

Representatives Chellie Pingree and Thomas Massie introduced H.R. 9528, the People Over Poison Act, on June 29, 2026; it was referred to the House Committee on Agriculture. The introduced bill would amend FIFRA to protect state tort claims related to pesticide or device labeling or packaging. The introduced bill text confirms the proposal and referral. The sponsors’ announcement describes it as a response to Durnell. Those records do not establish further committee or floor action.

The House Agriculture Committee argues for national labeling uniformity

A 2026 House Agriculture Committee one-pager argues that EPA review and federally approved labels provide an enforceable national standard, and that state-specific labeling rules can create conflicting obligations. It also says the committee’s farm bill language would preserve state authority to regulate pesticides and liability for bad actors. These are the committee’s policy arguments, not established findings about the effects of any particular proposal.

Other measures appear in the congressional record index

The 2026 Congressional Record Index lists H.R. 9807, concerning state-law claims consistent with FIFRA misbranding standards, and H.R. 10144, concerning protection of certain state tort claims from federal preemption. The index confirms that the measures appear in the record; it does not by itself establish their current procedural status or the final content of any later versions.

What the debate means for people following a pesticide claim

The legal outcome depends on the claim, the warning sought, the pesticide label and the governing law. Durnell is significant for claims that would require a warning different from the EPA-approved label, but it does not answer every question about pesticide liability. State legislation could add or define defenses, while a change to federal law would depend on Congress enacting a proposal.

  • Do not assume an EPA-approved label makes a manufacturer immune from every lawsuit. The Supreme Court decided a particular failure-to-warn claim, not all pesticide-related causes of action.
  • Do not treat an introduced or filed bill as law. Check whether it passed, was signed, and took effect, using the relevant official court or legislative record.
  • Separate legal claims from scientific conclusions. The case history includes Durnell’s allegations and a jury award; the Supreme Court’s ruling was about statutory preemption, not a scientific finding on causation.
