What the January 2026 lawsuit reportedly seeks

Holtz Matthews LLP, the law firm representing Welk Jr., announced on February 5, 2026 that he had filed a complaint on January 20 in Los Angeles County Superior Court. The firm said the complaint sought dissolution of The Welk Group, Inc., as well as compensatory and punitive damages. The announcement’s headline cited $30 million, but the release does not establish that this amount was awarded or that a court approved it.

The defendants named in the firm’s account were Welk Jr.’s son Kevin Welk, The Welk Group, his nephew Jonathan Fredricks, and Stephen Baron. These details are reported from plaintiff-side counsel’s announcement; they are not a substitute for the filed complaint or a court ruling.

What Welk Jr. alleged about his removal

According to Holtz Matthews LLP’s summary of the complaint, a November 2022 board meeting changed the company’s rules so a person over age 74 could not serve as CEO, eliminated the CEO position, and led to Welk Jr.’s loss of that role. The firm said the complaint alleged that he continued to own 28.551% of the company’s stock after his removal.

The firm’s account says Welk Jr. alleged that the change also cost him monthly salary, a bonus, an expense account, and health benefits. It reported that the complaint put his lost monthly salary at $35,303. The same announcement relayed an allegation that Kevin Welk used $231,782.07 in company funds for an Aston Martin. These are accusations and figures attributed to the complaint by plaintiff’s counsel; they have not been independently verified here.

Business history described in the complaint

Holtz Matthews LLP said the complaint portrayed Welk Jr. as helping expand his father’s enterprise into music and resorts. The firm also said the pleading credited him with an instrumental role in selling Welk Music Group to Concord Music in 2015 and Welk Resorts to Marriott in 2021. Those descriptions come from the plaintiff-side account of the complaint, rather than an independent finding about his role.

Keep the separate 2024 age-discrimination case distinct

A separate lawsuit concerns allegations of wrongful termination, age discrimination, and failure to prevent discrimination. MyNewsLA reported on August 28, 2026 that this case was filed in February 2024 and that Welk Jr.’s widow, Lynn H. Welk, became plaintiff as personal representative of his estate after he died on February 5, 2026, aged 85.

That 2024 case is not the January 2026 dissolution-and-damages action. The February 2026 law-firm release referred to two other related cases and listed trial dates of August 17 and October 19, but the available sources do not establish outcomes or current status for those matters. The August date had passed by the time of the later report.

The available sources do not establish the January 2026 lawsuit’s case number, the filed complaint, a current calendar entry, a ruling, or its present procedural status. A federal docket mirror documents a different 2024 case involving Welk Jr. and The Welk Group that was removed to federal court and remanded to Los Angeles County Superior Court in May 2024. That record does not establish the status of the January 2026 suit.

Why the allegations are not a legal finding

The complaint’s account, as described by Holtz Matthews LLP, is one side’s version of events. A filing states claims and requested remedies; it does not by itself prove liability or mean the plaintiff will receive damages or dissolution. The law firm quoted attorney Jordan Matthews saying, “We will not tolerate their reckless and malicious abuse of our client and intend to hold them fully accountable for their reprehensible actions, attempting to tarnish the legacy of an 85-year-old man, and a giant in the industry.” That statement is counsel’s advocacy, not a court’s characterization.
