Karnataka’s November 2025 government order provides eligible women employees one paid menstrual-leave day per month, up to 12 days a year. It covers permanent, contract and outsourced employees aged 18–52 at registered establishments under five specified labour laws. The Karnataka High Court directed implementation of the policy in April 2026, pending formal enactment of the proposed legislation.
Who qualifies for menstrual leave in Karnataka?
Government Order No. KAI 466 LET 2023, dated November 12, 2025, applies to women employees aged 18–52 who work in permanent, contract or outsourced roles at registered establishments covered by any of these laws:
- Factories Act, 1948
- Karnataka Shops and Commercial Establishments Act, 1961
- Plantation Labour Act, 1951
- Beedi and Cigar Workers (Conditions of Employment) Act, 1966
- Motor Transport Workers Act, 1961
The Cabinet’s October 2025 announcement described the policy broadly as applying in government offices and private industries, mentioning garment, multinational and IT workplaces. But the November order supplies the specific coverage terms: registered establishments under the named laws. The announcement’s examples do not by themselves establish that every employer, informal workplace or employment arrangement is covered. Read the government order for its operative scope; the Indian Express report on the Cabinet announcement describes the broader stated intent.
How much leave is available, and what are the conditions?
- Entitlement: One paid day during the menstrual period each month, up to 12 days in a year.
- Use-by rule: The monthly day must be used in that same month. Unused leave cannot be carried forward.
- Medical certificate: The order does not require one to claim the monthly day.
These are the order’s stated entitlement and conditions, not figures about how many employees have used the leave.

Is the policy in force after the court case?
On December 9, 2025, the Karnataka High Court initially stayed enforcement of the November notification, then recalled that interim stay the same day and scheduled further hearing. The initial stay was therefore not the continuing outcome. The Hindustan Times report on the December proceedings describes the stay and recall.
On April 15, 2026, the High Court directed the state to implement the existing policy “strictly and faithfully” pending formal enactment of the proposed Karnataka Menstrual Leave and Hygiene Bill, 2025. The direction concerns implementation of the existing policy; it does not establish that the proposed Bill has been enacted. See the High Court case record.
