On May 27, 2025, U.S. District Judge Jeannette A. Vargas allowed four additional Treasury DOGE Team members to access Treasury payment systems, but only under specified safeguards. She refused to dissolve the preliminary injunction in full. The access claims were later dismissed as moot in September 2026 after the court found that DOGE and the Treasury DOGE Team no longer existed.
Which four DOGE employees were allowed access?
The May 27, 2025 order named Thomas Krause, Linda Whitridge, Samuel Corcos and Todd Newnam. The case was State of New York et al. v. Donald J. Trump et al., No. 25-CV-1144 (JAV), in the U.S. District Court for the Southern District of New York. Read the May 27 order.
Did the judge lift the restriction on DOGE access?
No. Judge Vargas denied the administration’s request to vacate the preliminary injunction in full, modifying it to create a conditional path for access. The injunction continued to restrict DOGE-affiliated personnel who did not meet its requirements. The four named employees could proceed without separate approval from the judge, and future individuals who met the same requirements did not need individualized court approval either. The order did not authorize unrestricted access.

- Complete specified training.
- Be vetted under the same requirements as other Treasury employees with system access.
- Be subject to mitigation procedures.
- Be a Treasury employee hired in accordance with governing statutes and regulations.
- Be supervised by and directly report to Treasury officials. The order’s conditions
The court had previously required information about training, vetting and security clearances, mitigation measures, legal hiring authority and reporting lines. In May, the government submitted declarations describing procedures for the four employees. The plaintiffs did not oppose their access under conditions comparable to those applied to Ryan Wunderly, but they continued to oppose dissolving the injunction altogether. The May order explained that the safeguards would remain while Treasury handled onboarding for people who qualified.
What happened to the lawsuit after DOGE ended?
On July 7, 2026, the court asked the parties whether DOGE’s apparent dissolution left live issues in the case. It noted that Executive Order 14,158 had scheduled DOGE to terminate on July 4, 2026. The July 7 order requested briefing on mootness.

In an opinion dated September 23, 2026, Judge Vargas found that DOGE and the Treasury DOGE Team no longer existed and dismissed the claims about DOGE-affiliated access as moot. The court separately dismissed the remaining claims under Rule 12(b)(6), concluding that the complaint did not plausibly allege the required final agency action or that specific federal payments had been frozen. The later decision ended the case in district court; it did not establish that the complaint’s disputed allegations were true or false. The available sources do not establish whether the September 2026 disposition was appealed.
