No. Indiana residents are not eligible to access or play Stake.us under the platform’s current rules. Stake.us lists Indiana as a restricted state, and its Terms & Conditions classify it as an “Excluded Territory.” That establishes the platform’s eligibility rule; it does not, by itself, settle how a court or Indiana regulator would classify every feature of Stake.us under state law.
Can Indiana residents use Stake.us?
No. Stake.us’s restricted-states help article, dated July 10, 2026, includes Indiana. Its Terms & Conditions also say residents of an Excluded Territory are not eligible to access or use the platform, create an account, or play. The restriction applies to Indiana residents, not just to whether a particular game is available.
What does “legal” mean in this case?
There are two separate questions: whether Stake.us allows Indiana residents to use its service, and how Indiana law would classify or enforce the platform’s model. The first has a clear answer in Stake.us’s current rules: Indiana residents are excluded. The Indiana Gaming Commission’s general explanation of gambling law provides context for the second, but does not determine how every Stake.us feature would be treated.
Stake.us’s description of its games
Stake’s terms state: “THE PLATFORM AND GAMES DO NOT OFFER REAL MONEY GAMBLING, AND NO ACTUAL MONEY IS REQUIRED TO PLAY.” The company describes Gold Coins as being for Standard Play and Stake Cash as being for promotional play; its terms say Stake Cash is obtained through free promotional offers and that promotional play can provide an opportunity to redeem prizes. These are Stake.us’s descriptions of its model, not a finding by Indiana authorities that the service is lawful in the state.

Indiana’s general gambling rule
The Indiana Gaming Commission says unlawful gambling under Indiana Code 35-45-5 involves risking money or property for gain contingent on chance, excluding bona fide contests of skill, speed, strength, or endurance. It also says unauthorized gambling operations are unlawful. This general guidance does not establish how a court would apply the law to every feature of Stake.us.
Can you create an account or get around the restriction?
No. Stake.us’s terms say residents of an Excluded Territory must not proceed, and describe access or play by those residents as a material misrepresentation and breach of the terms. The terms also prohibit efforts to bypass location restrictions, including masking or manipulating your real location or giving false location or residence information. A VPN or other location workaround is therefore not a permitted way for an Indiana resident to use the platform.

Did Indiana HB 1052 ban sweepstakes casinos?
Do not rely on claims that Indiana HB 1052 enacted a sweepstakes-casino ban effective July 1, 2026. The official Indiana General Assembly page for HB 1052 labels it “Various administrative law matters”; that official listing does not substantiate the claim. Stake.us’s Indiana restriction is established by its own current restricted-state page and terms, but the precise statutory or enforcement rationale for that restriction is not established by those sources.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Does the age requirement change the answer?
No. Stake.us’s terms require users to be at least 21, or older if local law sets a higher minimum age. Meeting the age requirement does not make an Indiana resident eligible while Indiana remains an Excluded Territory.

What Indiana residents should take away
- Platform eligibility: Stake.us currently excludes Indiana residents from access, account creation, and play.
- Location checks: The terms prohibit disguising or misrepresenting your location to evade the restriction.
- State-law question: Indiana’s general gambling guidance is relevant context, but it does not independently resolve the legal classification of every part of Stake.us’s model.
