Iowa Senate File 394 (SF 394), a 2025 proposal addressing pesticide warning-label lawsuits, passed the Iowa Senate 26–21 on March 26, 2025. The House referred it to Judiciary in April. Beyond Pesticides’ tracker later reported that it did not advance from that committee in 2026. The bill proposed a limited rule for certain warning claims—not immunity from every lawsuit.
What Iowa Senate File 394 proposed
The amended SF 394 addressed health and safety warnings for pesticides registered under the federal Insecticide, Fungicide, and Rodenticide Act. Under its proposed rule, an EPA-approved label—or a label consistent with the most recent federal human health assessment or EPA carcinogenicity classification—would be sufficient to satisfy specified state warning and labeling requirements and common-law duties to warn. The amended text is reproduced by LegiScan.
That language concerned specified warning duties. It did not say that following an EPA label barred every kind of claim: the text also said the rule should not be interpreted to prohibit a cause of action based on another provision or doctrine of state law. It is therefore more accurate to describe SF 394 as a proposal affecting certain pesticide failure-to-warn claims than as blanket protection from lawsuits.

Why supporters backed the proposal
During consideration by the Senate Judiciary Committee, Sen. Mike Bousselot, who chaired the bill’s subcommittee, described it as a “common sense” measure. He argued that a manufacturer should not face a failure-to-warn suit when it followed the federal rules governing warnings. In a February 19, 2025, report, Iowa Capital Dispatch quoted him: “It is the simple premise that someone should not be allowed to sue someone else … for failing any duty to warn, when that manufacturer followed every federal rule and regulation required to warn.” That is the supporter’s rationale, not a complete statement of the bill’s legal scope. Why pesticide warning lawsuits are contested
The proposal was part of a broader effort, backed by Bayer, to limit failure-to-warn claims involving pesticide products that follow EPA labeling guidance, according to the Associated Press. The AP reported that plaintiffs alleged glyphosate caused non-Hodgkin lymphoma, while Bayer disputed claims that Roundup causes cancer. Those are opposing claims, not findings established by the Iowa bill. The AP also reported that EPA had described glyphosate as not likely to be carcinogenic to humans when used as directed; that is the agency position as reported in the article, with the stated use qualification.

The Associated Press reported Bayer figures of about 177,000 lawsuits involving Roundup and $16 billion set aside to settle cases. These are figures attributed to Bayer in AP’s 2025 coverage, not independently audited totals, and they do not describe Iowa cases alone. Associated Press

What the proposal would—and would not—have changed
- Covered subject: specified state health or safety warning and labeling requirements and common-law duties to warn for pesticides registered under federal law.
- Proposed sufficiency standard: an EPA-approved label or a label consistent with the specified federal assessment or classification.
- Other claims: the amended text preserved the possibility of a cause of action under another state-law provision or doctrine.
- Legislative status: the Senate passed the bill in March 2025; it was referred to House Judiciary in April, and Beyond Pesticides later reported that it did not advance from that committee in 2026.
