What HF 2104 proposed—and what the House passed
House File 2104 concerns the exercise of eminent domain for carbon oxide pipelines. The House passed the bill on January 21, 2026, by 64 votes to 28. The bill then went to the Senate, which referred it to the Commerce Committee on January 22. The Iowa Legislature’s bill history records the bill’s subject and votes.
The House-passed version represented a categorical restriction on eminent domain for these pipelines. Senate Commerce changed that approach: rather than maintaining a complete bar, the committee recommended an amendment that would leave a limited path to eminent domain under specified conditions.
What the Senate Commerce Committee changed
According to Iowa Capital Dispatch’s January 28, 2026 report, the amendment would permit a hazardous-liquid pipeline operator to use eminent domain only after it “diligently exhausted” efforts to secure voluntary easements within a widened corridor. That is the reported broad approach; the available account does not establish the precise corridor width, the legal test for diligent exhaustion, or all procedural requirements and exceptions. Those details should not be assumed from the summary alone.

Why senators disagreed
Sen. Dan Klimesh, the Commerce Committee chair, said the change “would give us the ability to recognize property rights on both sides of this issue,” according to Iowa Capital Dispatch.

Sen. Janet Petersen sought to defer action so a related proposal could receive a subcommittee hearing and Iowans could weigh in. The report quoted her saying: “We deserve to follow democracy here, and there is a subcommittee that will be held on it tomorrow to give Iowans time to weigh in on the subject, and I don’t believe we should be voting on something without it being given due process.”
The report said all Democratic committee members opposed the amendment and the bill; Sen. Dave Rowley opposed the amendment but voted to advance the bill.

The official bill-history page, displaying an October 7, 2026 update, still lists HF 2104’s status as “Passed House.” Its recorded actions show the Senate committee recommendation, unfinished-business placement, and later amendment filing, but do not show final Senate disposition or enactment. That record is not enough to say the proposal became law—or to say definitively what its eventual outcome was.
