Input Tax Credit Under GST: Eligibility, Blocked Credits and Documents

A practical guide to India’s central GST input tax credit rules: eligibility checks, apportionment, blocked categories and exceptions, supporting documents, records and the claim deadline.

Under India’s central GST rules, a registered person can generally claim input tax credit (ITC) for goods or services used or intended for use in business—but only when the statutory conditions, apportionment rules, exclusions and filing deadline are satisfied. A GST charge on a purchase alone does not make it creditable.

Who can claim input tax credit under GST?

Section 16(1) of the Central Goods and Services Tax Act, 2017 gives a registered person the general entitlement to credit for input tax on goods or services “used or intended to be used in the course or furtherance of his business.” That entitlement is subject to the Act’s conditions and restrictions, including the apportionment rules and blocked-credit categories in section 17. See the CBIC text of the CGST Act, Chapter V.

Use this sequence as a practical screening aid, not as a separate statutory test:

  1. Confirm the recipient is registered for the relevant transaction and tax period.
  2. Establish that the goods or services are used, or intended to be used, for business.
  3. Check whether the purchase is subject to apportionment or falls within a blocked-credit category, including any applicable exception.
  4. Verify that there is a prescribed tax document and that the goods or services have been received.
  5. Check the tax-payment and return conditions, along with any payment-related reversal requirement.
  6. Confirm the claim is within the applicable time limit and preserve the supporting records.

Eligibility depends on the transaction, the recipient’s use, the tax period, registration status and any relevant exception. The general rule is not a blanket credit for every business expense.

What conditions must be met for a claim?

Section 16(2) sets out conditions that work together. For each purchase, check the following rather than relying on the supplier’s invoice alone:

  • Prescribed evidence: Hold a tax invoice, debit note or other document prescribed for the transaction.
  • Receipt: The goods or services must have been received. In specified circumstances, goods delivered to another person on the registered recipient’s direction are treated as received by that recipient. If goods covered by an invoice arrive in lots or instalments, the Act makes credit available on receipt of the last lot or instalment.
  • Tax payment: The tax charged on the supply must have been paid to the government, subject to the statutory framework referenced in section 16.
  • Return: The recipient must have furnished the return under section 39.

Two further rules can affect credit even after these checks. If the recipient does not pay the supplier the value of the supply plus tax within 180 days of the invoice date, the Act requires the relevant ITC to be added to output tax liability with interest as prescribed. The credit may be taken again when payment is made; the CBIC Input Tax Credit Rules describe the reversal procedure and interest. Separately, ITC is not available on the tax component of capital goods if depreciation has been claimed on that same tax component under income-tax law.

Which ITC is restricted or blocked?

First distinguish apportionment from a blocked credit. Under section 17(1) and (2), credit is restricted to the part attributable to business use when goods or services are also used for non-business purposes. Where inputs support both taxable supplies—including zero-rated supplies—and exempt supplies, only the amount attributable to taxable supplies is generally available, calculated using the prescribed method. Section 17(5), by contrast, blocks specified categories subject to stated exceptions. The CGST Act, Chapter V sets out these rules.

Purchase or use General treatment and important qualifications
Motor vehicles and other conveyances Credit is generally blocked, with exceptions including further taxable supply, passenger transport, driver or operator training, and transportation of goods.
Food, beverages, outdoor catering, beauty treatment, health services, cosmetic and plastic surgery Generally blocked, subject to exceptions for same-category taxable outward supplies and certain composite or mixed supplies.
Club, health or fitness-centre membership Generally blocked.
Rent-a-cab, life insurance and health insurance Generally blocked, subject to specified exceptions, including certain employee benefits that an employer is legally obliged to provide and same-category taxable outward supplies.
Employee vacation travel benefits Leave travel concession and home travel concession are generally blocked.
Construction-related works contracts and property Specified works-contract services for construction of immovable property, and goods or services used to construct immovable property on one’s own account, are generally blocked. The Act provides rules involving plant and machinery and further works-contract supplies.
Other specified items Credit is generally blocked for tax paid under the composition scheme; supplies received by a non-resident taxable person other than imported goods; personal-consumption supplies; goods lost, stolen, destroyed, written off, gifted or given as free samples; and specified taxes paid under sections 74, 129 and 130.

The construction rules need particular care. The statutory explanation includes reconstruction, renovation, additions, alterations and repairs to the extent they are capitalized. “Plant and machinery” has a statutory definition with inclusions and exclusions, so neither “all construction inputs are blocked” nor “all machinery inputs qualify” is a safe general rule. Check the precise category, facts and exception before claiming credit.

For a mixed-use or borderline purchase, assess business versus personal use, taxable versus exempt outputs, the statutory category and its exception, and the tax period and filing deadline. Calling something a business expense does not, by itself, settle its GST credit treatment.

What documents support an ITC claim?

The CBIC rules recognize several document types for claiming ITC: a supplier’s invoice under section 31, a debit note under section 34, a bill of entry or similar prescribed customs document for import IGST, and specified Input Service Distributor (ISD) invoices or credit notes. For a standard tax invoice, use this practical check against the CBIC invoice rules:

  • Supplier’s name, address and GSTIN.
  • A unique serial number and the issue date.
  • Recipient details and, where relevant, the place of supply for an inter-State supply.
  • HSN or service accounting code, as applicable; a description; and quantity where relevant.
  • Total and taxable value, the tax rate and tax amount.
  • Delivery address where it differs from the recipient’s address, reverse-charge status, and the supplier’s signature or digital signature.

Special cases and notified variations can change invoice requirements, so this is a working checklist, not an exhaustive rule for every document type. Supplier-reported invoice information and reporting procedures can also change: check the rules and portal requirements applicable to the filing period rather than relying on a fixed workflow.

Records that make the claim traceable

As a practical control, reconcile the purchase register against supplier-reported invoice data and the relevant return statements. Keep evidence of receipt and business use, plus payment evidence where relevant to the 180-day rule. These steps help substantiate the statutory conditions; they are not an exhaustive statutory document list.

CBIC’s Accounts and Records Rules address preservation of accounts and associated invoices, bills of supply, credit and debit notes, and delivery challans for the period provided by section 36, and require records to be kept at each related place of business and produced on demand. Check the currently applicable section 36 text for the retention period; no duration is stated here.

Shared services across state registrations

Where a consolidated input service is directly used by GST registrations in more than one state, CBIC’s Sectoral FAQs say the credit should be appropriately invoiced or distributed through the ISD mechanism to the distinct persons that actually used the service. ISD registration and distribution requirements have evolved, so confirm the rules for the relevant tax period before setting up the filing process.

What is the time limit for claiming ITC?

For the general section 16(4) deadline, CBIC Circular 237/31/2024-GST states that ITC on an invoice or debit note cannot be taken after 30 November following the end of the financial year to which it pertains, or the date the relevant annual return is furnished, whichever is earlier. The relevant annual-return date can therefore bring the deadline forward. See the CBIC circular dated 15 October 2024.

The Finance (No. 2) Act, 2024 inserted subsections 16(5) and 16(6) retrospectively for specified cases. The circular discusses that relief, but it is limited and fact-dependent; it should not be treated as a general extension for late claims. The CBIC Act webpage also displays older September-return wording for section 16(4), so the dated circular is the relevant reference here for the amended general date.
