It does not forgive the deferred tax. Treasury determinations and guidance must clarify who qualifies, what activity is covered, and when postponed taxes must be paid—uncertainties that industry groups say could limit the benefit.
What Trump’s dyed-diesel order does
The White House’s October 5 executive order, “Emergency Tax Relief on Diesel Fuel”, directs the Treasury secretary to determine within five days whether relief is authorized under 26 U.S.C. 7508A, including whether a qualifying event occurred and which taxpayers were affected.
If Treasury makes the required determinations, the order directs deferral, to the extent authorized by law, of eligible taxes imposed under specified provisions of 26 U.S.C. 4041 and incurred from October 5 through December 31, 2026. The order says deferred amounts are to accrue without penalties, interest, additional amounts, or additions to tax. It also directs Treasury to have the IRS announce that it will not impose specified penalties on dyed diesel sold for highway use or used on highways during that period.
The order requires later guidance explaining the covered taxpayers and activities, applicable conditions, and the date postponed taxes must be paid. It also directs Treasury to explore ways—including legislation—to eliminate the deferred payment obligation. That instruction is not itself tax forgiveness.

Why industry groups say relief could be limited
Fuel sellers face uncertainty and future liability
Energy Marketers of America urged retailers to “proceed with caution,” according to The Daily Beast, because availability, coverage, and conditions depended on Treasury decisions and guidance that had not yet been issued. The group’s reported summary was: “Deferral is not forgiveness.”
The Daily Beast also reported that the Society of Independent Gasoline Marketers of America and the National Association of Truck Stop Owners warned members that the tax would remain owed. They pointed to a practical complication: residual dye can linger in tanks and fuel systems. Their reported assessment was that the remaining liability and customer risk could outweigh a temporary, uncertain benefit for many fuel sellers.

Trucking representatives say the order does not solve supply constraints
Owner-Operator Independent Drivers Association president Todd Spencer said, as reported by The Daily Beast, “Allowing the wider use of red-dyed diesel will provide minimal relief. Market stability is essential to bring down costs for the long haul.”
In an October 7 report, IBTimes UK quoted Henry Hanscom, chief advocacy and public affairs officer for the American Trucking Associations, arguing that broader highway use of dyed fuel “does not create additional fuel or address the underlying supply crunch that is driving prices higher.” These are industry judgments, not measured estimates of the order’s price effect.

Does the order eliminate the diesel tax?
No. The order describes a conditional deferral of specified federal taxes, not an enacted cancellation of them. If Treasury authorizes the deferral, eligible taxpayers may have more time before paying, but the order calls for later guidance on the payment date and asks Treasury to explore options for eliminating the obligation. Until a lawful change is made, readers should not treat postponed payment as a tax saving.
Can truckers use red-dyed diesel on highways now?
The order directs the IRS to announce temporary non-imposition of specified penalties for dyed diesel sold for highway use or used on highways from October 5 through December 31, 2026. That direction is subject to applicable law and does not, on its own, settle every question about who is covered or under what conditions. Treasury and IRS guidance is needed to establish implementation details; do not assume that every trucker, seller, or transaction automatically qualifies.

Do states have to follow the federal order?
The order directs federal transportation officials to coordinate with state governments, industry, and labor while continuing compliance enforcement as provided by law. It also directs agriculture officials to coordinate with agricultural and fuel-distribution stakeholders to support dyed-diesel access for farmers in high-demand areas and encourage corresponding state action. Those directions do not establish that every state has changed its own tax rules or restrictions.
IBTimes UK reported that state taxes and restrictions are not automatically displaced and that practical effects may vary by state, seller, and route. Because state requirements are jurisdiction-specific, check current official guidance for the relevant state rather than assuming the federal order creates a uniform state-tax waiver.

What savings can drivers and farmers expect?
The White House fact sheet presents the policy as an effort to reduce costs for consumers, farmers, truckers, and workers, and describes red dye as a way to identify off-road diesel during enforcement. Those are the administration’s stated rationale and anticipated benefits, not a guaranteed saving for each purchase. The executive order itself makes federal tax relief conditional on Treasury’s determinations and applicable law.
The actual effect on fuel prices or an individual’s costs is not established by the available reports. The practical outcome depends on Treasury’s implementation, the taxpayer and activity covered, state rules, sellers’ willingness and ability to participate, and fuel-market conditions.
