Council records set an 18% GST rate for ENA for industrial use, while recording a policy decision to exclude ENA used to make alcoholic liquor for human consumption through a legal amendment. The Council’s published 54th-meeting record discussed that intended amendment and a review of past-period taxation; the later implementation status is not established here.
What the Supreme Court decided—and what it did not
In October 2024, a nine-judge Supreme Court bench ruled in a dispute over the states’ authority to regulate industrial alcohol. The Indian Express reported the result as 8:1 and said the majority read “intoxicating liquor” in Entry 8 of the State List to include industrial alcohol. That is a reported account of the decision; the primary judgment text is not cited here.
The decision concerned the constitutional allocation of regulatory authority. It was not, on the evidence available here, a ruling that automatically struck down GST on every supply of rectified spirit or extra neutral alcohol (ENA). A state’s authority to regulate an alcohol-related activity and the GST treatment of a particular supply are distinct legal questions.
How the Council records distinguish ENA by use
The GST Council’s records do not treat ENA as one undifferentiated tax category. The stated use of the supply matters:

Why the GST question remained open after the Council’s decision
The Council described an intended legal change
The 54th-meeting record says the Council had decided to exclude beverage-manufacturing ENA from GST and discusses a proposed legal amendment. The Secretary’s recorded statement was: “The Council has already decided to exclude ENA from the purview of the GST.” That records the Council’s stated policy; it does not establish that legislation was later enacted or commenced.
Past transactions needed separate attention
The same meeting record says an officers’ committee was studying taxation for past periods. States raised questions about regularising earlier transactions and continuing VAT collection. Those issues are separate from the Council’s prospective policy: a decision about intended future treatment does not, on its own, settle how earlier supplies should be treated.

The earlier dispute involved competing views
The Council’s agenda note records disagreement over ENA used to make beverage alcohol. Several states argued GST should not apply to those supplies. An Attorney General opinion took a different position, saying the cited Bihar Distillery decision did not remove the Centre’s or states’ power to levy GST on them. Those submissions explain the administrative dispute; they should not be mistaken for a final post-2024 determination of the law.
What businesses and readers can safely conclude
- Do not infer that the Court’s ruling cancelled GST. The reported Supreme Court decision was about state regulatory authority, while the Council’s records address GST treatment by use.
- Do not apply the 18% industrial-use rate to every ENA supply. Council materials distinguish industrial use from supply for manufacture of alcoholic liquor for human consumption.
- Do not treat the recommended exclusion as proof of an effective statutory change. The 54th-meeting minutes describe a policy decision and proposed amendment, alongside work on past-period taxation.
- For a live transaction, verify the governing legal text. Classification, end use, the applicable tax notification and the status of any amendment matter. The Council minutes alone are not a substitute for checking those materials or obtaining transaction-specific tax advice.
What is—and is not—known about the current position
A recent Economic Times opinion by former CBIC chair Najib Shah says industrial alcohol continued to attract 18% GST and argues that state excise rates should account for input tax credit. Those are the author’s claims and views, not a formal Council ruling. The opinion’s body reportedly gives the 2024 court result as “9-8”; contemporaneous reporting identifies an 8:1 outcome in a nine-judge bench.

The latest official implementation position after the published 54th-meeting record is not established here. In particular, that record does not confirm whether a later statutory amendment took effect or resolve the treatment of past periods. Nor do the cited materials provide a verified figure for revenue foregone or state collections.
