Form 161 is the prescribed application for a specific immunity request to an Assessing Officer under section 440 of India’s Income-tax Act, 2025 framework. It is not established as a general application to cancel any income-tax penalty. Rule 231 of the Income-tax Rules, 2026 requires this form for a request for immunity from a penalty under section 439 and from initiation of proceedings under section 478 or 479. The rules took effect on 1 April 2026.
What Form 161 is for
Rule 231, “Form of application under section 440,” says an application to the Assessing Officer for immunity from imposition of a penalty under section 439 and from initiation of proceedings under section 478 or section 479 “shall be made in Form No. 161.” Read the Income-tax Rules, 2026, rule 231.

The relief described is this specific immunity request, not an across-the-board waiver of income-tax penalties. The rule prescribes the application form; the Assessing Officer decides the application under the governing Act. Filing Form 161 alone does not establish that immunity will be granted.
First check which Income-tax Act governs your matter
The Income-tax Department says the Income-tax Act, 2025 took effect on 1 April 2026. It also says provisions of the repealed Income-tax Act, 1961 continue to govern matters involving tax years beginning before that date, including certain proceedings initiated on or after commencement. The applicable law therefore depends on the tax year and the proceeding, not simply the date you file. See the Department’s Objective and scope of the New Act FAQs.

Before treating Form 161 as the right route, identify the tax year involved and confirm whether the transition provisions leave your matter under the 1961 Act or place it under the 2025 Act framework. If that is unclear, ask a qualified Indian tax professional or the tax authority to confirm the governing law for your case.
How to apply—and what is not yet established
The verified rule establishes the form and receiving authority, but not a complete filing procedure. The official material cited here does not establish Form 161’s eligibility tests, required fields or enclosures, application deadline, decision timeline, or current e-filing portal path. Do not infer these details from another form or assume that submission itself secures relief.

- Identify the tax year and governing Act. Check the Department’s transition guidance and determine whether the 1961 Act or 2025 Act provisions apply to the matter.
- Confirm the statutory basis for the requested relief. Form 161 is prescribed for the section 440 application concerning the specified section 439 penalty and sections 478 or 479 proceedings.
- Check the current official Form 161 and applicable section 440 provisions. Confirm eligibility, supporting documents, deadline, submission channel, and any procedural requirements before filing; these details are not established by rule 231 alone.
- Submit to the Assessing Officer using the confirmed current procedure. Keep the application and proof of submission, and wait for the authority’s decision rather than treating filing as approval.
Form 161 is different from Form 34BC
Form 34BC belongs to a separate route: an application to the Dispute Resolution Committee under the e-Dispute Resolution Scheme for eligible “specified persons” under the Income-tax Act, 1961. The Department says the committee may grant penalty waiver or reduction and prosecution immunity when the scheme’s conditions are met. Its Form 34BC guidance sets out conditions for that scheme and directs applicants to the e-filing portal.

Do not transfer Form 34BC’s eligibility thresholds, fees, deadlines, or filing steps to Form 161. The forms have different statutory bases and go to different authorities.
