An NBFC’s invoice to a bank is not automatically exempt from GST, and the bank’s status does not by itself decide whether the NBFC must register. For a taxable service supplied by an NBFC that qualifies as a financial institution under the relevant rule, the general invoice deadline is 45 days from the date of supply. A compliant consolidated monthly invoice or statement is also permitted. The tax treatment depends on the actual service, charges, registrations and locations involved. This guide covers India’s rules as of 7 October 2026.
Does an NBFC have to charge GST when it invoices a bank?
Not in every case. First identify what the NBFC supplied and what the payment represents. CBIC’s GST Sectoral FAQs distinguish interest or discount for extending loans, advances or deposits from separate amounts charged over and above it. The FAQ treats additional charges—including service, administrative and entry charges—as taxable consideration. It also describes documentation fees and similar charges in invoice-discounting contexts as taxable.
So a fee does not become exempt just because it relates to a loan or financial service. But the available official material does not establish one GST rate or tax result for every NBFC-to-bank transaction. The service classification, applicable exemption or rate notification, supplier and recipient details, place of supply, and any specifically applicable reverse-charge entry all matter. CBIC’s Central Tax (Rate) Notifications index is a starting point for checking the relevant notification and amendments, not a decision on a particular service.
Does the NBFC have to register for GST?
Do not infer a registration obligation solely from the supplier being an NBFC or the customer being a bank. The invoice provisions discussed below apply to covered registered financial institutions; they do not, on their own, settle whether a particular NBFC must register.

That determination requires the current registration provisions and the facts of the business, including its aggregate turnover, legal entity and places of business, the locations from which it supplies services, and whether an inter-State supply or another compulsory-registration provision applies. Establish which GST registration is making the supply before preparing the invoice. The customer being a bank does not answer that question.
How long does an NBFC have to issue an invoice?
Under Rule 47 of the CGST Rules, insurers and banking or financial institutions, including covered NBFCs, generally have 45 days from the date of supply to issue an invoice for services. This is the special period for the covered class, rather than the ordinary 30-day period for service invoices.

There is a separate timing provision for certain taxable supplies between distinct persons under section 25 and Schedule I: the invoice may be issued before or when the supply is recorded in the supplier’s books, or before the end of the quarter in which it is supplied. That qualification applies only where the transaction falls within the provision; it is not a general extension for all bank customers.
Can the NBFC issue one consolidated monthly invoice?
CBIC’s GST Sectoral FAQs say a covered financial institution, including an NBFC, may issue a consolidated statement, invoice or advice at month-end covering the charges and GST for that month. This is an option for documenting the month’s charges, not permission to leave out required tax particulars.

Under Rule 54(2), as explained in the FAQs, the document need not be serially numbered and need not state the recipient’s address, but it must have an identification number and retain the other applicable particulars prescribed by Rule 46. A serial sequence is not required for that identification number. Where relevant, the issuer should report the document details with the recipient’s GSTIN so the recipient can match the transaction for input tax credit purposes.
Which document should the NBFC issue?
Section 31 of the Central Goods and Services Tax Act distinguishes the documents by the tax character of the supply. A registered supplier issues a tax invoice for a taxable service and a bill of supply for an exempt supply. In specified reverse-charge cases, a registered recipient also has self-invoicing and payment-voucher obligations. The right document therefore depends on the supply and the applicable charging mechanism, not merely on the fact that the customer is a bank.

Could reverse charge apply?
There is no general reverse-charge conclusion for all services an NBFC provides to banks. The official material includes reverse charge for specified supplies, including a recovery agent’s service to an NBFC, and refers to recipient self-invoicing in specified cases. Those examples do not establish that an NBFC’s service to its bank customer is subject to reverse charge.
Check the actual supplier, recipient, service description and locations against the current notification entry. If reverse charge does apply, identify which party has the tax-payment and documentation obligations for that particular supply.

Can an NBFC use the 50% input tax credit method?
Rule 38 of the CGST Rules describes an optional section 17(4) method for an eligible banking company or financial institution, including an NBFC engaged in accepting deposits or extending loans or advances. Under this method, the institution excludes tax attributable to non-business use and blocked credits under section 17(5), allows the specified credits, and takes 50% of the remaining input tax.
This is not an automatic entitlement for every entity called an NBFC. Confirm that the entity and its activities meet the rule’s conditions, then compare the method with the institution’s credit profile and the ordinary input-tax-credit treatment before electing it.
What about penal charges on loans?
CBIC Circular No. 245/02/2025-GST, dated 28 January 2025, addresses GST applicability to penal charges levied by regulated entities, including NBFCs, following RBI instructions to discontinue penal interest for non-compliance with loan terms. The circular states that those instructions took effect on 1 January 2024.
The stated scope does not include credit cards, external commercial borrowings, trade credits and structured obligations covered by product-specific directions. A charge’s label alone is not enough to determine its treatment: check the full circular and the relevant RBI direction for the product and charge before applying the clarification.

Practical checks before sending an NBFC invoice to a bank
- Identify the supplier registration. Confirm which GST registration is making the supply and whether registration is required for the NBFC’s facts.
- Describe the actual supply and payment. Separate interest or discount from additional fees, and identify any penal charge or other distinct amount.
- Check the tax treatment. Verify the applicable exemption, rate and place-of-supply rules for the precise service, and whether a current reverse-charge entry applies.
- Choose the correct document. Use a tax invoice for a taxable service or a bill of supply for an exempt one; account for any specified recipient self-invoicing and payment-voucher duties.
- Meet the timing and particulars rules. Apply the 45-day period where the NBFC falls within the covered financial-institution class, or the specific distinct-person timing provision where it applies. For a consolidated monthly document, include an identification number and the other applicable particulars, and report relevant details with the recipient GSTIN.
- Assess input tax credit separately. If considering the section 17(4) method, verify eligibility and compare its effect with the institution’s other credit treatment.
