Huawei’s 5G Royalty Push Explained: What Apple and Samsung Were Actually Asked to Pay

Huawei really announced plans to negotiate 5G royalties, but the $2.50 figure was a proposed cap—not proof that Apple or Samsung agreed to pay it.

Huawei did announce a plan to negotiate 5G patent royalties with Apple and Samsung in March 2021, but “demands” overstates what was publicly established. Huawei discussed negotiations and possible cross-licensing, citing a proposed ceiling of $2.50 per 5G handset. That figure was a cap, not evidence that either company accepted the rate or paid it. Huawei has since disclosed additional licensing activity, while the public record still does not show a detailed Huawei–Apple 5G agreement or Samsung’s commercial terms.

What Huawei announced in March 2021

Huawei’s chief legal officer said the company would seek royalty arrangements and possible cross-licenses with major smartphone makers, including Apple and Samsung. Contemporary reports described the proposed 5G handset royalty as no more than $2.50 per device, a level Huawei said would be below comparable charges associated with other major cellular patent holders. Bloomberg Law reported the original announcement, while The Business Times reported the rate and potential targets.

The announcement described the start of a licensing discussion—not a court order, invoice, injunction, or confirmed obligation for Apple or Samsung. Huawei also forecast $1.2 billion to $1.3 billion in patent and licensing revenue for 2019–2021, but that was a projection for its licensing business generally, not a 5G-handset-only estimate. Caixin’s account provides that broader financial context.

What a 5G royalty would cover

The proposed fee would relate to patents used to implement cellular standards, not ownership of “5G” as a whole. A standard-essential patent (SEP) is a patent that a manufacturer may need to practice in order to comply with a technical standard. A 5G phone can rely on SEPs held by many companies, including Huawei, Qualcomm, Ericsson, Nokia, Samsung, ZTE and others.

Huawei’s handset-licensing materials identify contributions such as Polar Codes and Massive MIMO among its 5G-related technologies. Those are Huawei’s descriptions of its portfolio; they do not, by themselves, prove that every asserted patent is essential, valid, infringed or enforceable in every country. FRAND limits the licensing claim

Huawei says it offers standard-essential patents on FRAND terms—fair, reasonable and non-discriminatory. In a real dispute, the parties can contest several separate issues:

  • whether the patent is granted and enforceable in the relevant jurisdiction;
  • whether it is genuinely essential to the applicable standard;
  • whether the phone practices the patent;
  • whether the proposed royalty is consistent with comparable licenses and the patent’s contribution; and
  • whether the matter should be resolved by negotiation, arbitration or litigation.

A declaration that a patent is standard-essential is therefore not automatic proof of validity, infringement or a particular payment amount.

How much was Huawei asking?

The effective economics of a license can differ from a headline cap. Rates may reflect geography, product category, portfolio scope, sales volume, past sales, litigation risk and reciprocal patent rights. “Per handset” also does not reveal whether a contract uses the entire phone price, a component value or another royalty base. Why Apple and Samsung would negotiate

Apple and Samsung each have substantial patent portfolios and may develop their own modem technology, but standard-compliant products can still practice patents owned by other companies. Owning relevant patents does not eliminate the need to license someone else’s SEPs.

Large technology companies often use cross-licensing: each side grants rights to specified patents, with a balancing payment if the portfolios are not considered equal in value. That arrangement can be more practical than a simple one-way royalty, particularly when both companies own cellular patents and want to reduce litigation across multiple countries.

Huawei’s smartphone business was under severe pressure after U.S. restrictions limited access to advanced chips and other components. Licensing offered a way to monetize research and standards contributions even where handset sales were constrained. Huawei presents licensing as part of its wider intellectual-property strategy, rather than attributing it solely to sanctions; its overview is at Huawei’s intellectual-property site.

What happened after the 2021 announcement?

Huawei’s later announcements confirm an active licensing program but do not fill in every detail of the Apple and Samsung discussions.

  • In July 2023, Huawei announced a handset program with a $2.50 5G cap and said it had entered patent licenses with Samsung and Oppo. The announcement did not publish the date, rate, product scope, payment direction or whether Samsung’s agreement resulted from the 2021 talks.
  • On August 25, 2023, Huawei and Ericsson announced a global cross-license covering 3G, 4G and 5G standards. Huawei described that agreement here.

Apple, Samsung and other companies: what is verified?

How to judge a headline about Huawei’s royalties

  1. Separate negotiation from enforcement. “Will negotiate” is not the same as a demand backed by an injunction or judgment.
  2. Check what the number represents. The $2.50 figure is a stated cap, not proof of the amount paid by every licensee.
  3. Look for patent-level evidence. Portfolio size does not establish that a particular patent is essential, valid and infringed.
  4. Ask whether the deal is reciprocal. A cross-license can reduce or eliminate a straightforward cash payment.
  5. Check the product scope and geography. Handset licensing is distinct from network-equipment licensing, and global agreements can contain confidential country-specific terms.

Why the story still matters

The episode illustrates how cellular standards turn research into an international licensing business. A few dollars per device can become material at global handset volumes, while cross-licenses can be strategically more valuable than a published per-unit fee. It also shows why 5G patent disputes are difficult to summarize: the commercial outcome depends on essentiality, validity, infringement, FRAND analysis, portfolio offsets and jurisdiction.

For readers evaluating the original headline, the reliable conclusion is narrower than the wording suggests. Huawei announced an initiative to seek 5G royalties and possible cross-licenses, and it published a $2.50-per-5G-handset ceiling. Public information does not establish that Apple accepted that rate, that Samsung paid it, or how much Huawei collected from either company.
