For Indian IT professionals, an H-1B job, an H-1B visa stamp, and permission to remain in the United States are three related but different things. The employer-sponsored classification controls the job and authorized stay; the visa stamp is generally the document used to request admission after travel. Wage rules, job-change portability, a September 2025 payment condition for certain new petitions, and 2026 visa-screening instructions can each affect your work and travel plans.
This guide explains the rules published by the U.S. Department of Labor, U.S. Citizenship and Immigration Services, and the U.S. Department of State. Agency instructions and individual outcomes can change, so use the dates and qualifications below when checking your own case.
What H-1B status means for an Indian IT worker
H-1B is a temporary, employer-sponsored classification for a “specialty occupation.” The job must require the theoretical and practical application of specialized knowledge and normally at least a bachelor’s degree, or equivalent, in the specific specialty. Your Indian nationality does not by itself make a position qualifying or disqualifying; the duties, requirements, your credentials, and the petition evidence are what matter.
The employer files the H-1B petition. The Department of Labor describes an annual limit of 65,000 regular H-1B numbers plus a 20,000 exemption for workers with qualifying U.S. advanced degrees. Those are program-wide statutory numbers, not a count of Indian workers and not a prediction of your approval odds.

Status, petition, and visa stamp are different
| Document or concept | What it does | What it does not do |
|---|---|---|
| H-1B petition | Shows that an employer seeks approval for a particular specialty-occupation job, location, terms, and period. | It is not itself a visa stamp and does not guarantee admission at a port of entry. |
| H-1B status and authorized stay | Controls whether you may remain and work in the United States under the approved terms and dates. | It does not automatically remain valid if you stop complying with the petition or authorized period. |
| Visa stamp | Generally lets you ask a U.S. consular officer for admission when you travel; the stamp’s validity is shown in the passport. | It does not extend your authorized stay or guarantee that Customs and Border Protection will admit you. |
Check the approval notice, passport visa, and most recent admission record separately. A mismatch in employer, worksite, dates, or job duties can require prompt advice from the employer’s immigration counsel.
How pay and workplace protections work
The employer’s wage obligation is generally the higher of two figures: the actual wage paid to workers with similar experience and qualifications in the specific employment, or the prevailing wage for the occupation and area of intended employment. The Department of Labor states: “You must be paid the actual wage, which is the same wage rate your employer pays other workers with similar experience and qualifications, or the local prevailing wage for the occupation in the area of intended employment, whichever is higher.”

Protections that affect your finances
- Employer-caused nonproductive time: Pay obligations can continue when a lack of assigned work is caused by the employer, subject to the governing rules and facts.
- Benefits: H-1B workers must generally receive fringe benefits on the same basis as comparable U.S. employees.
- Deductions and business costs: Employers cannot shift certain petition costs or business expenses to the worker when doing so would reduce pay below the required wage. Whether a particular deduction is lawful depends on the cost and circumstances.
- Working conditions: The employer attests to working conditions comparable to those of other workers in the occupation.
- Records and transparency: The Labor Condition Application (LCA) and related records must be available as required. Keep your own copies where possible.
- Retaliation: Workers are protected against retaliation for raising covered compliance concerns.
Records to keep
Maintain pay statements, time records, offer letters, worksite and employer addresses, job-duty descriptions, immigration notices, and a copy of the LCA if available to you. Preserve messages about unpaid bench time, required deductions, or a worksite change. A clean chronological file helps counsel or the Department of Labor evaluate what happened; it does not replace legal advice.

Often, yes, through H-1B portability—but a job offer alone is not authorization to move. Portability is designed for an H-1B worker who is already employed in valid H-1B status. The prospective employer must file a qualifying Form I-129 petition before your authorized stay expires, and the filing must be supported by an unexpired, approved LCA covering the new job. The Department of Labor describes the protection this way: “The portability provision enables an H-1B worker to change to a different job without the risk of being ‘out of status.’”
Before accepting the new role
- Confirm that you are currently maintaining H-1B status and have not passed the authorized-stay end date on your admission record.
- Give the new employer accurate information about your current approval, status, job, and work locations.
- Have the employer obtain an LCA that covers the offered occupation, wage, and work area, and verify that it is approved and unexpired when the petition is filed.
- Make sure the employer files a nonfrivolous I-129 petition before your authorized stay expires.
- Keep the filing receipt, LCA information, and the date you start work. Ask counsel how to handle any gap, withdrawal, or material change.
When the portability conditions are met, the cited Labor Department materials say the worker may begin the new employment after the qualifying filing and before adjudication. That protection depends on the filing and status facts; it is not a blanket rule for every transfer or for someone who is no longer maintaining status.

Does the new $100,000 rule apply to my current H-1B?
A presidential proclamation issued September 19, 2025, and State Department guidance dated September 21, 2025, describe a $100,000 payment condition for specified H-1B employment petitions filed with USCIS after September 21, 2025, at 12:01 a.m. Eastern Daylight Time. The proclamation restricts visa issuance and entry for covered cases unless the petition is accompanied or supplemented by that payment, with exceptions determined by the Department of Homeland Security under the proclamation.
USCIS’s September 20, 2025 memorandum describes the measure as prospective. It says the condition does not apply to beneficiaries of petitions filed before the effective date, beneficiaries of currently approved petitions, or holders of validly issued H-1B visas. The memorandum also says the proclamation does not affect current visa holders’ ability to travel to or from the United States.
How to analyze your situation
| Your fact | Why it matters |
|---|---|
| Petition filed before September 21, 2025, 12:01 a.m. EDT | The USCIS memorandum describes the payment condition as not applying to these beneficiaries. |
| Petition already approved | The memorandum says beneficiaries of currently approved petitions are outside the condition. |
| Validly issued H-1B visa | The memorandum says holders are not covered by the payment condition and may travel, subject to ordinary admission rules. |
| New petition filed after the effective time | Ask the sponsoring employer and counsel whether the $100,000 payment or a DHS-determined exception applies. |
This is described as a condition attached to specified petitions and entry, not as a personal fee that every H-1B worker must pay. Because proclamations and implementation can be amended or litigated, confirm the current agency instructions at the time of filing or travel.

Do H-1B applicants have to make social media public?
Yes, current State Department guidance updated September 18, 2026 says H-1B and H-4 visa applicants are subject to online-presence review and instructs applicants to make social-media profiles public or open. This is a visa-screening instruction. It does not itself change your underlying H-1B status, approve a petition, or guarantee visa issuance.
Practical preparation
- Review the usernames, profile links, and other information requested in the visa application carefully.
- Do not omit or misstate information. Inconsistencies between the application, interview answers, and public profiles can create questions.
- Preserve evidence of the petition, employment, qualifications, and travel purpose so you can answer consistently.
- Check the State Department’s latest notice before submitting an application because screening instructions can change.
Where should I book my visa interview?
Under State Department instructions dated July 15, 2026, nonimmigrant applicants should generally schedule interviews at a U.S. embassy or consulate in their country of nationality or residence. If you apply based on residence, you must be able to demonstrate that residence. The Department warns that applying elsewhere can make qualification more difficult.
For an Indian citizen living and working in India, that normally means using the designated U.S. consular process in India. An Indian professional legally resident in another country should be prepared to document that residence. Consular capacity, appointment availability, and local instructions can change, so follow the post’s current directions rather than assuming that a third-country appointment is interchangeable.

How long is an H-1B visa stamp valid for Indian citizens?
The India reciprocity schedule lists H-1B and H-4 visas as multiple-entry visas with a listed validity of 35 months. That is a country schedule, not a promise that every applicant receives exactly 35 months. Individual issuance remains discretionary.
Visa validity answers how long the stamp can be used to seek admission. It does not extend the authorized period of stay shown by your admission record, change the end date of an approved petition, or guarantee admission. At each entry, immigration officers decide whether you may be admitted and for how long under the applicable documents.
Can I travel to India and return with an expired visa stamp?
Generally, an expired stamp cannot be used as the ordinary document to request admission after travel. Your underlying H-1B status and an unexpired petition are separate questions, so an expired stamp does not automatically mean that your status inside the United States has ended. Before leaving, determine whether you will need a new visa appointment, whether your petition and passport documents remain valid, and whether any current travel instructions affect your case. Do not rely on the petition approval notice alone as a substitute for a visa stamp when one is required for your return.

Travel and job-change checklist
Before changing employers
- Check the authorized-stay expiration on your latest admission record.
- Confirm the new employer has an approved, unexpired LCA for the offered occupation and work area.
- Obtain proof that a nonfrivolous I-129 portability filing was made before your stay expires.
- Compare the new duties, wage, and location with the petition and LCA.
Before international travel
- Separate the expiration dates of your passport, visa stamp, petition approval, and authorized stay.
- Review whether your case falls within the September 2025 proclamation’s filing-date rules.
- If applying for a visa, use the interview location tied to nationality or demonstrable residence under the July 15, 2026 instruction.
- Prepare for the online-presence review that applies to H-1B and H-4 applicants under the September 18, 2026 notice.
- Carry the documents your employer and consular or port-of-entry instructions require, and avoid booking nonrefundable travel until the relevant approval is in hand.
What H-4 dependents should know
H-4 applicants are included in the State Department’s September 18, 2026 online-presence review instruction, and the India reciprocity schedule lists H-4 alongside H-1B with multiple entries and 35 months of listed validity. The materials summarized here do not establish when an H-4 spouse qualifies for employment authorization. Employment authorization depends on current USCIS rules and the individual’s facts, so obtain up-to-date guidance before treating an H-4 visa as work permission.

Get individualized immigration advice before acting if your employer has withdrawn a petition, you have a gap in pay or employment, your worksite or duties will materially change, your authorized stay is close to expiring, a new petition falls after the September 21, 2025 cutoff, or you have a prior refusal, status violation, or arrest. Keep a written timeline and your immigration and payroll records for the lawyer. Agency pages describe general rules; they cannot decide the outcome of your particular case.
The Bottom Line
Indian IT workers should treat H-1B status, the employer’s petition, and the visa stamp as separate controls. Verify wage and LCA compliance, use portability only after a qualifying filing, classify any new petition by the September 21, 2025 effective date, and plan visa travel around the 2026 interview and online-presence instructions.
