To transfer a house you inherited through a will, first confirm how the deed holds title and whether the property must go through probate. The executor named in the will may need to be appointed by a probate court before handling estate property. The required court documents, deed or succession filings, and tax-assessor notices depend on the law where the house is located. This is a U.S.-oriented overview; California examples below are not nationwide rules.
Start with the deed, the will, and the property’s location
Get a copy of the current deed and identify the state and county where the property sits. Check the exact way ownership is held: for example, in one person’s name, jointly with survivorship rights, through a trust, or in another form. A will may not control property that passes under a survivorship arrangement or trust, so confirm that it actually gives this property to you.
Also check for a mortgage or other recorded lien. The deed, will, and any trust or survivorship documents help establish whether the house is part of the probate estate and which transfer procedure may apply. The rules are local; the title information alone does not establish which procedure is available.
Does inheriting a house through a will require probate?
Not necessarily, but a will does not by itself eliminate probate. California Courts explains that an estate may need probate even when the deceased left a will. Whether probate is required—and whether a simplified or non-probate transfer is available—depends on the property, title, and law in the relevant jurisdiction.

If the house is a probate asset
The person named as executor commonly handles estate administration, but may need to petition the probate court and receive appointment as the estate’s personal representative before acting. That representative generally identifies and manages estate assets, addresses allowable bills and taxes, and distributes what remains according to the will and applicable law.
If a simplified procedure may apply
Ask the probate court in the relevant jurisdiction whether a simplified estate procedure covers real property and what eligibility limits, notices, waiting periods, or court approvals apply. Do not assume an affidavit designed for personal property transfers a house: California’s personal-property affidavit instructions expressly say it cannot transfer real property and direct users to separate procedures. Other states may have different real-estate procedures.

Use the procedure that can establish title in the property’s jurisdiction
The appropriate transfer document may be a court order, letters testamentary or other appointment papers, an affidavit, or a succession document. Which one is valid—and whether it must be recorded—depends on local law and the property’s title history. The estate representative or an eligible beneficiary should confirm the process with the court handling the estate and the county where the property is located.
California illustrates why there is no single nationwide “change the deed” step. Alameda County probate guidance says a deed is not necessary merely to change title to estate real property through its probate process. It separately describes recording a succession document when marketable title is needed. California also has procedures for qualifying real property, including a petition to determine succession and a small-value real-property affidavit; eligibility and document requirements must be checked in the current court materials. Those California procedures and limits do not establish eligibility elsewhere.

Update county records and ask about property-tax reporting
Before filing or recording anything, ask the probate court clerk and county recorder whether a certified court order or filed form must be recorded to show marketable title. A record that supports an inheritance transfer may not be the same document needed for a later sale or refinance, so explain your intended use when you ask.
Separately contact the county assessor to find out which death or change-in-ownership forms apply, the filing deadlines, and whether an exemption claim is available. A transfer can affect property-tax assessment, and any exclusion depends on the applicable rules and facts. For example, Alameda County’s guidance lists a notice of death and preliminary change of ownership report and describes a parent-child exclusion claim for qualifying cases. That is a county-specific example, not a promise that an exclusion applies to your transfer.

Notify the mortgage servicer and protect the loan
Contact the servicer promptly to report the death and ask how it confirms a successor in interest. Request the current balance, payment instructions, escrow information, insurance requirements, and any loss-mitigation information relevant to the loan. CFPB consumer guidance says the servicer may ask for proof such as the executed will and death certificate or a letter from the executor; the exact documents depend on the circumstances and applicable law.
Federal servicing rules provide protections for a confirmed successor in interest. Under the CFPB’s explanation of those rules, a successor generally is not personally liable for mortgage debt unless the successor assumes the obligation under state law. That does not erase the mortgage lien: the property remains collateral, and foreclosure may be available under the loan documents and applicable law if the debt is not paid. Keep payments current while the transfer is being resolved, if possible, and get case-specific advice if payments are in jeopardy.

Keep valuation, probate, and expense records for tax purposes
Retain the will, death certificate, court appointment and final order, recorded documents, valuation or appraisal records, property-tax statements, mortgage statements, and proof of expenses. IRS Publication 551 says inherited property’s basis is generally its fair market value on the date of death. An alternate valuation date may apply if the estate representative elects it. These records can matter if you later sell the house and need to report a gain or loss.
Federal estate-tax filing is a separate question for the executor; it is not the same as transferring title. The IRS instructions for 2026 Form 706 state a general $15,000,000 filing threshold for estates of U.S. citizens or residents dying in 2026, subject to the adjusted-gift and specific-exemption calculation described in those instructions. A return may also be required to elect portability of a deceased spouse’s unused exclusion, regardless of estate size. The executor should check the current instructions and the estate’s facts rather than treating the threshold as a title-transfer rule.
