To track a GST appeal deadline, record the date and proof that the order was communicated, identify the appeal stage, and calculate the statutory period from that communication date. For an aggrieved person’s appeal under section 107 of India’s CGST Act, the ordinary period is three months; a separate Tribunal appeal under section 112 also generally has a three-month period. Keep filing acknowledgements and set reminders well before the deadline. The exact date can depend on service facts, applicable rules and jurisdiction, so verify it for the specific matter.
How do I track GST appeal deadlines and avoid missing them?
- Preserve the order and its communication evidence. Save the complete order and record when and how it was communicated, together with supporting evidence such as the relevant notice or portal record. The statutory clock is tied to communication, not simply the date printed on the order.
- Identify the appeal stage and who is appealing. A taxpayer’s appeal to the Appellate Authority under section 107 is not the same as an appeal to the Appellate Tribunal under section 112. The department also has a distinct period under section 107(2).
- Record the statutory period beside the matter. Note the provision, start event and period, then have the actual due date checked against applicable time-computation rules, holidays, notifications and case circumstances. The Act states periods in months; do not substitute a universal number of days.
- Set early reminders and name an owner and backup. Schedule reminders well before the checked last date and assign responsibility for preparing and submitting the appeal. Do not plan to rely on condonation as extra filing time.
- Retain filing proof. For an Appellate Authority appeal, keep the provisional acknowledgement, evidence of certified-copy submission where required, and the final acknowledgement showing the appeal number.
- Recheck current requirements before filing. Confirm current rules and portal instructions, and ask a qualified GST professional to verify the deadline if the communication history, order or jurisdiction is unclear.
How many months do I have to appeal a GST order?
The period depends on who is appealing and which authority will hear it. Under the central CGST Act, the principal periods are:

These are central CGST Act periods, not a final calculation for an individual case. State or Union Territory legislation, notifications, amendments, the particular order and the communication facts may matter. Check the current applicable law before acting.
When does the GST appeal time limit start?
For the section 107(1) appeal, the three-month period for an aggrieved person runs from the date the decision or order is communicated to that person. For a section 112(1) Tribunal appeal, the Act likewise measures the three-month period from communication of the order. Record the communication date and how it can be established; do not assume the order’s printed date is the start date.

Because the clock is measured in months, not a fixed number of days, the final calendar date should be checked using the applicable time-computation rules and the matter’s facts. If service or communication is disputed or unclear, get a qualified adviser to review the evidence before relying on a calculated date.
Can the GST appellate authority condone delay?
For a section 107 appeal, section 107(4) says the Appellate Authority may allow presentation within a further period of one month if satisfied that sufficient cause prevented filing within the applicable three- or six-month period. The word “may” makes this discretionary, not automatic; the provision does not make that extra month a routine extension.
At the Tribunal stage, section 112(6) provides a different limit: an appeal may be admitted within three months after the ordinary period expires if sufficient cause is established. Do not apply the section 107 one-month allowance to a Tribunal appeal or assume that either provision guarantees acceptance of a late filing. Obtain case-specific advice if a deadline may have passed.
What filing records should I keep for a section 107 appeal?
The CGST Rules prescribe FORM GST APL-01 for an appeal to the Appellate Authority and link the filing date to acknowledgement and certified-copy requirements. Under the rule text, the appeal is treated as filed when the final acknowledgement indicating the appeal number is issued. Where a provisional acknowledgement is issued, the certified copy must be submitted within seven days for the provisional acknowledgement date to remain the filing date. Check the current rule and portal instructions for the matter before relying on this procedure.

- Retain proof showing when the certified copy was submitted, if required.
- Save the final acknowledgement, including the appeal number, and verify that it is available in the matter record.
These records help establish what was submitted and when; retain them with the order and communication evidence.

Create one record for each order so that dates and filing evidence do not get mixed across matters. Include:
- Taxpayer name and GSTIN, the authority, and the order identifier.
- Date printed on the order, separately from the date and method of communication.
- The source evidence supporting the communication date.
- Appeal stage, receiving authority, statutory provision and ordinary period.
- Checked internal due date, the person responsible, a backup and reminder dates.
- Submission acknowledgements and certified-copy proof relevant to the filing.
