How to Start a Production Company from Zero: An 11-Step U.S. Guide

Starting a production company begins with a clear offer and validated demand—not a universal budget or a camera purchase. Follow these 11 steps to build the business and prepare each project.

You can start a production company without buying a camera or renting a studio first. Begin by choosing what the business will sell, testing whether customers will pay for it, and estimating the costs. Then establish the business and build project-by-project systems for money, rights, permits, insurance, and hiring. The exact steps depend on your state and locality, the kind of production you do, and whether a project uses union performers.

1. Choose what your production company will do—and who will pay

“Production company” can describe several businesses with different customers, cash needs, and risks. Decide whether you will focus on narrative films, commercials, branded video, documentaries, production services, or a combination. Then identify the buyer: for example, a brand commissioning a video, a client hiring local production services, or an audience reached through a film you own or license.

Compare potential models on who pays, when cash arrives, who owns the finished work, how repeatable the work is, how much capital is needed before revenue, and who bears the cost of overruns. These are business choices to validate, not a ranking of which model is best. Write a concise description of your offer and test it with prospective clients, collaborators, and local industry contacts.

2. Validate demand and estimate the costs

Research likely customers, competing providers, the pace at which projects might arrive, and realistic revenue sources. Make a startup and operating-cost list for the work you intend to pursue, including any needed labor, space, utilities, insurance, government fees, and costs to win and deliver projects. The U.S. Small Business Administration (SBA) recommends market research and business planning to assess an opportunity and explain a company’s strategy; its planning guidance also notes that costs vary by location. There is no well-supported universal startup budget for a production company: a lean service business in one city and a company financing its own film projects have different costs. Build estimates around your model and location, and distinguish one-time setup expenses from recurring overhead and project-specific spending. Avoid taking on fixed expenses until you have a reason to expect they will help you secure or deliver work.

3. Choose an operating location

Location affects registration, taxes, zoning, local regulations, fees, and the agencies you may need to contact. It also changes access to clients, collaborators, labor, and production resources. Compare candidate locations on those factors rather than choosing solely for a perceived film-industry advantage. Verify any incentive program separately before counting on it in a budget.

Local film offices can help with location searches and permit information. For example, the California Film Commission’s production resources direct producers to regional film offices. That is a California resource, not a substitute for checking the rules in another state or locality.

4. Choose a legal and tax structure with qualified advice

Common options include a sole proprietorship, partnership, limited liability company (LLC), and corporation. Compare them based on ownership, personal-liability exposure, tax treatment, fundraising plans, setup and ongoing filing costs, and governance obligations. The SBA says structure affects taxes, fundraising, paperwork, and personal liability; the IRS explains that entity form affects federal tax return treatment. Neither source establishes one structure as best for every production business. Review the SBA’s launch guidance and IRS business-structure overview, then consult an attorney or tax professional familiar with your jurisdiction and plans.

An LLC is not automatically the right choice just because the company makes films. Ownership arrangements, planned investors, tax circumstances, state rules, and filing burden can change the decision. Do not treat a general description of a structure as individualized legal or tax advice.

5. Check and clear the company name

Before investing in a logo or public launch, check whether the name is available under your state’s entity-name rules and whether local assumed-name or “doing business as” (DBA) registration applies. Also check trademark conflicts and domain availability. A DBA is not a substitute for trademark clearance and does not override trademark rights. Requirements vary by business structure and jurisdiction; use the SBA launch guidance as a starting point, then verify with the relevant state and local offices.

6. Register the business and organize its records

File formation documents with the appropriate jurisdiction when required, and keep copies of filings and other formation records. Put ownership arrangements and the company’s operating or governance agreements in writing and store them where authorized decision-makers can access them. These records are not just administrative: SAG-AFTRA’s applicable production signatory guidance requests company formation documents and distinguishes between corporation and LLC records. Registration and paperwork requirements still depend on the jurisdiction and the project.

7. Set up tax IDs, accounting, and business banking

Determine whether the company needs an employer identification number (EIN), state tax IDs, payroll registrations, or other tax accounts. The IRS’s business-startup checklist explains the tax steps to consider. An EIN is free when obtained directly from the IRS; do not pay a third party solely to obtain one from the agency.

Set up a bookkeeping process to track income, expenses, payroll obligations, and the chosen tax year. The SBA recommends opening a separate business bank account once the business starts accepting or spending money. Keep company and personal transactions distinct, and retain project-level records so you can see what each production actually earned and spent.

8. Check permits, insurance, and workplace obligations

Ask the relevant federal, state, county, city, property-owner, and film-office contacts what applies to the company’s ordinary operations and to each shoot. Permit needs and fees depend on the activity and location; filming on private property, in a public space, or at a controlled location may involve different requirements. Confirm rules before promising a location or shoot date.

Insurance requirements are also location- and activity-specific. New York City, for example, requires commercial general liability proof for many permit applications and specifies certificate details on its film-permit insurance page. That is an NYC example, not a nationwide rule. Ask the relevant permit office and property owner what documentation they require, and consult an insurance professional about coverage appropriate to the work.

9. Build a rights and paperwork process before developing or producing a project

For each project, establish who owns or controls the script and underlying material, and document the rights needed to produce, distribute, or license the work. Depending on the project, this may involve written assignments, work-for-hire arrangements, performer or location releases, music and other third-party permissions, and distribution or licensing agreements. Have entertainment counsel review project-specific rights and contracts; the necessary documents depend on the material and intended use.

Rights records can matter in formal production processes. SAG-AFTRA’s theatrical getting-started guidance identifies screenplay registration, assignments, and distribution or license agreements among the chain-of-title materials it reviews. Its signatory process is relevant when seeking coverage under an applicable union agreement, not a universal filing requirement for every production company.

10. Plan staffing, budgets, and union compliance for each project

Prepare a realistic project budget and schedule, identify the cast and crew you need, and create a consistent hiring and payroll process. If you plan to use SAG-AFTRA performers, identify the applicable agreement early and confirm current eligibility, terms, and application timing directly with the union. The applicable agreement depends on the project; do not assume every production company must become a signatory.

SAG-AFTRA’s official pages describe the scope of particular agreements. The Theatrical Agreement applies to films shooting entirely in the United States with a total budget greater than $2,000,000 and to films shooting outside the United States, according to the page accessed in 2026. The Low Budget Agreement describes coverage for films shooting entirely within the United States with a total budget less than $2,000,000, also on the page accessed in 2026. These are descriptions of those agreements, not a general threshold for all union work or a guarantee that a project qualifies. The union requests advance applications and project records that can include a line-item budget, cast list, script, and day-out-of-days; check the current agreement for exact requirements before work begins.

11. Make a first-project plan and turn it into a repeatable system

Before committing to production, connect the essential pieces in one project plan:

  • Rights sufficient to make and use the project.
  • A finance plan and a separate project budget.
  • A realistic schedule, locations, and any required permits.
  • Appropriate insurance and hiring arrangements.
  • Written client, distribution, or licensing terms, as applicable.
  • A delivery plan and records for tracking actual costs and cash flow.

After the project, compare actual income, costs, and timing with your estimates. Use that record to adjust future budgets and decide which kinds of work the company can take on responsibly. This project-level discipline helps separate a viable business from a string of productions whose costs and obligations are hard to track.
