To reduce the risk of buying mislabeled seeds or receiving a shipment that may violate U.S. import rules, check who is selling the seeds, what the listing says about the variety and origin, and whether overseas imports meet USDA requirements. A suspicious package is a reason to pause and report it—not proof by itself that you were defrauded or that the seeds are dangerous.
How to evaluate a seed offer before you buy
Check the seller and the listing
Look for a seller that identifies itself and provides meaningful information about the seed, including its kind, variety and origin. Be cautious when country-of-origin details are missing or appear false, particularly when a listing involves a foreign shipment. USDA APHIS identifies seeds ordered from foreign online sellers that omit or misstate their country of origin as examples of potentially non-compliant imports. That warning does not, on its own, establish fraud.
For seed covered by the Federal Seed Act, required label information can include purity, germination, noxious weed seed content, treatment when present, kind and varietal identity, and the interstate shipper’s name and address. Requirements depend on the seed and transaction, so this is not a universal checklist for every retail packet. See USDA AMS’s Federal Seed Act information.
Do not treat one clue as proof
A low price, polished photographs, a domestic-looking website, or a shipping detail that seems unusual can prompt questions, but no single clue proves a seller is fraudulent. The official guidance supports checking details and reporting concerns, not applying a definitive consumer fraud test. APHIS recommends buying locally when possible and checking documentation as practical ways to reduce import risk; neither guarantees that a seller is legitimate.

Check import rules before ordering from abroad
In the United States, an online buyer bringing seeds or plants from another country is considered the importer and is responsible for checking the rules. Many seeds require a permit or other documentation; some categories are exempt or have special requirements. Do not assume a marketplace listing or a website that looks domestic means a shipment can enter without restrictions. Check the requirements for the particular seed using APHIS guidance on buying seeds and plants online and its small-lots seed requirements.
The small-lots pathway has specific conditions, including limits on seeds per packet and packets per shipment, exclusions for prohibited or specially regulated seeds, invoice and packet-label details, secure packaging, and permit and shipping steps. APHIS says the permit process can take up to two months. These rules describe a particular import pathway, not a general allowance for all seed purchases.

What to do if seeds arrive unexpectedly or seem suspicious
If a package contains seeds you did not order, or you suspect an imported shipment does not comply with requirements, follow APHIS’s instruction: “Do not plant the seeds.” APHIS notes that seeds may carry pests or diseases, but an unexpected package alone does not establish that its contents are dangerous or that a seller committed fraud.
- Keep the seeds and package intact. Do not plant them, discard them, or mail them on your own.
- Report the package promptly and contact your State Plant Health Director. Follow the handling directions in APHIS’s guidance for non-compliant seeds.
- Preserve the details officials may need. Note the date received, carrier and tracking number, whether you placed an order, and the vendor or website if applicable. Keep the invoice and photograph the seeds and package labels.
- Store the seeds as APHIS directs. APHIS says to seal them in a bag and place them in the freezer until contacted. Retain the packaging and documents until state officials contact you.
- If you already planted them, report that too. Ask APHIS for next steps rather than trying to handle the plants or seeds independently.
APHIS estimates that about one-third of the seed shipments discussed on its page were intentionally ordered from websites that appeared U.S.-based but were operated overseas and shipped internationally. This is an estimate about the shipments APHIS discusses, not the share of all seed orders or all seed scams. For suspected foreign-origin agricultural products that may have been illegally imported or sold, APHIS also accepts reports through its Smuggling Interdiction and Trade Compliance (SITC) reporting route.

Where to report fake, mislabeled or illegal seeds
Choose the reporting route based on the concern. A labeling or seed-quality complaint is different from a suspected illegal import; keep receipts, seed packets, shipping labels and photographs that relate to your report.

APHIS’s page on non-compliant seeds was last modified April 23, 2026. Import requirements vary by seed type and can change, so check the current agency instructions before ordering or handling a questionable shipment.
