You can sell food online from home only if the food, kitchen, sales method, and delivery plan are allowed where you operate. Start by checking the rules for your exact product and location; a listing on Etsy or a Shopify store does not grant permission to make or deliver it. This guide focuses on the United States, where requirements vary by state and locality.
1. Define the food and where you plan to sell it
Before building a store or accepting orders, write down what you will make and how customers will receive it. Regulators may treat products differently depending on ingredients, preparation, packaging, and whether you sell for pickup, deliver locally, mail orders, or ship across state lines.
- Product: List the food, ingredients, preparation method, and packaging.
- Sales area: Identify your state and local jurisdiction, plus any other states where you plan to sell or deliver.
- Fulfillment: Specify customer pickup, your own delivery, a third-party delivery service, or carrier shipment.
Use those details when contacting your state or local food authority. The FDA also directs food businesses to consider federal, state, and local requirements in its food business startup guidance. There is no universal list of foods that every home seller may make or ship.
2. Confirm that your home kitchen and sales plan qualify
Ask the responsible state or local agency whether your specific food is eligible for home production and what conditions apply. Confirm the requirements before investing in ingredients, packaging, equipment, or a website.

- Is this product allowed under the jurisdiction’s home-food or cottage-food rules?
- Do you need registration, a permit, food-safety training, an inspection, or a commercial kitchen?
- Are there sales limits or restrictions on venues, delivery methods, or where customers may be located?
- Does the answer change if you mail orders or sell to customers in another state?
Federal rules also matter, but they do not replace state and local approval. The FDA says private residences are not facilities required to register under the federal food-facility registration rule. That is not blanket permission to sell any food from home: the FDA still advises businesses to review applicable rules, and safe-production and other requirements may apply.
State rules illustrate why the exact location and fulfillment method matter. Connecticut’s Department of Consumer Protection says cottage-food operators may advertise and take orders online but must deliver directly, in person, within Connecticut; mail and third-party delivery are not allowed under that guidance. Florida’s 2026 statute, by contrast, permits internet and mail-order sales for qualifying cottage foods. These are examples, not a complete state-by-state guide: check the current requirements with the authority for your location.
Florida’s 2026 statute sets a $250,000 annual gross-sales ceiling for cottage food operations. Michigan’s agriculture department states a $50,000 yearly gross-sales threshold for cottage food producers. Those figures apply to the respective state programs; they are not national limits or estimates of what a seller will earn. Check the current Florida statute, Florida cottage-food guidance, and Michigan selling and samples guidance for program details.

3. Set up safe production and recordkeeping
Plan how you will make, store, package, and hand off each product under safe and sanitary conditions. The FDA’s startup guidance discusses food-safety obligations and recordkeeping for food businesses. The exact obligations depend on the product and applicable rules, so ask the responsible agency what records and procedures your operation needs.

Do not assume your kitchen has been inspected—or that an online platform has verified it—unless the relevant authority has actually required and completed an inspection.
The FDA Food Code is a model used by jurisdictions, not a universal home-business permit. The FDA identifies the 2026 edition as its most recent full edition; local rules determine what applies to a particular seller.

4. Prepare packaging and labels before listing the product
Ask your regulator which label information is required for the product and jurisdiction. FDA guidance says manufacturers are responsible for legally compliant labels and that labeling must be truthful and not misleading. Etsy likewise puts responsibility for applicable labels and warnings on sellers in its Seller Policy.
Florida’s 2026 statute provides one state-specific example of required cottage-food label details: operator name and address, product name, ingredients in descending order by weight, net weight or volume, and allergen information. Do not treat that list as a nationwide template; confirm the rules for your product and location with the relevant authority.

Before accepting payment, make sure the product page and package communicate the information customers need to order and handle the food safely. Keep descriptions accurate, including ingredients and allergens, storage directions, and any limitations on pickup or delivery.

5. Choose a delivery method the rules allow
Online ordering, local pickup, direct delivery, mail order, and interstate shipping are separate choices. Permission to advertise or accept an online order does not necessarily permit every way of fulfilling it. Check the governing rules for both your operation and intended delivery area, and confirm that the carrier will accept the food and packaging.
Connecticut’s online-sale guidance, for example, allows advertising and ordering online while limiting qualifying cottage-food delivery to direct, in-state, person-to-person delivery. Florida’s 2026 law permits internet and mail-order sales for qualifying cottage foods. Neither example establishes what another state allows. For interstate orders, verify the requirements that apply to the product and distribution model before offering shipping nationwide.

Etsy and Shopify are options to evaluate, not a regulatory shortcut or a source-supported ranking of the best platforms. Etsy is a marketplace; Shopify can support a branded standalone store. In either case, the seller remains responsible for complying with applicable food rules.

The table describes channel differences, not a performance or fee comparison. The available official sources do not establish a universal fee winner or sales-performance ranking. Compare current platform terms, order-management features, customer-information needs, and fulfillment limits before choosing. Etsy’s Seller Policy and Shopify’s legal compliance guidance make clear that platform availability does not itself authorize production or delivery.
7. Check the unit economics and customer details before launch
Work out what each order costs to produce and fulfill before setting a price. A basic planning calculation is:
Contribution per order = amount collected − ingredients − packaging − labor − platform and payment charges − delivery − expected refunds and waste.
Use your actual costs and the platforms’ current official terms; do not rely on generic fee or profit estimates. Include time spent preparing, packing, communicating with customers, and making deliveries. If the resulting amount does not cover your costs and labor, revise the price, portion, product, or fulfillment method before taking orders.
Set customer expectations on the listing and order confirmation: what is included, how allergens are disclosed, when the order will be ready, whether it is pickup or delivery, where you can fulfill it, and how the food should be stored. State only shipping or delivery options that you have confirmed are lawful and operationally available.
