How to Sell Food Online: A U.S. Startup Checklist

Selling food online starts with confirming that your product, kitchen, label and delivery area comply with the rules that apply to them. Then choose a sales channel and build a costed, tested fulfillment plan.

You can sell food online only after confirming that your particular food, preparation setup, business location and delivery area meet the rules that apply to them. Start by identifying those details, then choose a permitted production route, check product and label requirements, select an ordering channel, and work out packaging and delivery before accepting more orders than you can safely fulfill. This guide takes a U.S. perspective; requirements differ by state and locality.

Start with the food, the kitchen and the customer’s location

“Food” is not one regulatory category. The product and the way you make, store and deliver it can change which rules apply. Before building a storefront or advertising a menu, write down:

  • What you will sell: the specific product and its ingredients.
  • Where and how you will make it: a private residence, a permitted commercial kitchen or another facility.
  • How it must be stored: shelf-stable, refrigerated, frozen or otherwise specially handled.
  • Where the business is based and where customers will receive orders: including whether you plan to sell only locally, elsewhere in your state or across state lines.
  • How customers will buy it: direct orders, a marketplace, a storefront or another arrangement.

Use those answers to ask the relevant state and local health and regulatory authorities what is allowed for your exact product and sales method. The FDA’s food-business startup guidance describes federal considerations and points sellers to state and local requirements; it is an overview, not a tailored permit determination.

Choose a production route that permits your product and sales plan

Home-based or cottage-food sales

A cottage-food route may let some sellers make eligible foods at home, but states set the rules. The permitted products, required training or registration, labeling, sales channels and customer geography can differ. A food that is eligible in one state—or under one sales arrangement—may not be eligible in another. Check your state’s current list and conditions for the food you actually plan to sell before taking orders.

Do not treat federal facility-registration rules as a general home-business exemption. The FDA says a private residence where FDA-regulated food is made is not a “facility” required to register under that federal requirement. The FDA separately advises home-based businesses to review applicable federal, state and local rules, so the registration exemption does not by itself establish that a product or sales plan is permitted.

Production in a commercial facility

If the food or sales plan does not fit your state’s cottage-food rules, ask the relevant authorities whether production in a permitted commercial facility is an option and what requirements apply. Which registrations, permits, inspections or other controls are needed depends on the food, facility and jurisdiction; there is no reliable one-size-fits-all permit list for an unspecified product and location.

Foods that may have additional federal requirements

The FDA identifies low-acid canned foods, milk, eggs, juice, seafood and infant formula as examples of foods with additional product-specific requirements. These are reasons to check the FDA’s guidance and the relevant regulator before investing in equipment or launching sales, not a complete list of regulated food categories.

Confirm the rules for selling to customers online

Permission to make a food at home does not automatically tell you whether you can sell it through every online channel or deliver it to every destination. Check whether the rules for your product allow the specific combination of online orders, direct sales, shipping or carrier delivery, and customer locations that you intend to offer.

State examples show why the answer cannot be generalized nationally. Under Florida’s 2025 cottage-food statute, qualifying operations may take internet or mail orders and deliver directly or by USPS or commercial carrier, subject to the statute’s conditions. Alabama’s cottage-food guidance allows online direct sales when the recipient is in Alabama. Neither example establishes permission for a seller in a different state or for every food.

Before listing a delivery area, confirm the rules with the authorities responsible for your business location and intended customer destinations. Do not assume that permission for in-state delivery also permits interstate shipping.

Make the label accurate for the food you sell

Food manufacturers are responsible for labels that comply with the applicable legal requirements. Depending on the product and the rules that apply, a label may need an ingredient statement, nutrition information and allergen declarations. Cottage-food laws can also impose their own label rules, so a label format used by another seller is not necessarily suitable for your product.

The FDA’s January 2025 allergen guidance explains that covered foods regulated under the FD&C Act are misbranded unless each major food allergen is declared on the label using the name of its food source. Check the current guidance and applicable state rules for your product rather than relying on a universal template. The FDA notes that sellers may hire commercial laboratories to analyze nutrient content; consider qualified assistance if you need to determine nutrition information for your label.

Choose an ordering channel around the business you can operate

A standalone online store, an online marketplace, social ordering or a local ordering model may all be options to investigate. No channel is automatically best: compare its costs and transaction terms with the way you plan to find customers, manage orders and fulfill them. Also confirm that the channel’s policies and your local permissions fit the food and locations you plan to serve.

  • Costs: identify the platform, payment-processing and other transaction costs, then determine how they affect the amount left from each sale.
  • Customer relationships and discovery: consider whether customers find you through the channel or through your own outreach, and what customer information and follow-up options the channel provides.
  • Order management: check whether the workflow can handle your menu, order limits, pickup or delivery schedule, and any product-specific instructions.
  • Fulfillment and geography: confirm how orders move from purchase to handoff and whether the channel supports only the destinations you are permitted to serve.

Work out the money before setting prices

For each product, list the costs that change with an order: ingredients, packaging, payment or platform charges, and delivery costs you cover. Also account for your labor and any other business costs when deciding whether the price supports a sustainable operation. A useful first calculation is:

Amount remaining per order before fixed costs and other overhead = selling price − order-related variable costs.

This is not profit: it does not account for fixed costs or every expense. Use it to test whether your planned price and delivery offer leave enough to cover the rest of the business, and revise the menu, portion, pricing or delivery terms if the numbers do not work. Do not base prices only on ingredient cost.

Match packaging and delivery to the product and route

Food delivery is a food-safety concern, and there is no single container or shipping method that suits every product. Choose packaging for the food’s handling needs and the actual route, including transit time, temperature requirements, fragility, leakage risk, package weight and carrier availability. Packaging must also work with applicable labeling rules.

Before expanding delivery, test a real shipment or delivery under the conditions you intend to use. Check the product when it arrives and review any breakage, leakage, temperature or timing problems. This is a practical way to identify issues; it is not a substitute for any required food-safety controls or regulator guidance. The FDA discusses food delivery as an area of food-safety concern in its overview of new business models and retail modernization.

Launch in a manageable first batch

  1. Settle the compliance questions first. Confirm that your production location, product, label, online sales method and delivery destinations fit the applicable rules.
  2. Keep the initial menu and delivery area limited. A smaller launch makes it easier to manage order volume and identify problems in production, packaging and fulfillment.
  3. Calculate costs and set order limits. Include the costs that change with each sale and choose a quantity you can produce and deliver reliably.
  4. Take a controlled first set of orders. Track the time, costs and fulfillment issues associated with those orders rather than assuming the process will scale unchanged.
  5. Review feedback and adjust before expanding. Use customer comments and delivery experience to refine the product, workflow or service area, while rechecking regulatory requirements if the product or sales plan changes.
