To check a mortgage escrow analysis, reconcile its past-year deposits and payments against your account records and bills, then check next year’s tax and insurance estimates, any shortage repayment, and the projected account cushion separately. A higher monthly mortgage payment can reflect higher future bills, repayment of a prior shortage, or both—not necessarily a calculation error. This guide covers general U.S. rules for covered federally related mortgage loans; loan terms, state law, and regulatory exceptions can affect the result.
What your annual escrow analysis should show
Federal Regulation X defines an escrow analysis as a trial running balance used to set target balances, calculate upcoming monthly escrow payments and deposits, and determine whether the account has a shortage, surplus, or deficiency. A servicer generally must provide an annual statement within 30 calendar days after the end of the escrow computation year. The statement should let you trace both what happened and what the servicer expects to happen next. CFPB Regulation X, 12 CFR § 1024.17
- The current and prior monthly payment, including the escrow portion.
- Total escrow deposits during the past year.
- Itemized payments for property taxes, insurance, and other escrowed charges.
- The account’s ending balance and the treatment of any surplus.
- How a shortage or deficiency will be handled.
- Projected and actual low balances when relevant to the analysis.
Reconcile the statement against your records
Work through the analysis in date order. A spreadsheet or paper worksheet can help you add deposits and disbursements and track the running balance; it does not replace comparing the entries with bills and payment evidence.
- Verify deposits. Match each escrow deposit to the escrow portion shown on your mortgage statements and to your bank or payment records. Flag a payment or credit that is missing, duplicated, or posted in the wrong amount.
- Verify disbursements. Compare each tax, insurance, or other payment with the corresponding bill or invoice. Check the payee, amount, and payment date. For taxes, confirm whether the bill was paid by the deadline and whether a late charge or penalty appears.
- Compare last year’s estimates with actual charges. Look at each category separately. Under Regulation X, when the servicer knows a charge for the next computation year, it must use that amount. If it does not know the charge, it may generally use the prior year’s charge or adjust it by no more than the most recent annual change in the all-items Consumer Price Index.
- Rebuild the projected running balance. Starting from the account balance, add the projected deposits and subtract the expected disbursements in their expected months. Compare your result with the statement’s projected low balance and target balance.
- Check the cushion. For covered accounts, the cushion is generally limited to one-sixth of estimated annual escrow disbursements—equivalent to two months. Your loan documents or applicable law may impose a lower limit, so do not treat the federal maximum as an automatic allowance in every case.
Separate the reasons for a payment increase
Compare the old and new payment by component rather than treating the difference as one unexplained “escrow increase.”

A correct past-year account can still lead to a higher payment if next year’s taxes or insurance are expected to cost more. Conversely, a shortage repayment may increase the bill even if future estimates have not changed. The statement should identify how any shortage or surplus is being treated.
Understand shortage, deficiency, and surplus
These terms describe different account conditions. Regulation X defines a shortage by comparing the account balance at analysis with the target balance; a deficiency means the account has a negative balance. Check the account history and projected running balance to see which condition the statement reports, rather than assuming the terms are interchangeable.

- Surplus: If a current borrower has a surplus of at least $50, the servicer generally must refund it within 30 days of the analysis. For a smaller surplus, the servicer may refund it or credit it against future escrow payments.
- Shortage below one monthly escrow payment: The servicer may leave it in the account, collect it within 30 days, or spread repayment over at least 12 months.
- Larger shortage: The servicer may leave it in the account or spread repayment over at least 12 months.
- Deficiency: Because the balance is negative, inspect the dates and amounts that produced it and follow the statement’s stated handling. Ask the servicer to explain any amount or schedule that does not reconcile.
These are general federal rules for covered accounts, and exceptions or applicable loan terms may matter. See 12 CFR § 1024.17 for the regulation.
Common errors and mismatches to look for
- A mortgage payment, escrow deposit, or account credit is absent or recorded for the wrong amount.
- A tax or insurance payment has the wrong amount, payee, or date compared with the bill or invoice.
- A next-year estimate ignores a charge amount the servicer already knew.
- The projected cushion exceeds the applicable cap, without a lower limit in the loan documents or law being accounted for.
- The shortage or repayment schedule does not match the statement’s own running-balance figures.
- A tax bill is shown as unpaid even though the escrow history lists a disbursement, or taxes were paid late despite sufficient escrow funds.

How to dispute a suspected servicing error
For a covered mortgage, send a written notice of error to the servicer’s designated address for those notices. Use the address specified for error notices—not simply a payment address—and make the issue specific enough for the servicer to investigate.
- Identify the loan. Include your name and loan identifier, such as the account number shown on your statement.
- Describe the exact discrepancy. Give the statement line, amount, and relevant date or period. Explain what you believe is wrong and what the bill, invoice, payment record, or prior projection shows instead.
- Attach useful evidence. Include copies, not originals, of relevant tax bills, insurance invoices, mortgage statements, payment confirmations, or other records. For an unpaid property-tax issue, include the tax bill.
- Keep a complete record. Retain the letter, attachments, and proof of delivery, along with the escrow analysis and supporting bills.
- Continue scheduled payments. A notice of error does not itself change your mortgage payment obligation. Keep making scheduled payments while the servicer investigates.
For covered notices, Regulation X generally requires acknowledgment within five business days. The servicer generally must correct the error or investigate and respond within 30 business days. For many errors, it may extend that response period by 15 business days if it sends written notice of the extension and its reasons before the original deadline. For covered escrow accounts, a servicer generally must pay escrowed items by the deadline needed to avoid a penalty when the borrower’s mortgage payment is no more than 30 days overdue. If your history shows a late tax or insurance payment, compare the due date, the disbursement date, and the status of your mortgage payments. When a mortgage is paid in full, the servicer generally must return escrow funds still under its control within 20 business days, subject to regulatory exceptions. CFPB Regulation X, 12 CFR § 1024.34
