Start by reading the complete notice: identify the assessment year, issuing authority, response deadline, questions and requested evidence. Then reply through the Income Tax Department’s e-Filing portal under Pending Actions > e-Proceedings, addressing each point with relevant records. Before explaining whether foreign salary belongs in your Indian return, establish your residential status for the relevant year and reconcile the salary and any foreign tax credit with the return actually filed.
Read the notice before preparing a reply
A notice about foreign salary does not, by itself, establish that the salary was omitted, that tax is due, or that a foreign tax credit is available. The notice’s wording and the facts for the relevant tax year determine what you need to explain. Do not prepare a general statement about overseas work in place of answering the specific questions.

- Sign in to the official Income Tax Department e-Filing portal and open Pending Actions > e-Proceedings.
- Find the proceeding connected with the notice. Download and read the complete notice and any accompanying documents or earlier communications.
- Record the issuing authority, section or proceeding reference, assessment year, response deadline, every question asked and each document requested.
- Check whether the notice gives specific submission instructions, including attachment formats or file-size limits. Follow the instructions displayed for that proceeding.
The Department describes e-Proceedings as a way for registered users or their authorized representatives to view and respond to notices, intimations and letters. The actual notice controls what the department is asking you to provide; an overview of the portal is not a substitute for its instructions.
Make a working list of the notice’s separate requests before drafting. For each one, note the information requested, the document that supports it, and where that information appears in the Indian return or foreign records. This simple mapping helps prevent a response that explains the salary generally but leaves a specific question unanswered. If the notice refers to prior correspondence or a particular figure, include that reference in your working notes and check it against the document rather than relying on memory.

Check the deadline and the type of proceeding
Use the deadline stated in your notice, not a deadline remembered from a different notice or tax year. Notices and proceedings can have different purposes and response requirements. Identify the particular proceeding and answer its questions rather than assuming that every notice about foreign income calls for the same documents or explanation.
Submit well before the stated deadline where possible. The Department’s e-Proceedings FAQ says response availability can lapse after a Centralized Processing Centre (CPC) due date and may also depend on whether the proceeding remains open or has been blocked by the authority. It also says that a submitted response cannot be edited. Because portal options and proceeding status matter, do not assume that a late response or an incorrect submission can be fixed through one universal route.
These are practical reasons to plan time for gathering records, not a reason to substitute a remembered general deadline for the one shown in the notice. A response may require records from an employer or foreign tax authority, so check what you already have early. If a requested item is missing, do not wait until the final hours to decide how to handle it; review the notice and current portal instructions and, if the missing evidence affects a material point, seek professional advice promptly.

Establish your residential status for the relevant year
Before drawing a conclusion about how foreign salary should be treated in an Indian return, work out your Indian residential status for the relevant previous year. Citizenship, the location of your employer, the country where salary was paid, and the country where you live now do not, on their own, settle that question.
The Income Tax Department’s residential-status overview for AY 2026–27 points to section 6 and relevant day-count tests, but expressly describes the guidance as general and non-exhaustive. Apply the rules relevant to the assessment year in the notice to your actual dates and circumstances. Do not carry a conclusion from one year into another without checking the facts and rules for each year.
For a useful status check, gather travel and presence dates for the relevant period and the facts needed to apply the tests that govern that year. Where relevant, retain travel records or other contemporaneous evidence supporting those dates. If the status is disputed, the day count is difficult to establish, or other personal circumstances affect the result, get advice from an India-qualified tax professional rather than asserting a category on the basis of a rough estimate.

The practical comparison is between the status categories that may apply for the year—resident, non-resident and, where relevant, resident but not ordinarily resident—not between where you consider your home to be and where your employer is located. The category matters because it can affect the analysis of foreign income, but the reviewed guidance does not make the result automatic for every salary arrangement. First establish the correct category under the rules for that assessment year; then check the return disclosures and any relevant treaty position against that result. Do not use a category from a later year, or an assumption based only on being paid abroad, as a substitute for that analysis.
Reconcile the foreign salary with the return
Compare the salary described in the notice with the employer’s records, the money received and the disclosures in the Indian return for the year in question. A clear reconciliation helps show what figures you used and why they may differ. The notice determines which records to attach; the following records are useful when they relate to the questions asked.
| Record or information | What it can help establish |
|---|---|
| Employer compensation or annual salary statement | The salary amounts and periods reported by the employer. |
| Payslips and proof of salary receipts | How compensation was paid and when amounts reached your account. |
| Foreign tax certificate, assessment or withholding statement | Foreign tax reported as withheld, assessed or paid. |
| Proof of foreign tax payment or deduction | Support for the amount of foreign tax claimed as paid or withheld, particularly when seeking foreign tax credit. |
| Return acknowledgment and relevant schedules | What was filed in India, including the foreign-income and tax-relief disclosures relevant to the notice. |
| Travel or day-count records, where relevant | Dates used to support the residential-status position. |
Make the reconciliation specific. Match amounts and dates to the relevant return schedules and explain differences only where they apply—for example, differences in currency conversion, the timing of salary receipts, reimbursements or split workdays. Do not add an explanation for a circumstance that did not occur, and do not treat a bank receipt alone as a complete explanation of how the salary was reported.
If the notice asks about a difference between employer records and the return, state the figures being compared, identify the relevant period and show how you arrived at the amount disclosed. If you cannot reconcile an amount from the documents available, do not present an unsupported figure as certain. Explain the uncertainty accurately and seek professional help if it affects the response.
A useful reconciliation is not just a total. It should let a reader follow the salary from the employer record to the receipt and then to the relevant Indian return disclosure, to the extent those records and the notice call for it. Keep the underlying records available, and make clear which amounts or dates explain a difference. Where there are multiple periods, payments, or currencies, identify the relevant period and conversion basis used rather than combining everything into a single unexplained number. Explain reimbursements, split workdays or timing only if they actually apply to your facts and are relevant to the question asked.

Check the filed return’s foreign income and tax-relief schedules against the salary and tax records. The Department’s guide to the FSI and TR schedules says to include the applicable treaty article when claiming relief under a tax treaty, and to report foreign tax credit details and income in Form 67. Which treaty provision, tax year and personal circumstances apply depends on the case. A foreign tax payment does not automatically eliminate Indian tax.

When a resident taxpayer claims credit for foreign tax paid, the Department’s Form 67 FAQ and manual say Form 67 is to be filed online by the section 139(1) return due date. The form calls for foreign income and foreign tax information, supported by evidence of foreign tax paid or deducted. The FAQ says a certificate from a chartered accountant is not mandatory to submit Form 67. That does not, by itself, establish eligibility for a credit or its amount; those require applying the rules to the income and foreign tax in the particular case.
If the notice concerns a credit, compare the foreign tax claimed with the supporting statements and payment or withholding evidence, then check the Form 67 information and relevant return schedules. If you did not claim credit, do not describe the notice response as a claim unless you have checked whether and how a claim can properly be made for that year. If the return’s disclosures do not match the documents, identify the actual difference rather than suggesting that a foreign tax credit automatically resolves it.
There are two distinct questions to keep separate: whether the salary and foreign tax were correctly disclosed, and whether the foreign tax credit claimed is supported and available under the applicable rules. A certificate or withholding record can support what was paid or deducted, but it does not alone settle the credit computation. Likewise, a treaty-based relief claim has its own relevant article and factual context. Check that the amounts and income information in Form 67 and the FSI/TR disclosures correspond to the records and the return for the year at issue; do not assume that an overseas tax payment is a substitute for reconciling the Indian filing.

Build a focused response and submit it in e-Proceedings
Respond to every question in the notice in its own clearly identifiable part of the submission. Attach records that directly substantiate each answer; an undifferentiated upload of every tax and banking document can make it harder to see what supports a particular point.
- Open the relevant proceeding from Pending Actions > e-Proceedings and choose the portal’s Submit Response flow.
- Answer the notice’s questions in order. Tie each explanation to the relevant year, amount, return disclosure or document, as applicable.
- Attach the records requested in the notice and the supporting material needed to substantiate your answers. Use the formats and size limits shown by the portal.
- Review the response and attachments for accuracy before submitting. In particular, check that amounts, dates, assessment year and the position taken on residential status or foreign tax credit agree across the submission.
- Submit the response, save the transaction ID and confirmation, and then review the submission in e-Proceedings to verify the record of what was filed.
Keep a copy of the full notice, prior communications, filed return and acknowledgment, response text, attachments and portal confirmation together. This makes it possible to identify exactly what the department asked and what you submitted if the proceeding continues.
Before submission, compare the draft answer with the notice item by item. A concise answer can still be complete if it answers the question directly and points to the relevant attachment. Check that the attachment is readable and relates to the figure or fact discussed; where there are several files, use clear file names or descriptions if the portal allows them. Do not add a claim or factual explanation that is not supported by the records. Because the FAQ says the response cannot be edited after submission, this review is especially important.

Evidence checklist: send what answers the notice
- The complete notice and any relevant prior communications.
- The filed Indian return, acknowledgment and foreign-income or tax-relief schedules relevant to the questions.
- Employer compensation statements, payslips and proof of salary receipt, when salary figures are at issue.
- Foreign tax certificates, assessments or withholding statements and evidence of payment or deduction, when foreign tax or credit is at issue.
- A concise reconciliation of amounts, dates and currency conversions where those explain a difference.
- Travel or day-count records if residential status is relevant to the notice.
- The response, submitted attachments, transaction ID and portal confirmation.
This is a practical selection guide, not a required bundle for every proceeding. The exact notice determines what to provide. Include supporting material relevant to the question; avoid sending unrelated personal records merely because they are available.

A notice focused on salary figures may call for employer statements, payslips, receipts and the relevant return disclosure. A question about foreign tax credit makes the foreign tax evidence and Form 67 information more central. A question about residential status makes the relevant travel or day-count records pertinent. In every case, match the documents to the requests actually made and retain a copy of what you submit.

If response submission is unavailable, or you discover a mistake after submitting, promptly review the notice, proceeding status and options currently shown in the portal. The Department’s FAQ notes that response availability can depend on the deadline and whether the proceeding remains open or is blocked by the authority, and that a submitted response cannot be edited. The official materials do not establish one remedy that applies to every notice or error.
Do not assume that resubmitting, emailing documents or using a general grievance route will correct the issue for your particular proceeding. Check the current portal instructions and consider an India-qualified tax professional promptly, especially where the deadline has passed, the proceeding is no longer open, or the error changes the tax position or evidence submitted.
When to get India-qualified professional advice
Consider advice from an India-qualified tax professional with relevant cross-border individual-tax experience if residential status is uncertain or contested, salary and tax records do not reconcile, treaty relief or foreign tax credit eligibility is unclear, a response deadline has passed, or a submission error cannot be corrected through the portal’s available options. The relevant year’s rules and your individual facts matter; a generic answer about foreign salary cannot resolve those issues.

Frequently Asked Questions
How do I respond to an Indian income tax notice about foreign salary?
Read the complete notice and note its issuing authority, assessment year, deadline, questions and requested records. Sign in to the official e-Filing portal, open Pending Actions > e-Proceedings, select the relevant proceeding and use its Submit Response flow. Answer each question and attach focused evidence that supports the answer. Save the transaction ID and confirmation, then review the submission in e-Proceedings.
Is my foreign salary taxable in India if I live abroad?
Living abroad, foreign citizenship, an overseas employer or payment into a foreign account does not alone determine the answer. Establish your Indian residential status for the relevant previous year under the rules applicable to the assessment year in the notice. The Department’s AY 2026–27 overview points to section 6 and relevant day-count tests but says it is general and non-exhaustive. Apply the actual facts and seek India-qualified advice if status or treatment is disputed.
Can I claim foreign tax credit for salary tax paid overseas?
Do not assume a foreign tax payment automatically eliminates Indian tax or creates a credit. Check eligibility and computation under the rules relevant to your facts and year, and reconcile the foreign income and tax with the Indian return. The Department says a resident taxpayer claiming credit files Form 67 online by the section 139(1) return due date and supplies foreign income and tax details with evidence of foreign tax paid or deducted.
The Tool Desk
Outbyte PC Repair FREERepair Windows errors before they cause bigger problemsFix Now →Outbyte Driver Updater FREEScan for outdated or missing drivers - takes under a minuteDriver Scan →Do I need a chartered accountant’s certificate for Form 67?
The Department’s Form 67 FAQ says a CA certificate is not mandatory to submit Form 67. That does not mean a credit is automatically available or establish its amount. The foreign income and tax information still needs to be reported and supported with evidence, and the applicable eligibility and computation rules must be considered.
What documents should I attach to my response?
Start with the notice’s specific requests. Depending on the question, relevant records may include the filed return and foreign-income or tax-relief schedules, employer compensation statements, payslips, proof of salary receipt, foreign tax certificates or withholding statements, proof of foreign tax payment or deduction, a reconciliation of figures and dates, or travel and day-count records. Avoid an undifferentiated bundle of unrelated documents.
What if the response deadline has passed or I cannot submit online?
Check the current proceeding status and the options displayed in e-Proceedings promptly. The Department FAQ says response availability can lapse after a CPC due date and may depend on whether the proceeding remains open or is blocked by the authority. The reviewed official materials do not establish one universal remedy for every notice. Consider qualified professional advice rather than assuming an email, resubmission or general grievance will resolve it.
Can I edit a response after submitting it?
The Department’s e-Proceedings FAQ says a submitted response cannot be edited. Review your answers, dates, amounts, assessment year, attachments and position on residential status or foreign tax credit before you submit. If you discover an error afterward, promptly check the notice and current portal options; there is no single remedy established for all proceedings.
Should I submit every salary and bank document I have?
No. The checklist is practical guidance, not a required bundle for every proceeding. Select records that answer the notice: for example, salary statements and receipts for a salary discrepancy, foreign tax evidence for a credit question, or travel records when residential status is relevant. Keep copies of the full notice, response, attachments and submission confirmation.
The Bottom Line
Read the exact notice, confirm its deadline and requested evidence, then answer through e-Proceedings with focused records and keep the transaction confirmation. Reconcile the foreign salary and any credit with the filed return only after establishing residential status under the rules for the relevant year. If the portal is closed, a submission contains an error, or the facts are disputed, check current options and seek India-qualified professional advice promptly.
