Responding to a Section 74 GST show-cause notice requires more than reconciling a tax difference. The notice alleges that tax was unpaid or short paid, an erroneous refund was granted, or input tax credit was wrongly availed or utilised because of fraud, wilful misstatement, or suppression of facts to evade tax. Read the notice and annexures, map every allegation to your records, challenge errors in both the amount and the Section 74 basis, and file a documented reply through the prescribed GST process. Check the exact deadline, form instructions, tax period, State-GST counterpart and current law before deciding whether to contest, pay, or use a combination of lawful responses.
What a Section 74 notice means
Section 74 of the Central Goods and Services Tax Act, 2017 (CGST Act) is the fraud-related route for recovering:
As an Amazon Associate I earn from qualifying purchases.
- tax that was not paid or was short paid;
- an erroneous refund; or
- input tax credit (ITC) wrongly availed or utilised.
The statutory allegation is not simply that the department found a mismatch. The shortfall, refund or credit issue must be alleged to have occurred by reason of fraud, wilful misstatement or suppression of facts to evade tax. The proper officer’s notice asks the recipient to show cause “as to why he should not pay the amount specified in the notice” (CGST Act, Section 74(1)), together with applicable interest under Section 50 and penalty.
A notice is an allegation, not a final finding. Your response should therefore deal separately with (1) whether the underlying tax, refund or ITC demand is correct and (2) whether the evidence establishes the additional Section 74 ground. A correct reconciliation alone may not answer a disputed fraud allegation, and a denial of fraud alone may not answer an undisputed tax calculation.

First actions after service
Preserve the complete record
Download the notice from the GST portal and save the PDF, summary, annexures, workings, portal delivery message and any email or physical service record. Keep the envelope, delivery proof and a screenshot showing when the notice became available. Preserve earlier correspondence, including any DRC-01A intimation, audit communication or summons that the notice refers to. Do not annotate the only copy; work from duplicates so the original remains intact.
Establish the operative deadline
Use the date, mode and legal provision stated in the notice to calculate the response date. There is no safe universal number of days for every notice: amendments, extensions, the type of proceeding and the applicable State-GST law can change the calculation. Record the date in a calendar and build in time for scanning, review, portal upload and a possible technical failure. If the notice is unclear about the deadline, obtain written clarification rather than assuming that an email date, download date or printed date controls.
Check who issued it and for which law
Confirm the issuing authority, GSTIN, tax period, registration state, legal provisions and demand head. A State GST authority may issue a corresponding notice under the State GST enactment, while an integrated or central issue may involve the CGST Act. The reply must use the law and portal route identified in the actual notice; this article cannot determine which authority has jurisdiction in an individual case.

| Notice item | What to record | Questions for your reply | Documents to test it |
|---|---|---|---|
| Allegation | Transaction or credit described by the officer | Is it admitted, disputed, incomplete or misdescribed? | Invoices, contracts, correspondence and ledgers |
| Period | Tax month, quarter or financial year | Does the item fall in the stated period? | Return data, books and dated source records |
| Amount | Tax, interest, refund or ITC calculation | Can the arithmetic and rate be reproduced? | Return workings, payment challans and reconciliations |
| Legal basis | Section, rule and classification relied upon | Does the provision apply to these facts? | Registration details, supply documents and prior rulings or filings |
| Section 74 ground | Words and evidence said to show fraud, wilful misstatement or suppression to evade tax | What act, omission, knowledge or concealment is specifically alleged? | Filings, disclosures, audit trails and contemporaneous communications |
| Department evidence | Statements, third-party data, mismatch reports or investigation material | Is the source complete, attributable and consistent with your records? | Reply documents, confirmations and explanations of differences |
Give each row a reference number and use the same number in the written reply and document index. This prevents a general narrative from leaving one allegation unanswered.
Reconcile the proposed demand with your records
Tax and classification allegations
Reperform the officer’s calculation from the underlying transactions. Check taxable value, rate, place of supply, exemption or zero-rating treatment, reverse charge, credit notes, debit notes, amendments and the period in which each adjustment was reported. Compare the figures with GSTR-1, GSTR-3B, annual returns, books and payment records. If the department has aggregated transactions, prepare a transaction-level schedule showing which entries are duplicated, outside the period, cancelled or already taxed.
ITC allegations
For an ITC notice, trace each invoice from the purchase register to the return, supplier details, receipt of goods or services, accounting entry and payment trail. Test eligibility conditions and identify credits that were reversed, reclaimed or never used. Reconcile supplier data and explain timing differences instead of treating every portal mismatch as proof of wrongful availment or utilisation. Do not claim that an invoice, e-way bill or payment record exists unless you can produce it.
Erroneous-refund allegations
Reconstruct the refund application, formula, supporting statements, payment evidence and the credit ledger position on the relevant dates. Separate an error in the refund amount from an allegation that information was deliberately concealed. Explain corrections, subsequent reversals or amounts already paid and attach proof of each adjustment.

Interest
Recalculate interest under Section 50 using the dates and amounts that actually apply. Show the period, rate used and payments credited. If the principal demand changes, the interest computation must change with it; identify that dependency explicitly rather than accepting the notice’s interest figure as a standalone amount.
Answer the Section 74 allegation directly
Use a separate heading for each asserted ground—fraud, wilful misstatement and suppression of facts to evade tax—and respond to the facts actually pleaded. Explain what was disclosed in returns, reconciliations, books, correspondence or earlier departmental interactions. Point out where the notice relies on an inference without identifying the document, person, transaction or conduct said to constitute concealment or intent. If a mistake occurred, describe its cause, discovery, correction and effect without adopting a legal conclusion that the evidence does not support.
Do not rely on a blanket sentence such as “there was no fraud.” State the transaction history, the contemporaneous disclosure, the control or accounting explanation and the document proving each point. Where the notice combines several periods or taxpayers, require the officer to identify the evidence attributable to your GSTIN and each period. Preserve a distinction between an honest classification or clerical dispute and conduct alleged to evade tax; they involve different factual questions.
Prepare the written reply and attachments
Recommended structure
- Header: notice number and date, GSTIN, legal provision, tax period and authority.
- Preliminary statement: identify the allegations you admit, dispute or cannot verify from the material supplied.
- Facts and chronology: set out the relevant transactions, filings, disclosures, correspondence and corrections in date order.
- Issue-by-issue response: follow the allegation map; give the calculation and legal reasoning for every item.
- Section 74 ground: address the particular evidence said to establish fraud, wilful misstatement or suppression.
- Demand schedule: show the department’s figure, your figure, the difference and the reason for each difference.
- Relief requested: ask for withdrawal or reduction of unsustainable items, correction of arithmetic and a decision based only on established facts and applicable law.
- Hearing request: make a written request if oral submissions would help or if the notice is contested.
- Verification and index: sign or authenticate as required and list every annexure with page numbers.
Make the evidence usable
- Use searchable, legible PDFs and name files consistently with the index.
- Highlight the relevant invoice, return line or ledger entry, but do not obscure surrounding context.
- Attach a reconciliation rather than hundreds of unlabelled pages.
- Explain unavailable records and state what alternative evidence is provided.
- Keep an identical, paginated copy of the submission and the upload confirmation.
File through the prescribed GST route
Rule 142(4) states that a representation or reply to a notice whose summary has been uploaded electronically in FORM GST DRC-01 is furnished in FORM GST DRC-06. Log in to the current GST portal, open the notice from the relevant services or litigation menu, and follow the notice-specific filing instructions. Portal labels and workflows can change, so use the path displayed for your notice rather than an old screenshot or a form downloaded from an unauthorised site.

The CGST Rules text commonly circulated for FORM GST DRC-06 is amended through 1 January 2022. Later rule changes, portal updates and State-specific procedures may apply, so verify the live instructions before filing.
Request and prepare for a hearing
Section 75 contains hearing safeguards, including a hearing where the person requests one in writing or where the officer contemplates an adverse decision. Put the request in the reply and, if the portal provides a separate field, repeat it there. Specify the issues requiring oral explanation, such as a complex reconciliation, third-party data or the Section 74 intent allegation. Keep proof that the request was made.
At the hearing, take the notice, reply, indexed evidence and a short issue list. Ask that clarifications and documents submitted at the hearing be recorded. Afterward, preserve the minutes, attendance record or written confirmation. A hearing is not a substitute for a complete written reply; the adjudicating officer must be able to match the decision to the filed evidence.

Payment routes and their consequences
Payment before notice
Section 74(5) permits payment, before service of a notice or statement, of tax and applicable interest on self-ascertainment or the officer’s ascertainment, with information to the proper officer. This route may reduce later exposure in an appropriate case, but it should not be treated as an admission unless that is your deliberate, advised choice.

Payment within 30 days after notice
Under Section 74(8), if the person pays the specified tax and interest within 30 days of issue of the show-cause notice, no penalty is payable and proceedings in respect of that notice are deemed concluded. Confirm the issue date, amount, interest calculation, payment method and proof requirements in the actual notice and current rules. A payment decision can affect dispute rights and cash flow; obtain GST advice before using it where liability or the Section 74 allegation is contested.
After determination
If the case proceeds after representation, Section 74(9) provides for an order determining tax, interest and a penalty equivalent to the tax. Rule 142 discusses DRC-03 for intimating payments and related acknowledgement or order forms. The available rules text has changed over time, so verify the current form, ledger treatment and acknowledgement before making a payment.
| Decision path | Questions to answer first | Potential consequence |
|---|---|---|
| Contest in full | Are the facts, computation, Section 74 ground or procedure materially wrong? | Preserves the opportunity to obtain a reasoned determination, but requires a complete record and deadline control. |
| Pay under the notice route | Is the amount accepted, can it be paid on time, and is avoiding the specified penalty worth the cash cost? | Section 74(8) can remove penalty and conclude proceedings for that notice when its conditions are met. |
| Part-pay and contest balance | Which items are admitted and which remain disputed, and how must each payment be reported? | Requires precise allocation and does not automatically resolve the disputed Section 74 allegation. |
Limitation, order and appeal issues
Review the notice’s issuance and service dates against the relevant financial year or erroneous-refund date, statutory limitation, extensions, court stays and amendments. Do not assume that a date printed on a demand summary answers every limitation question.

Section 75 requires an order to set out relevant facts and the basis of decision. If an appellate authority, tribunal or court concludes that the Section 74 fraud, wilful-misstatement or suppression ground was not established, Section 75(2) directs determination as if the notice had been issued under Section 73. That does not automatically save a time-barred proceeding. CBIC Circular 185 discusses cases in which, if the original Section 74 notice was beyond the applicable Section 73 deadline, the proceedings may have to be dropped rather than converted; it refers to a 2 years and 9 months notice period for the situations described in that circular. That figure is not a universal deadline for every notice. Have a professional calculate limitation from the live dates and applicable amendments.
When an order arrives, read the reasoning, quantified demand, penalty, interest, service date and appeal instructions immediately. Record the appeal deadline and any pre-deposit or payment requirement stated by the governing law. Do not wait for recovery action before obtaining advice.
Why Section 128A is not a general Section 74 waiver
Section 128A and Rule 164 concern a conditional waiver of interest or penalty, or both, for specified Section 73 demands. CBIC Circular 238/32/2024-GST describes coverage for Section 73 demands relating to financial years 2017-18, 2018-19 and 2019-20 and identifies 31 March 2025 as the notified full-payment date for the cases it discusses. This is not a blanket waiver of a demand that remains under Section 74. If a case is later changed or redetermined under Section 73, eligibility still has to be tested against the current Act, rules, notifications and circulars; the waiver should not be claimed merely because the tax period is one of those years.
Common mistakes that weaken a reply
- Responding only to the tax amount while ignoring the separate fraud, wilful-misstatement or suppression allegation.
- Using a generic denial without a transaction-level reconciliation.
- Missing the deadline because the portal download date or a draft email was treated as filing.
- Uploading unreadable, unindexed or incomplete annexures.
- Admitting liability or paying without understanding the statutory consequence and allocation of the payment.
- Relying on an old DRC-06, DRC-03 or portal guide without checking the live workflow.
- Assuming a State GST notice follows exactly the same authority, form or instructions as a central notice.
- Failing to request a hearing in writing or failing to preserve proof of the request.
- Ignoring limitation until after an order has been issued.
A practical final checklist
- Notice, annexures, service proof and prior communications saved.
- Deadline calculated from the actual notice and current law.
- Every allegation mapped to period, amount, provision, evidence, response and document.
- Tax, interest, refund and ITC figures independently recomputed.
- Section 74 ground answered with specific facts and records.
- Reply indexed, paginated, signed and uploaded in the prescribed route.
- Hearing requested in writing where appropriate.
- ARN, acknowledgement, final files and portal errors preserved.
- Payment, limitation and appeal choices reviewed with a qualified GST professional.
When to obtain professional help
Seek prompt advice from a qualified GST practitioner, chartered accountant or tax lawyer when the notice alleges deliberate concealment, involves several years or entities, relies on third-party investigation material, proposes a large ITC reversal or refund recovery, raises limitation, or presents a payment choice that could affect appeal rights. Give the adviser the complete notice, service record, working reconciliation and evidence index; a summary without the annexures can hide the issue that controls the outcome.
