Ask which process applies, what forms or supporting information are needed, and when you should expect a decision. In the United States, federal FMLA protections or disability-accommodation rules may also apply, but eligibility depends on your circumstances. State and local law, employer policy, union agreements, and your employment details can change the answer; this is general information, not individualized legal advice.
How to ask for a leave of absence
- Check the process. Review your employee handbook, HR portal, leave policy, or call-in instructions. Find out who receives the request, whether a specific form is required, and what notice deadlines apply. For potentially qualifying FMLA leave, employees generally follow the employer’s usual procedures unless unusual circumstances prevent it. The Department of Labor explains the notice rule in Fact Sheet #28E.
- Notify the right person promptly. Tell your manager, HR, or the contact named in the policy as soon as practical. If FMLA leave is foreseeable, give 30 days’ notice when possible and practical. If that is not possible—or the need is unforeseeable—give notice as soon as practicable under the circumstances. Follow the employer’s call-in procedure for an urgent absence.
- Give the information needed to understand the request. State the broad reason, when you expect leave to begin, how long it may last, and whether you expect to need recurring or intermittent time away. You do not need to volunteer a diagnosis or unrelated medical history, but a vague statement such as “I’m sick” may not give the employer enough information to recognize that FMLA could apply.
- Ask what happens next. Ask which leave process applies, what forms or certification are required, how benefit premiums will be handled, whether updates are expected, and when you should hear about the decision. Keep copies of your request and the employer’s responses. Employers have FMLA notice obligations, including notices about eligibility and rights and responsibilities, and later whether leave is designated as FMLA leave.
What to say in your request
You can use a short email or message as a starting point, then complete any forms your employer requires. This template is not a required legal form.

Hi [Manager/HR contact],
I need to request leave beginning [date] because of [brief general reason, such as a medical condition or caregiving need]. I currently expect to be away until approximately [date]. [If applicable: I expect to need intermittent leave on this schedule: …] Please let me know which leave process applies, what forms or supporting information you need, and any steps I should take before leave begins. I will update you if the timing changes.

For an urgent, unexpected absence, prioritize the employer’s call-in procedure and provide the relevant information as soon as practicable. Use required employer forms where applicable.

Could your leave qualify for FMLA?
The federal Family and Medical Leave Act (FMLA) can provide eligible employees of covered employers with job-protected leave for qualifying family and medical reasons. The Department of Labor describes employee eligibility as generally requiring all of the following:
- At least 12 months of employment with the employer.
- At least 1,250 hours of service during the 12 months before leave begins.
- A work location where the employer has at least 50 employees within 75 miles.
Employer coverage and the reason for leave also matter. Ask HR for an eligibility determination rather than assuming that meeting these general tests settles whether a particular absence qualifies. See the Department of Labor’s FMLA overview and employee notice guidance.

Continuous, intermittent, and reduced-schedule leave
Continuous leave is one uninterrupted period away from work. Intermittent leave means separate periods of leave for a qualifying reason; a reduced schedule means temporarily working fewer hours. If you expect recurring absences or a changed schedule, describe the anticipated pattern as clearly as you can and ask what documentation or updates are required. The employer may request relevant medical certification for FMLA leave.
Job protection, pay, and health coverage
FMLA leave may be unpaid or may run at the same time as employer-provided paid leave, depending on applicable rules and policies. Group health coverage continues under the same conditions as if you had continued working. At the end of FMLA leave, eligible employees generally have restoration rights to the same or a virtually identical position. These job-protection rules are distinct from whether the absence is paid; ask HR how pay and benefit-premium arrangements work during your leave.

Medical privacy and certification
Your first request does not have to say “FMLA,” and you do not have to give your employer a diagnosis or full medical history. You do need to provide enough information to alert the employer that the leave may involve a qualifying reason. If certification is requested, it may need sufficient medical facts about the condition. The Department of Labor’s FMLA forms page provides official forms; required information can also be provided in another format, such as a provider’s letterhead, if it contains the necessary information.
Under the Department of Labor employee guide, an employer must allow at least 15 calendar days to provide requested certification, with additional time potentially available in some circumstances. You are not required to sign a medical release or waiver as part of FMLA certification, although a complete and sufficient certification may be required. Ask HR to clarify what is missing if a certification is returned as incomplete or insufficient. See the Department of Labor’s employee guide to FMLA.

When to make a disability-related accommodation request
If your need for leave or a schedule change relates to a disability, you can explain the work-related limitation or adjustment you need in plain language. You do not have to cite the Americans with Disabilities Act (ADA), use the phrase “reasonable accommodation,” or put the initial request in writing. Documenting the conversation can help keep the request and response clear.
When the disability or need is not obvious, the employer may ask for reasonable documentation about the disability and functional limitations. The employee and employer should use an informal process to clarify the need and identify an effective accommodation. Leave may be a reasonable accommodation in some circumstances, subject to applicable limits, including undue hardship and whether an effective accommodation would allow the employee to keep working. A leave request is not automatically granted, and the ADA accommodation process is distinct from FMLA eligibility. See the EEOC guidance on reasonable accommodation and undue hardship.

Keep the leave routes distinct, even when they overlap

These routes can overlap, but they are not interchangeable. A personal leave policy, FMLA, disability accommodation, and paid-time benefits can have different eligibility rules and consequences.
What to do if the request is delayed or denied
- Ask which policy or legal process the employer considered and request the decision or next steps in writing.
- Confirm whether the employer needs a form, certification, or clarification, and ask for the applicable deadline.
- If certification is involved, ask the provider to address the requested information and return it through the required channel.
- If the request relates to a disability, clarify the work limitation and discuss possible effective adjustments, including a different schedule or leave arrangement where appropriate.
- Keep copies of notices, forms, messages, and dates. If you believe a legal right may be involved, seek advice suited to your state and circumstances.
Federal FMLA and EEOC guidance do not settle every case. State or local protections, employer coverage, length of service, hours worked, worksite, reason for leave, workplace policy, and any union agreement can affect the available rights and deadlines.
