Choose the account by deciding what the money is for, who should legally own it, when the child should control it, and which tax rules apply. A UTMA/UGMA account makes an irrevocable gift the child owns; a 529 is built around qualified education expenses; a custodial IRA requires the child to have earned income; and an adult-owned brokerage account keeps ownership with the adult. Trump Accounts are another emerging option, but their rules are evolving. State law, tax year, and provider terms can change the details.

Choose the account by purpose, ownership, and control

There is no single best investment account for every child. Start with the purpose of the money, then decide whether the child or the adult should own it and when the child should be able to take control. Those choices affect how flexible the money is, what tax rules apply, and whether the adult can change course later.

Account type Best fit Ownership and adult control Main constraint
UTMA/UGMA custodial account An investment gift intended to belong to a minor, without limiting it to education costs The child owns contributed property; a custodian manages it until the termination point set by applicable state law and account arrangement. FINRA Regulatory Notice 20-07 describes this structure. The transfer is irrevocable, and the child eventually takes control. The termination age and any extension options vary by state and circumstances (FINRA, February 27, 2020).
529 qualified tuition program Saving and investing for qualified education costs The program is for a designated beneficiary. The program’s rules govern account administration; provider and state terms vary (IRS Topic 313 and Publication 970). Tax treatment depends on qualified use. A special 529-to-Roth IRA rollover is subject to several conditions, including a 15-year account history and a $35,000 lifetime cap (IRS Topic 313, accessed October 2026).
Custodial IRA, including Roth IRA Retirement saving for a child with earned income An adult handles the custodial arrangement until the applicable transfer point. The child is the relevant retirement saver and must have compensation (FINRA, June 2026; IRS Roth IRA guidance). Contributions are constrained by the child’s compensation and annual IRA rules; gifts and investment returns are not earned income.
Trump Account A qualifying child for whom the account’s current rules and eligibility apply The IRS describes an election for a qualifying child and a custodian. Specific implementation details depend on current IRS guidance. Rules are new and evolving. The IRS issued proposed investment regulations in 2026; proposed rules should not be treated as final.
Adult-owned brokerage account An adult who wants to invest for a child’s future while retaining ownership and control The adult remains the legal account owner; this is not a custodial account or a completed gift to the child (FINRA, June 2026). Do not assume that an informal intention to use the assets for a child gives the child ownership or the legal treatment of a custodial gift.

The table is a starting point, not a substitute for checking a state’s law or a plan’s current terms. The right answer can depend on where the child lives, the account agreement, family goals, and the tax year.

Understand what a custodial gift means before opening a UTMA/UGMA account

Uniform Transfers to Minors Act and Uniform Gifts to Minors Act accounts let an adult transfer money, securities, or other assets to a minor without creating a formal trust. The adult serves as custodian and manages the property for the child, but the child—not the custodian—owns the assets. FINRA’s February 27, 2020 Regulatory Notice 20-07 puts the consequence plainly: “Depositing assets into an UTMA/UGMA Account represents an irrevocable transfer from the donor to the beneficiary.”

That means a custodial account is not simply a parent’s savings account with a child’s name attached. After a contribution is completed, the donor generally cannot take it back or redirect it at will. The custodian must manage the assets for the child’s benefit, not treat them as the adult’s own property. Consider carefully whether you are comfortable making a permanent gift before funding the account.

The custodian’s authority is also temporary. It generally ends when the child reaches the age set under the relevant state law and account arrangement. That may be the state’s age of majority or another statutory termination age; some states permit an extension under specified conditions. There is no single nationwide age that applies to every UTMA/UGMA account. Confirm the governing statute and account terms for the child’s circumstances, and record the expected transfer date.

Because the child owns the assets, this route can make sense when the goal is a flexible gift rather than money restricted to education. Its trade-off is that the child eventually gains control, even if the adult would prefer to preserve the assets for a later milestone. Do not choose it on the assumption that you can veto the beneficiary’s future use once the child becomes entitled to control the account.

Use a 529 when qualified education spending is the objective

A 529 qualified tuition program is designed around education expenses for a designated beneficiary. It is not an unrestricted substitute for a general investment account: tax treatment depends on how distributions are used and on the program and tax rules that apply. Review the program’s current terms and IRS guidance before contributing or withdrawing.

The IRS explains that when a distribution exceeds adjusted qualified education expenses, the earnings portion can be taxable. The calculation is not simply a comparison of the total distribution with a tuition bill: adjusted qualified expenses matter. Keep records of distributions and relevant expenses so the tax treatment can be determined for the specific year. IRS Publication 970 and Topic 313 describe the applicable rules.

A limited route may allow some 529 money to move to the beneficiary’s Roth IRA, but it is not a general-purpose escape hatch for unused funds. IRS Topic 313, accessed October 2026, describes a $35,000 lifetime rollover cap. The transfer must be direct from trustee to trustee, the 529 must have been open for at least 15 years, the annual Roth IRA contribution limit still applies, and contributions or earnings from within the stated five-year lookback cannot be included. Confirm current IRS instructions before relying on a rollover; satisfying one condition does not remove the others.

State tax benefits, provider fees, investment menus, and program availability are not established by the national account overview. If those factors matter to the decision, compare current plan documents and the rules for the relevant state rather than assuming every 529 has the same terms or advantages.

Open a custodial IRA only if the child has earned income

A custodial IRA, including a Roth IRA, is a retirement account for a child who has compensation. The child must have earned income; a gift from a parent or grandparent, interest, dividends, or investment gains do not become the child’s compensation just because they are deposited in the account. FINRA’s June 2026 overview identifies earned income as the key condition for a child’s IRA.

Contributions are limited by the child’s compensation and the annual IRA rules in effect for the relevant tax year. The amount a family gives the child is not, by itself, a basis for contributing more than the child is allowed. Check current IRS Roth IRA guidance and the applicable year’s contribution instructions before funding the account. Do not assume the limit from a prior year still applies.

An adult manages the custodial arrangement while the child is a minor, but the account is for the child’s retirement and remains subject to IRA rules. Roth IRA tax treatment and distribution rules are distinct from those of a taxable custodial account; consult current IRS guidance for the circumstances at issue. A custodial IRA is a poor fit if the child has no qualifying compensation or if the family needs the money to remain available for ordinary expenses before retirement.

Check child investment income and tax filing requirements

Investment income in a child’s name can raise a filing question even when the child does not have a job. The account type, income amount, tax year, and other conditions matter, so do not rely on a remembered “kiddie tax” threshold or assume that the adult can report every child’s income on a parent’s return.

IRS Topic 553, accessed October 2026, lists “more than $2,700” of unearned income as one criterion for the described Form 8615 rules. It also says a parent may be able to elect to report a child’s income on Form 8814 when the child’s gross income is less than $13,500 and other conditions are met. These amounts are tax-year-sensitive and are not stand-alone tests that determine filing treatment by themselves. Check the instructions for the applicable year’s Forms 8615 and 8814, including all eligibility conditions, before filing.

Keep account statements, contribution records, tax forms, and information about who owns the assets. If the account holds a child’s property, do not assume that putting the account under an adult’s online login changes who owns the income or who may have a filing obligation. For a particular family’s filing position, use current IRS materials or consult a qualified tax professional.

Consider Trump Accounts carefully because implementation is developing

Trump Accounts appear in FINRA’s June 2026 overview as a current option for eligible children. The IRS has described the ability to submit and track elections in 2026 and has separately published proposed investment regulations. That distinction matters: an announced election process and issued IRS guidance can be described as current, but a proposal is not a final rule.

Before selecting this route, verify the child’s eligibility, the current election process, the custodian’s role, and the latest final IRS guidance. The available national overview does not establish every account term, investment option, provider fee, or state-level consequence. Do not infer those details from a proposed regulation or from a comparison with other child accounts. Because implementation can change, check official IRS information again when applying and before making decisions that depend on a particular rule.

Open and manage the account in five deliberate steps

1. Write down the goal and desired control

Decide whether the money is for qualified education, an irrevocable gift the child will eventually control, retirement saving tied to the child’s compensation, an eligible Trump Account, or future support while the adult retains ownership. Also consider whether you need to be able to change the beneficiary or use of the money. A clear purpose prevents a common mismatch: selecting an account for its label without accepting its ownership and access rules.

2. Verify state, eligibility, and tax rules

For a UTMA/UGMA account, identify the governing state law, termination age, any applicable extension conditions, and the account arrangement. For a 529, review the program rules and current qualified-expense guidance. For an IRA, verify the child’s compensation and the annual contribution limit. For a Trump Account, check current eligibility and whether relevant IRS rules are final or proposed. Tax figures and instructions can change by year; use materials for the tax year involved.

3. Compare providers using their current terms

Provider fees, minimums, investment choices, state availability, opening requirements, and account-transfer procedures vary. The account category alone does not establish what a particular provider offers. Read the current agreement and fee schedule, review the available investments and funding process, and find out how the provider handles statements, tax forms, and an eventual transfer of control. Do not assume that a document checklist or fee at one institution applies everywhere.

4. Keep a durable record from the first contribution

Save the account agreement, statements, contribution history, tax documents, and records relevant to the intended use. For a custodial account, note the expected termination date and ask the provider how it notifies the custodian and transfers authority. FINRA examination material has identified missed monitoring of this transition as a supervisory problem for firms; keeping track of the date helps prevent an avoidable handoff problem.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

5. Revisit the arrangement when circumstances change

Review whether the account still fits the goal, whether eligibility and contribution conditions remain satisfied, whether the investment mix remains appropriate for the time horizon, and whether tax reporting is current. Check for an approaching custodial control transfer rather than waiting for an account notice. This is a review process, not a universal recommendation for a particular allocation or trading strategy.

Common mistakes to avoid

  • Treating a custodial account as revocable. A UTMA/UGMA contribution is a gift to the child, not a temporary transfer the adult can reclaim at will.
  • Assuming every child gets control at the same age. State statutes and account arrangements govern the timing, and some states allow specified extensions.
  • Using a 529 as if every withdrawal were unrestricted. Tax treatment depends on adjusted qualified education expenses; the Roth rollover is limited by its own conditions.
  • Funding a child’s IRA without compensation. A gift or investment return is not earned income, and annual IRA rules also constrain contributions.
  • Assuming adult intent changes legal ownership. An adult-owned brokerage account remains the adult’s account; an informal intention to use it for a child does not turn it into the child’s custodial property.
  • Relying on stale tax thresholds or proposed rules. Verify the applicable tax-year forms and distinguish final IRS guidance from proposed Trump Account regulations.
  • Ignoring the handoff date. For a custodial account, determine when authority ends and how the provider will handle the transition.

Match the account to the commitment you are making

Choose a UTMA/UGMA account only if you accept that the property belongs to the child and that the child will gain control under the applicable state rules. Choose a 529 when qualified education use is central and you are willing to follow its distribution rules. Use a custodial IRA only when the child has compensation and the goal is retirement saving. Consider an adult-owned brokerage account if retaining ownership is essential, and assess Trump Accounts against current official rules rather than assumptions about a new program. Before opening anything, confirm the relevant state law, tax-year guidance, and provider agreement.
