How to Handle a Bank Dispute: Report an Error and Track Your Claim

Report suspected bank-account errors promptly. The right deadline and process depend on whether the transaction was an EFT, check, or credit-card charge.

First identify what kind of transaction is in dispute: an electronic transfer from a deposit account, a check, or a credit-card charge. The rules and deadlines differ. For a suspected unauthorized electronic transfer, contact your bank or credit union promptly, describe the transaction clearly, and keep proof of your report and follow-up. The guidance here covers U.S. consumer accounts; business accounts, non-bank payment providers, and other bank-service problems may follow different rules.

Identify the type of dispute before you act

A debit-card purchase and a credit-card charge may look similar on a statement, but they do not use the same dispute process. Check how the transaction was processed and which account was charged before relying on a deadline.

What is disputed Rules that may apply What to do first
ATM withdrawal, debit-card purchase, some online bill payments, or an automatic account deduction Regulation E for covered electronic fund transfers (EFTs). CFPB guidance also notes that some payment-network or P2P-provider rules may ask for earlier notice. Report the error promptly through the bank’s stated channel and keep a record of the notice.
Conventional check Generally state UCC law; rights and time limits can vary with state law. Ask the bank how the check was processed and check the applicable state rules.
Substitute check Check 21 includes a specific expedited-recredit process. Ask whether the item is a substitute check and follow the bank’s written claim procedure.
Credit-card billing error Regulation Z, a separate billing-error process. Use the issuer’s billing-rights notice for the accepted method and timing.

These distinctions reflect CFPB guidance and regulations, and the OCC’s explanation of check rights. A claim involving a non-bank P2P provider can also depend on the provider’s terms and network rules.

For an electronic transfer, report it as soon as possible

Regulation E covers certain electronic transfers from a consumer deposit account, including ATM activity, debit-card purchases, some online bill payments, and preauthorized deductions. Tell the bank or credit union that you believe an EFT error occurred. Do not treat the outside notice limit as a reason to wait.

Keep the two important notice clocks separate

  • Lost or stolen card or access device: CFPB guidance says reporting within two business days can limit potential liability under the circumstances it describes. This concerns notice after discovering the loss; it is not the general statement deadline.
  • Statement showing an unauthorized EFT: The general outside reporting limit is 60 days after the bank sends the statement showing the error. Report sooner if you can. CFPB consumer guidance, last reviewed August 28, 2026, describes both timing rules.

If you are unsure whether the transaction qualifies as an EFT or which clock applies, report it immediately and ask the institution to identify the process it is using.

Make a clear report and keep a paper trail

Use the phone number, mailing address, or digital route the institution specifies for error reports. Regulation E notice must give the institution enough information to identify you and the account and indicate why you believe there is an error; include the transaction type, date, and amount where possible.

  1. State plainly that you are reporting an error or unauthorized transfer.
  2. Identify the affected account using the information the bank requests.
  3. List each disputed transaction separately, with its date and amount.
  4. Explain why you believe each transaction is wrong. If you recognize a merchant but dispute the amount or a duplicate charge, say that rather than calling it unauthorized.
  5. Ask how the bank will communicate its decision and whether it requires written confirmation of an oral report.
  6. Save your statement or transaction screen, receipts, relevant merchant or recipient messages, the claim or confirmation number, and the date and name associated with each follow-up.

If you report orally, the bank may require written confirmation within 10 business days. It must tell you when you make the oral report if confirmation is required and explain where to send it. The institution must begin investigating promptly; it cannot wait for that written confirmation to start. If you do not provide required confirmation on time, the bank need not provide provisional credit while it investigates.

Know what the bank’s investigation deadlines mean

For a covered EFT error, the ordinary initial investigation period is 10 business days after the institution receives notice. That is a deadline for determining whether an error occurred, not a promise that every dispute will be resolved or finally reimbursed within 10 days.

Timeframe When it applies
10 business days The ordinary initial period to investigate and determine whether an EFT error occurred.
20 business days An initial investigation period that can apply to a transfer made within 30 days after the first deposit to the account.
Up to 45 days The general extended period when the institution cannot finish within the initial period and follows Regulation E’s provisional-credit requirements.
Up to 90 days An extended period that can apply to specified cases, including point-of-sale debit transactions, EFTs initiated outside the state, or transfers made within 30 days after the first deposit.
One business day Correction is due within one business day after the institution determines that an error occurred.
Three business days The institution must report its findings within three business days after completing its investigation.

These timeframes come from CFPB consumer guidance and 12 CFR § 1005.11. The 10-business-day and 20-business-day initial periods are not added together; the applicable period depends on the circumstances.

Provisional credit is conditional

If the bank needs more time, it generally must provisionally credit the disputed amount within 10 business days while investigating. Exceptions apply, including when a consumer fails to provide written confirmation that the bank properly required after an oral report. Provisional credit is not a final decision: if the institution finds the transfer was authorized, it must give written notice before removing investigation credit.

If your dispute involves a check

Do not automatically apply the EFT deadlines to a check. The OCC says conventional check processing generally falls under state UCC law, so the applicable rights and filing periods can depend on the state’s law and how the check was handled.

A substitute check has a more specific Check 21 expedited-recredit process. The OCC says a consumer generally should contact the bank within 40 days of receiving the substitute check or the statement showing the problem, and submit a written claim with information needed for the investigation. If the bank has not resolved the claim after 10 business days, it must credit at least part of the amount. Confirm that the item is a substitute check and ask the bank how to submit the claim.

If the disputed charge is on a credit card

A credit-card billing error is governed by Regulation Z’s separate billing-error framework, not the Regulation E process for an EFT from a deposit account. Consult the issuer’s billing-rights notice and follow its accepted notice method and required timing; do not assume the debit-card deadlines apply.

If the bank denies an EFT claim

Ask the institution for its written explanation and copies of the documents it relied on. Regulation E requires reporting of findings after the investigation, and relevant records can include ACH records and account transaction history. Compare the explanation with the transaction details and evidence you submitted. If you believe relevant information was missed, identify it specifically when asking the institution to review or explain its decision. The appropriate next escalation depends on the institution, transaction, and jurisdiction, so verify the right complaint or legal route for your circumstances.
