The child becomes the beneficial owner, an adult custodian manages the property, and the gift generally cannot be taken back. The account’s governing state law and paperwork determine when control must pass to the child.
Before transferring anything, confirm that the receiving brokerage accepts the specific shares in kind, identify the applicable state termination age, and preserve the donor’s tax-basis records. Dividends, interest and gains generally belong on the child’s tax return, with special kiddie-tax rules potentially applying.

What a custodial stock gift does
A UTMA or UGMA account lets an adult transfer securities or other property to a minor without creating a formal trust. The account is titled for the child, with an adult named as custodian. The child owns the property; the custodian has authority to invest, sell, and spend it only for the child’s benefit until the custodianship ends.

FINRA describes the legal effect plainly: “Depositing assets into an UTMA/UGMA Account represents an irrevocable transfer from the donor to the beneficiary.” Once the shares are accepted and credited, the donor normally cannot reclaim them, change the beneficiary, or redirect the money for another child.

FINRA examination findings state that the beneficiary generally becomes owner when the gift is made, while the custodian manages and invests the property until the applicable age of majority, when the custodian must transfer it. State statutes differ, so there is no safe nationwide answer of “18” or “21.” Some states provide different ages or extensions, and the account agreement may reflect those rules.
Who has which rights?
- Child (beneficiary): owns the securities and all income they produce.
- Custodian: controls transactions and distributions while acting for the child’s benefit; the custodian does not own the assets personally.
- Donor: gives up ownership when the transfer is completed, even if the donor is also the custodian.
How to transfer shares step by step
- Determine the governing law. Ask the brokerage which state’s UTMA or UGMA statute will govern the account and read the account agreement for the termination age, permitted extensions, successor-custodian rules, and delivery procedure.
- Choose the custodian. The custodian is commonly a parent or another adult, but eligibility and successor rules are state- and provider-specific. Consider who can manage the account reliably for many years and who can document spending decisions.
- Ask the brokerage about in-kind transfers. Confirm that it accepts the exact security, share class, registration, and quantity. Ask whether the donor must open the custodial account first, which forms are required, whether partial shares are accepted, how restricted or employer shares are handled, and what transfer fees apply.
- Open the account in the child’s name. The application generally identifies the minor as beneficiary and the adult as custodian. Supply the identification and tax information requested by the provider. Do not assume an ordinary joint or individual brokerage account creates a custodial gift.
- Submit the transfer instruction. Follow the delivering and receiving firms’ instructions exactly. A transfer may be made in kind, preserving the shares rather than selling and sending cash, if both firms support it. Keep the completed forms and confirmation showing the date and number of shares delivered.
- Record the gift-date information. Save the donor’s adjusted basis immediately before transfer, the fair market value on the gift date, acquisition dates, prior adjustments, share quantity, and any gift-tax filings or tax paid.
- Manage for the child’s benefit. Investment choices, sales, and withdrawals must be defensible as benefiting the minor. Keep statements and receipts, and avoid treating the account as the custodian’s emergency fund or general household account.
- Plan for handoff. Calendar the statutory termination date and ask the brokerage what documents it will require to move control and assets to the now-adult beneficiary.
UTMA versus UGMA
Both structures are custodial accounts governed by state law. UGMA statutes traditionally cover money and financial assets such as securities. UTMA statutes generally authorize a broader range of property, which can provide more flexibility for assets beyond publicly traded securities. The exact property permitted, custodian powers, age of termination, and administrative procedures depend on the state whose law applies.
| Feature | UGMA | UTMA |
|---|---|---|
| Typical property | Cash and securities | Securities plus a broader range of property under the applicable statute |
| Ownership | Child owns the gifted property | Child owns the gifted property |
| Control before termination | Adult custodian manages for the child | Adult custodian manages for the child |
| Irrevocability | Generally irrevocable after acceptance | Generally irrevocable after acceptance |
| Control-transfer age | State-specific; verify current law and account documents | State-specific; verify current law and account documents |
When does the child take control?
The transfer age is controlled by the governing statute and the account’s registration, not by a universal federal rule. FINRA says custodial property must be transferred when the beneficiary reaches the applicable age. Before acting, obtain the current statute or written guidance for the relevant state and ask the brokerage how it handles the change of control.

Gift-tax treatment
For federal gift-tax purposes, the annual exclusion is tied to the calendar year and the type of interest transferred. The IRS 2025 Form 709 instructions list a $19,000 exclusion for gifts of present interests to each donee during 2025. This is a 2025 figure, not a permanent amount; verify the exclusion for the year you give the shares.

The IRS instructions explain that a gift of a future interest cannot use the annual exclusion. A transfer to a minor is treated as a present interest only when specific conditions are met, including that the property and income can be used for the minor before age 21, the remainder passes to the minor at 21, and specified rights apply if the minor dies before 21. Whether a particular custodial arrangement meets those conditions depends on the state-law structure and facts.
Giving more than the annual exclusion does not automatically mean immediate gift tax is due. The result can depend on the donor’s other gifts, available lifetime exclusion, elections, split-gift treatment, and whether a federal gift-tax return is required. For a large transfer, a gift involving spouses, a trust, a nonresident donor, or unusual property, review the current Form 709 instructions and obtain professional advice.
Practical gift-tax records
- Date the shares were transferred and the number and class of shares.
- Fair market value on the transfer date.
- Donor’s adjusted basis and acquisition dates.
- Any gift tax paid or Form 709 filed.
- Brokerage confirmations showing delivery into the custodial account.
Who pays tax on dividends, interest and gains?
IRS Publication 550 says property a parent gives a child under UGMA, UTMA, or a similar law becomes the child’s property. Income from that property is generally taxable to the child. An exception applies when income is used to satisfy the legal support obligation of the parent or guardian; that amount is taxable to the responsible adult instead.
Dividends, taxable interest and capital gains are generally unearned income. The tax reporting follows the child’s ownership, even when the parent is the custodian and receives the brokerage statements.
Kiddie-tax filing rules
For tax year 2025, the IRS Form 8615 instructions identify $2,700 of unearned income as the threshold used in the listed filing conditions. A child with more than that amount may need Form 8615 if the other requirements on the form are met. Form 8615 generally calculates tax on the child’s net unearned income using the parent’s tax rate under its rules.

The threshold and filing tests are year-specific. Age, earned income, support, filing status, and other conditions matter, so do not assume every child with dividends is taxed at a parent’s rate. A parent may sometimes elect to report a child’s interest and dividends on the parent’s return with Form 8814, but that election has its own limits and does not eliminate every possible filing obligation. Check the current-year Forms 8615, 8814 and 1040 instructions.
Capital-gain reporting
When the custodian sells shares, the brokerage may issue a Form 1099-B in the child’s name. The return must use the correct basis and holding period. Keep the donor’s records because the child’s basis does not automatically become the market value on the transfer date.
Basis of gifted stock
IRS Publication 551 requires a gift-basis analysis using the donor’s adjusted basis immediately before the gift, the property’s fair market value at the gift date, and any gift tax paid. If the gift-date value is below the donor’s basis, the basis used to calculate a later gain can differ from the basis used to calculate a later loss. This “dual-basis” situation makes incomplete records especially risky.
| Information | Why it matters |
|---|---|
| Donor’s adjusted basis before transfer | Starting point for calculating the child’s gain basis |
| Fair market value on gift date | Determines the loss basis when gift-date value is below donor basis and supports valuation records |
| Gift tax paid attributable to appreciation | May affect the child’s basis under IRS rules |
| Original acquisition date and later adjustments | Helps determine holding period and correct taxable gain or loss |
Do not rely solely on the receiving brokerage’s cost-basis display. Transfer confirmations, reinvested-dividend records, corporate-action adjustments, and older acquisition documents may be needed to reconstruct the correct basis.
What the custodian may and may not do
The custodian can invest and sell assets, but the account exists for the child’s benefit. Appropriate expenses depend on state law and the facts. A withdrawal for tuition, medical care, or another expense that benefits the child may be supportable; paying the custodian’s unrelated bills is not. Keep a written note explaining the child-related purpose, amount, date, and source of each withdrawal.

The gift cannot normally be revoked because the custodian later dislikes the investment, needs the money, or wants to give it to a sibling. If the named custodian dies, resigns, or becomes unable to serve, follow the account agreement and state-law successor process rather than moving the assets to the custodian’s own account.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Alternatives to giving the shares now
A custodial account is not the only way to help a child invest. The right choice depends on ownership, control, permitted use, taxes, and administrative burden.
| Route | Who owns the assets? | Control and use | Key trade-off |
|---|---|---|---|
| UTMA/UGMA custodial account | Child immediately | Adult manages until the statutory handoff; assets must benefit the child | Irrevocable gift and eventual unrestricted control by the child |
| Parent-owned brokerage account | Parent | Parent controls timing and use; child has no automatic ownership | More flexibility, but it is not a completed gift to the child |
| Other child-focused savings arrangement | Varies by product | Product-specific restrictions and beneficiary rules | May offer different tax treatment or limits; read current terms |
| Trump Account | Eligible child under a traditional IRA structure | Eligibility, contribution, investment and distribution rules apply | Not a general-purpose custodial brokerage account |
Trump Account points to verify
Investor.gov describes the Trump Account as a distinct traditional IRA for eligible children, not a replacement for a UTMA or UGMA account. During the growth period, investment choices are limited to eligible broad U.S. equity index mutual funds or exchange-traded funds under the applicable rules. The IRS announced a $1,000 pilot contribution for eligible U.S. citizens born in 2025 through 2028 when the required election is made. Eligibility, enrollment, contribution limits, investment rules and distributions are new and may change, so verify current IRS and Investor.gov guidance before relying on this option.
Decision checklist before you give stock
- Is an irrevocable transfer appropriate, or do you need to retain ownership and flexibility?
- Which state’s custodial statute governs, and exactly when does control transfer?
- Will the brokerage accept these shares in kind, including the registration and share class?
- Who will serve as custodian, and is a successor named?
- How will dividends, sales and tax forms be tracked for the child?
- Do you have donor basis, acquisition dates, gift-date value and transfer confirmations?
- Could the transfer affect need-based financial aid or the child’s eligibility for another benefit? Obtain advice specific to the program before acting.
- Have you checked the current-year gift-tax and kiddie-tax instructions?
Common mistakes and fixes
Assuming the child receives control at a universal age
Fix: Verify the governing state statute and the brokerage’s account agreement; calendar the required handoff.
Recommended Free Tools
Believing the gift can be undone
Fix: Treat the transfer as permanent once accepted. If you need reversibility, consider keeping the asset in an account you own instead.

Reporting every dividend at the parent’s rate
Fix: Apply the current Form 8615 tests and consider whether Form 8814 is available and appropriate; the child’s age, support and other income matter.
Spending custodial money as household money

When professional advice is warranted
Use a tax professional or attorney when the transfer is large, involves appreciated or restricted stock, crosses borders, uses a trust or spouse-splitting election, may exceed annual exclusions, or could affect government benefits or financial-aid planning.
