If the IRS questions, reduces, or disallows your American Opportunity Tax Credit (AOTC) or Lifetime Learning Credit (LLC), start with the exact notice—not an automatic amended return. Identify the tax year, notice number, response deadline, records requested, and the stage of the case. An open document request, a completed audit adjustment, and a later-year claim after a disallowance require different responses.
Start with the IRS notice and its deadline
Make a copy of the notice and note the tax year, notice or letter number, response deadline, requested documents, permitted submission methods, and phone number. Keep a complete copy of everything you send and proof of submission. Deadlines and appeal rights depend on the specific notice; do not assume a general IRS processing estimate gives you more time.
An IRS letter questioning an AOTC claim may mean the agency did not receive Form 1098-T or needs support for the qualified tuition and related expenses reported on Form 8863. The IRS addresses this situation in its education-credit questions and answers (updated January 10, 2025) and Topic 654. A request for evidence is not the same as a final decision that you owe tax.
For an open CP75 or CP75A document request
Complete the response form that came with the notice and send copies of the requested records by the date printed on that notice. Use only the submission route specified there: the IRS Campus Correspondence Exam Document Upload Tool or QR code, the fax number, or the return envelope/address. If you need more time to collect records, call the number on the notice. Do not substitute Form 1040-X for the requested response while the evidence request is open.

The IRS says review of CP75 evidence takes at least 30 days. If the documentation establishes eligibility, the IRS says it will send an audit-closed notice. Inadequate or partial support may lead to an examination report proposing changes. This process description applies to CP75/CP75A document requests; follow other letters’ own instructions.
For a completed audit, adjustment, or proposed deficiency
Read the examination report and any later statutory notice or final letter. If you disagree with an audit disallowance, the IRS says you may request reconsideration and provide documents showing entitlement for the audited year. Appeal and court deadlines are notice-specific, so use the dates and instructions in your own correspondence rather than assuming reconsideration pauses another deadline.

Gather evidence that matches the disputed claim
Compare the filed Form 8863 with school and payment records for the student and tax year in question. Check that names and identification numbers match, determine what expenses were actually paid, and account for scholarships, employer education benefits, Veterans’ Educational Assistance, or other benefits that may reduce expenses available for the credit.
- Form 1098-T: Check the student’s name and Social Security number. If information is wrong, ask the school to correct its reporting; if a form that should have been issued is missing, request it. Some eligible institutions need not issue Form 1098-T in defined circumstances, and a taxpayer may still qualify without one if eligible enrollment and payment of qualified expenses can be substantiated.
- Proof of payment: If the AOTC expenses claimed exceed the Form 1098-T Box 1 amount, or there is no Form 1098-T, the IRS identifies canceled checks and receipts for required fees, books, and supplies as examples of evidence. A school account statement and payment records can help connect the amounts claimed to actual payments.
- Enrollment and required materials: Enrollment records, course descriptions, or a list showing required books and supplies may help explain expenses or student eligibility when relevant to the notice.
- Offsets: Do not count expenses paid by employer education benefits, Veterans’ Educational Assistance, or other benefits toward the credit as well. Subtract applicable amounts; a Form 1098-T is not, by itself, a final determination of the allowable credit.
Send copies, not originals, unless the notice explicitly requests otherwise. Organize the material so each document supports a particular student, expense, payment, or eligibility point raised in the letter.

Choose the remedy for the stage you are in

When Form 1040-X may fit
If you discovered that your own return misstated an education credit, Form 1040-X is the usual amended-return route for corrected figures. The IRS permits electronic filing for certain individual amended returns for the current or two prior tax periods through participating software; older periods and some returns originally filed on paper must be mailed. Verify that your year and return qualify under the current IRS amended-return FAQ and Form 1040-X instructions.
The IRS estimates Form 1040-X processing generally takes 8–12 weeks and may take up to 16 weeks in some cases; this operational estimate can change. An amendment is not a substitute for responding to an active IRS evidence request or preserving a notice-based appeal deadline.

When to pursue reconsideration or an appeal
For a disallowed credit after an audit, the IRS’s CP79 guidance describes requesting reconsideration with documentation showing that you qualified for the credits in the audited year. The IRS Independent Office of Appeals offers an administrative channel for eligible disputes without litigation. If an appeal is underway, ask the Appeals Officer about secure document upload and messaging tools; see the Independent Office of Appeals information. The notice in hand remains central to the available route and timing.

Before disputing a reduction, verify that the student, expenses, and credit fit the rules for the return’s tax year. For 2025, the IRS’s Form 8863 instructions state the following limits and eligibility distinctions:

These are 2025 tax-year parameters, not universal thresholds for other years. Use the Form 8863 instructions for the tax year being corrected or audited. A dollar amount on Form 1098-T does not automatically establish the allowed expense total, and assistance or benefits may affect what can be claimed.
Understand Form 8862 and possible claim bans
If the IRS disallowed AOTC for a tax year beginning after 2015 for a reason other than a math or clerical error, Form 8862 generally must be attached to the next return claiming AOTC. Exceptions can apply—for example, if Form 8862 was filed, the credit was later allowed, and there was no subsequent non-math or non-clerical reduction or disallowance. Consult the current Form 8862 instructions and the instructions for the return year.
A ban imposed after a finding of reckless or intentional disregard can bar the credit for two years; a fraud finding can result in a ten-year ban. These are fact-specific determinations, not consequences of every reduction. IRS instructions describe requesting reconsideration of a ban with evidence of entitlement or evidence that the relevant conduct standard was not met. Filing Form 8862 alone does not automatically remove a ban. A denied claim may also require repayment with interest and can carry penalties.
Get help with a difficult notice
The IRS says taxpayers may qualify for free help from the Taxpayer Advocate Service and may be eligible for a Low Income Taxpayer Clinic. LITCs may assist with audits, appeals, and collection issues for free or a small fee. A tax professional or tax controversy representative may be useful for complicated disputes, but any representative should work from the specific notice, year, and deadline rather than promise a particular outcome.
You remain responsible for information on your return even if someone else prepared it. The IRS states: “You’re legally responsible for what’s on your return, even if someone else prepares it.”
