How to Fix a Mortgage Payment That Was Applied Incorrectly

Compare your mortgage statement with payment records, send a focused written notice of error to the servicer’s designated address, and keep paying amounts currently due while the issue is reviewed.

If your mortgage servicer credited a payment to the wrong month, allocated it incorrectly, or failed to credit it when required, compare your account history with your payment records and send a written notice of error to the servicer’s designated address. Clearly identify the loan, payment, and requested correction, and keep proof of what you send. Continue making other payments due under your mortgage while the servicer investigates; disputing a past posting does not suspend those obligations.

This guide covers the U.S. federal baseline under RESPA and Regulation X. Your loan terms and state law may affect your options, so this is general information rather than advice about an individual case.

What counts as a mortgage payment applied incorrectly?

Regulation X treats a servicer’s failure to apply an accepted payment to principal, interest, escrow, or other charges according to the mortgage terms and applicable law as a servicing error. The rule also addresses certain failures to credit an account as of receipt, improper fees, and other servicing errors. The exact issue depends on what your loan requires and what happened to your payment. See the Consumer Financial Protection Bureau’s 12 CFR § 1024.35.

A mismatch does not by itself prove the servicer made an error. For example, the servicer’s posting may reflect how your loan handles a partial payment or how an amount is allocated under the loan terms. Describe the specific difference between the payment you made and the account entry you see; avoid assuming the cause before you have the records.

Examples to check

  • Wrong installment or posting date: Your records show a payment was accepted, but the account history does not credit it as expected.
  • Wrong allocation: The payment appears in the account, but the amounts credited to principal, interest, escrow, or charges differ from what the mortgage terms require.
  • Fee or balance affected by the posting: A fee or balance entry may be connected to the disputed payment. Point to the specific entry and ask the servicer to review it rather than assuming it will automatically be reversed.
  • Unclear or partial-payment handling: Check the statement and your payment instructions to understand how the servicer recorded the transaction before concluding it was misapplied.

Compare your statement with your payment records

Start with the mortgage statement and account payment history. CFPB guidance says mortgage statements generally show amounts applied to principal, interest, and escrow, along with payment history and dates and amounts of transactions affecting the bill. Statements may also give information about how partial payments are handled. See the CFPB’s mortgage-servicing rules guidance.

Compare the entries with your own records. Focus on the transaction at issue and the account entries that changed after it; a concise, documented mismatch is more useful than a broad allegation that the entire account is wrong.

  • The statement and payment history, including the transaction date, amount, and allocation shown.
  • Your bank record showing the debit, if the payment came from a bank account.
  • The servicer’s payment confirmation or reference number, if available.
  • Any remittance instructions or relevant correspondence about the payment.

Write down what you expected to happen and what the account shows instead. Note the payment date, amount, method, and any confirmation number. Keep your originals; send copies with your notice if they help explain the discrepancy.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

It can help to make a short side-by-side account of the payment: when and how you sent it, when the bank shows the debit, what the servicer confirmed, and how the statement later displayed it. These records may show that the payment was received but allocated differently, or they may reveal that an important fact is still unclear. If your payment was made through an online portal, save any confirmation screen or receipt you still have. If you do not have a particular record, do not delay describing the issue simply because you cannot supply every possible document; the required notice contents are your name, loan-identifying information, and description of the believed error.

How to dispute a mortgage payment with a notice of error

A written notice of error is the formal route for asking the servicer to investigate a covered servicing error. Under Regulation X, the notice must include your name, enough information for the servicer to identify the mortgage loan account, and a description of the error you believe occurred. The regulation does not make every supporting document or drafting detail below a prerequisite to investigation. They are practical ways to make your concern specific and easier to review.

  1. Identify the borrower and loan. Include your name, the property address, and information that identifies the account. Use a reasonably safe form of account identification when sending documents.
  2. Pinpoint the payment. State its amount, date, payment method, and confirmation or reference number if you have one.
  3. Explain the mismatch. Describe what you believe should have happened, what the statement or payment history shows, and why those entries differ from your payment records or loan terms.
  4. Say what you want the servicer to do. For example, ask it to apply the accepted amount to the correct installment or allocation, review a fee connected to the posting, or confirm the corrected balance and effective date. Request a written explanation if the servicer concludes there was no error.
  5. Attach relevant copies. Include only records that help identify or explain the issue, such as payment confirmation, the bank transaction, the relevant statement pages, or related correspondence. Do not send irreplaceable originals.
  6. Sign, date, and keep a complete copy. Save the notice and every attachment together so you can refer to exactly what you sent.

Adapt this example to your facts. Keep the description specific, and do not include claims you cannot support.

I believe an error occurred in the servicing of my loan. On [payment date], I paid [amount] by [payment method]. The confirmation/reference number is [number, if available]. My [statement/payment history] shows [describe the account entry]. I expected [describe the expected application or crediting] because [brief explanation].

I have enclosed copies of [list relevant records]. Please send your response in writing.

[Name]
[Mailing address]
[Date]

The name, loan-identifying information, and description of the believed error are the key regulatory contents. The other details in the sample help make the request concrete, but the regulation does not require every borrower to use this wording or attach every listed type of record.

Send the notice to the right address and keep proof

Look for a special address for notices of error on your monthly statement, coupon book, or the servicer’s website. If the servicer designated a specific address and informed you that notices must be sent there, use it rather than assuming a general payment or customer-service address is sufficient. The CFPB describes this address requirement in its servicer rules guidance and Regulation X.

Keep a dated copy of the notice, attachments, and delivery confirmation. Record when the servicer received it if you can verify that date; the response periods run from receipt. If you also contact customer service, note the date, the representative’s name if provided, and what was discussed. A phone call can help clarify the account, but it does not replace sending the formal written notice to the applicable designated address.

Ordinary customer-service contact and a formal notice of error serve different purposes. A call or secure-message exchange may help you ask about a transaction or understand what appears on your account. But if you want to invoke the written error-resolution process, check the statement, coupon book, or website for the designated notice address and send the notice there when one applies. A customer-service representative’s verbal assurance is not a substitute for retaining your notice, its attachments, and evidence of delivery.

What happens after the servicer receives your notice?

For most servicing errors, the servicer must acknowledge a notice of error within five days, excluding Saturdays, Sundays, and legal public holidays. It generally must respond within 30 days, calculated on the same basis. For these general errors, the servicer may extend the response period by 15 more days only if it gives you written notice before the original period expires and explains the reason. These timeframes are set out in Regulation X and summarized by the CFPB in its consumer guidance.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

The acknowledgment and the decision are separate steps. The initial acknowledgment confirms receipt; it is not necessarily a finding that the account is wrong or that a requested correction will be made. Track the date the notice was delivered and keep any acknowledgment or later letters. If the servicer invokes the permitted 15-day extension, check whether it gave written notice before the original response period ended and stated the reason.

The servicer must either correct the error or investigate and explain in writing why it believes no error occurred. If it corrects the account, its written response must describe the correction and its effective date. If it concludes that there was no error, its response must explain that conclusion, tell you that you can request the documents relied on, and explain how to make that request.

If you request the documents the servicer relied on for a no-error determination, it generally must provide them without charge within 15 days, excluding Saturdays, Sundays, and legal public holidays. Confidentiality, privilege, and proprietary-information limits may restrict what it provides. The document deadline is tied to your request, not to the original notice’s general response period.

Read the response against the exact transaction you disputed. A response should make clear whether the servicer changed the account and, if so, the correction and its effective date; a no-error determination should explain the basis and how to request the documents used. If the response does not address the posting you identified, keep a copy and make your next written request specific about the unanswered point. The federal timelines described here are calculated using days that exclude weekends and legal public holidays; keep the receipt and response dates rather than relying only on when you mailed the notice.

Keep making payments currently due

A notice disputing an earlier payment does not cancel later installments owed under your mortgage. The CFPB’s official interpretation of Regulation X explains that the borrower still owes the next payment while the servicer investigates the earlier one. Keep paying as required by the loan terms rather than treating the dispute as permission to stop payments. See the CFPB’s official interpretation of § 1024.35.

If the disputed posting makes the amount currently due unclear, contact the servicer promptly, keep a record of the conversation, and ask for written instructions. The available federal guidance does not establish a single workaround for every account or loan situation, so do not assume that a disputed balance changes what you owe.

Keep a record of any payment you make while the earlier posting is under review, including its date, amount, and confirmation details. This helps distinguish the transaction being disputed from later installments and gives you a clearer record if the account history changes. Do not rely on the dispute process itself to change a due date or payment amount; the obligation to make payments otherwise owed remains in place under the mortgage terms.

Credit reporting protection during the dispute

The CFPB says a servicer may not furnish negative credit information about the disputed mortgage payment for 60 days after receiving the notice of error. This protection concerns furnishing negative information about that payment; it is not a waiver of other amounts due or a general suspension of the mortgage. See the CFPB’s mortgage-servicing guidance.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Keep the delivery date because the 60-day period is measured from the servicer’s receipt of the notice. The protection is limited to negative information about the payment being disputed, so it should not be read as permission to miss later payments or as a guarantee about every entry on a credit report. If you believe the disputed payment has been reported inaccurately, preserve the relevant notices and account records and raise the specific concern with the servicer.

If the response does not resolve the error

Compare the written response with the account entries and evidence you submitted. If the servicer says no error occurred, you can request the documents it relied on using the method described in its response. Keep the response, your request, any documents received, and updated statements together; these records make the unresolved point clearer if you pursue a complaint or seek professional help.

The CFPB identifies its complaint channel as an option for consumers with mortgage-servicing concerns. Its servicer rules guidance describes the federal obligations relevant to these disputes. A complaint or further contact does not guarantee that the account will be corrected. The federal materials summarized here do not determine the best state-specific remedy or deadline for an individual borrower.

If foreclosure is threatened, the dispute is causing substantial credit harm, or the servicer persistently refuses to address an apparent posting error, promptly seek advice from a qualified housing counselor or an attorney experienced in mortgage servicing. The right next step can depend on the loan, the records, and state law.

Common mistakes to avoid

  • Sending the notice only to a general payment address. Check whether the servicer requires notices of error at a separately designated address.
  • Describing a broad problem without identifying the transaction. Include the payment date and amount and explain which account entry does not match.
  • Sending originals or an unorganized packet. Keep original records and send copies that relate to the disputed posting.
  • Assuming the servicer’s investigation pauses later payments. Continue payments currently due under your mortgage terms.
  • Relying on a call without preserving a written notice. Use the formal notice route when you are disputing a servicing error, and retain delivery proof.
  • Assuming an error or remedy before reviewing the loan terms. State what you believe happened and ask the servicer to explain its decision; the outcome depends on the account facts and applicable requirements.

Quick checklist before you send

  • Have you matched the payment against the statement and payment history, bank transaction, and any confirmation?
  • Does the notice identify you, the loan, and the specific payment or posting you believe is wrong?
  • Have you said what you expected, what the account shows, and what correction or written explanation you are requesting?
  • Did you check for the servicer’s designated notice-of-error address and retain a complete copy and delivery proof?
  • Have you planned to continue making payments otherwise due while the review is pending?

This checklist is a way to keep the issue focused, not an additional set of legal prerequisites. The core regulatory notice information remains your name, information identifying the loan, and a description of the error you believe occurred. Supporting records can clarify the discrepancy, but the central task is to describe it accurately and send the notice to the right place.

Frequently Asked Questions

How do I dispute a mortgage payment that was applied incorrectly?

Compare the mortgage statement and payment history with your bank record, payment confirmation, and relevant payment instructions. Then send a written notice of error that identifies you and the loan, describes the specific payment and mismatch, and states the correction or explanation you want. Send it to the servicer’s designated notice address when one applies, and keep a copy and proof of delivery.

Where should I send a notice of error to my mortgage servicer?

Check your monthly statement, coupon book, or the servicer’s website for a special address for notices of error. If the servicer designated an address and informed you it must be used, send the notice there rather than assuming a general payment or customer-service address is sufficient.

How long does a mortgage servicer have to respond to a notice of error?

For most servicing errors, the servicer must acknowledge receipt within five days and generally respond within 30 days, excluding Saturdays, Sundays, and legal public holidays. It may add 15 days only if it sends written notice before the original response period expires and explains the reason.

Can I stop paying my mortgage while the servicer investigates?

No. A dispute about an earlier posting does not cancel later installments owed under your mortgage. Continue paying as required by your loan terms. If the disputed posting makes the amount currently due unclear, promptly contact the servicer, document the conversation, and ask for written instructions.

What if the servicer says no error occurred?

The written response should explain why the servicer believes no error occurred and tell you how to request the documents it relied on. You may request those documents; they generally must be provided without charge within 15 days, excluding weekends and legal public holidays, subject to confidentiality, privilege, and proprietary-information limits.

Does a notice of error protect my credit during the dispute?

The CFPB says the servicer may not furnish negative credit information about the disputed mortgage payment for 60 days after receiving the notice. That limited protection does not waive other amounts due, suspend later payments, or guarantee an outcome on every credit-report entry.

The Bottom Line

Compare the payment history with your own records, send a focused written notice of error to the servicer’s designated address, and keep proof of delivery. Track the servicer’s written response and request the documents relied on if it finds no error. Continue making payments otherwise due while the issue is reviewed; for foreclosure risk or serious unresolved harm, seek qualified housing or legal help.
