Gather the details that determine which rules to check
Before looking up requirements, write down the transaction facts. Rules and procedures can depend on where the sale or transfer takes place, the buyer’s state of residence, whether a licensed dealer or a private party is involved, and whether the firearm is a handgun or a long gun.

These details matter both for who conducts a background check and for which interstate-transfer rules apply.

Use ATF’s Brady State Lists to identify the check route
Open ATF’s Brady State Lists and locate the state. The list identifies whether the FBI conducts NICS checks, the state acts as a point of contact (POC) for all covered transactions, or the state handles only some checks. In a partial-POC state, responsibility can vary by firearm or transaction type, so read the state’s linked clarification rather than relying on the label alone. The page’s search listing reports a last update of February 10, 2026.

ATF’s guide explains: “Some States, known as point of contact (POC) States, conduct NICS background checks for some or all firearms transfers.” A POC arrangement changes who processes the check; it does not, by itself, answer whether a buyer needs a permit or whether other state sale conditions apply.
Verify state requirements with the responsible agency and current law
Follow the state link on ATF’s list to the relevant state-issued explanation. Depending on the state, the responsible source may be the state police, department of justice, attorney general, or another agency. Look specifically for the requirements that apply to your transaction:

- Whether a permit, license, or separate state approval is needed
- Required identification or other documents
- Any state background-check process or fee
- Waiting periods or other timing conditions
- Rules for dealer sales versus private transfers
An agency page or FAQ can explain how to complete a process. If you need to establish whether a condition is legally required, check the current state statute or regulation as well. ATF cautions licensees to comply with applicable state law; its POC list is not a state-law digest.
Keep the federal baseline separate from state rules
ATF says licensed dealers generally must conduct a NICS background check for covered transfers to nonlicensees, subject to limited exceptions. Which entity processes the check can differ in POC states. A transaction that does not require a point-of-sale NICS check under an exception should not automatically be treated as exempt from every state requirement.

Check both states before an interstate purchase
If a sale crosses state lines, check the laws of both the buyer’s state and the state where the seller or dealer is located, along with the permitted transfer route. ATF says a firearm may be shipped to a licensed dealer in the buyer’s state for delivery there. Its over-the-counter exception for a nonresident applies to rifles and shotguns, and remains subject to federal law and the laws of both states. Do not assume that a route allowed for a long gun also applies to a handgun.

ATF’s licensee guide provides the relevant federal interstate-sale guidance. Confirm current state procedures with the official agencies for both states before relying on an exception or arranging a transfer.

Understand what a check result does—and does not—tell you
NICS is a background-check system used to determine whether a transfer may proceed under applicable law. A denial may reflect a federal or state prohibition; a general state lookup cannot determine an individual’s eligibility. The FBI’s About NICS page explains the system and possible denials. A delayed response is also not the same as a general ruling on a person’s eligibility; the transaction and applicable procedures matter.

Recheck before the transaction
State laws and agency procedures can change. Use ATF’s list as a starting point, then check the latest state-issued material and applicable law close to the transaction date. For a specific sale, confirm the requirements for the exact firearm, transfer method, and states involved rather than relying on a broad summary or an old agency page.
