Then open the underlying order, filing, rule, or interpretation and verify its date and current status. An index entry or press release is a starting point—not, by itself, a complete account of the law or a case’s outcome.
Find SEC crypto enforcement actions
Start with the SEC’s Enforcement Actions index, under its Cyber, Crypto Assets and Emerging Technology materials. The index organizes matters by action name and filing date, includes a Crypto Assets section, and links to individual records. It also has a separate Trading Suspensions section.
The index was last reviewed or updated April 24, 2025. Treat it as a discovery tool rather than a live, complete record of everything that has happened since. Open the individual matter and check for later filings, orders, announcements, or court decisions before describing its status.
What to verify in a matter
- Who brought the action and against whom.
- The filing date and, where available, the court case or docket number.
- What the SEC alleged, distinguishing allegations from facts established by a court.
- The latest procedural event and its date: for example, whether the case is pending, settled, dismissed, or resolved by a court.
Use procedural verbs that match the record. A complaint may say the agency “alleged” or “charged” conduct; it does not establish that a court found the allegations true. A settlement, dismissal, or court ruling should be described only after checking the relevant order or decision.

Search CFTC crypto announcements and records
Use the CFTC’s general Press Releases page. Its controls let you search by keyword, press release type, release number, tag, and year. Search for a token, company, activity, or conduct term; note the release date and number; then follow links to any underlying order, court filing, rule, or agency material.
This is a general announcement index, not a verified, exhaustive crypto-enforcement docket. A search result can help locate a matter, but it cannot establish that you have found every CFTC action. For a specific case, use the announcement to identify and open the primary order or court record, then check its case number, filing date, allegations, and latest procedural status.
Separate proposals and staff explanations from final action
The CFTC page listed an advanced notice of proposed rulemaking concerning crypto asset transactions and markets dated October 5, 2026. An advanced notice seeks input at an early rulemaking stage; it is not a final rule. The page also listed updated FAQs concerning registrants and crypto assets dated September 24, 2026. FAQs are explanatory material, not a substitute for a Commission rule or the underlying law.
Find current SEC and CFTC guidance on crypto assets
For broader SEC materials, check the agency’s March 17, 2026 interpretive release page. The SEC and CFTC jointly issued an interpretation regarding federal securities laws and crypto assets; it became effective March 23, 2026. The CFTC-hosted Federal Register text is available here.

The interpretation classifies crypto assets and discusses when an asset may be subject to an investment contract. It also addresses protocol mining, protocol staking, wrapping, and airdrops. It states that it does not supersede or replace the Howey test, which it describes as binding legal precedent; it conveys the Commission’s views about how aspects of that test apply to crypto assets and transactions. Read the interpretation as agency guidance on those questions, not as a substitute for the governing legal test or a universal classification of every asset.
Use SEC staff FAQs with their stated limits
The SEC Division of Corporation Finance’s crypto FAQs were updated September 28, 2026. The page says the FAQs represent staff views, are not a rule or regulation, have no legal force or effect, and create no new obligations. They can explain staff thinking, but cite the governing law or Commission interpretation for legal propositions, and do not present a staff FAQ as an adopted SEC rule.

Identify what kind of record you found
Agency websites bring different kinds of material together. Before relying on a page, identify its issuer, document type, status, date, and scope. These categories are not interchangeable:
- Enforcement complaint or order: a case-specific record. A complaint states allegations; an order may record a ruling, settlement, or other disposition. Check the document itself and later case activity.
- Final rule: an adopted agency regulation. Check its publication and effective dates and the activity it covers.
- Proposed rule or advanced notice: a request for comment or an early rulemaking step, not an effective final requirement.
- Interpretation: an agency’s explanation of how it understands legal provisions apply. Check the issuing agencies, text, and effective date, and distinguish the interpretation from statutes and binding precedent.
- Staff FAQ: an explanation by agency staff. Check its disclaimer and do not treat it as a Commission rule.
- Press release: an announcement that may link to a primary record. Use it to find the record, not as a replacement for that record.
A practical verification checklist
- Choose the agency route. For SEC enforcement discovery, open the SEC enforcement index. For CFTC announcements, use the CFTC Press Releases filters.
- Open the linked primary material. Follow the result to the complaint, order, court filing, rule, interpretation, or FAQ instead of relying only on an index title or announcement.
- Record identifying details. Note the agency, document type, issue or filing date, release number or docket/case number, and any listed update or effective date.
- Check status in the record. Distinguish a proposal from a final rule, an allegation from a finding, and an ongoing case from a concluded one. For litigation, check later filings and decisions.
- Keep the conclusion within the document’s scope. A case involving particular parties and conduct does not, on its own, establish a universal classification for a token or activity.
For the joint 2026 interpretation, the SEC release page identifies the document as an interpretive release and notes CFTC guidance relating to it; the Federal Register version supplies the full text. Use those records for the release’s contents and dates, and use individual case records for case-specific allegations and outcomes.
