How to Find and Read a U.S. Tax Court Opinion

Use the Tax Court’s DAWSON Opinion search to locate decisions and understand their type, context, disposition, and durable docket links.

Search for U.S. Tax Court opinions in the court’s public DAWSON system: open the Opinion tab, then search by words or a phrase, docket number, case or petitioner name, judge, or date. To understand a result, identify its type and case context before reading the court’s analysis and disposition. For a durable reference, save a copy and link to the case’s docket record rather than relying on the document’s unique viewing link.

This guide covers the practical path from an uncertain clue—such as an issue, party name, or approximate year—to a verified opinion you can read, save, and cite. It also explains what the search labels do and do not tell you, how to troubleshoot a missing result, and how to avoid mistaking a party’s argument or a quoted sentence for the court’s holding.

What is a U.S. Tax Court opinion?

The U.S. Tax Court defines an opinion as “the written determination of a Judge on the issues tried and submitted to the Court for decision.” It is the court’s written decision on the issues presented for decision in a case—not a general explanation of tax law or a substitute for reviewing the facts and procedural posture of the case.

That distinction matters when searching and reading. A search result may match a phrase in the caption, title, or body of an opinion, but the match alone does not establish that the decision addresses the same circumstances as your question. Read the document as a decision in a particular case, and use the court’s current rules when procedure matters.

An opinion should therefore be treated as a package of identifying information, procedural history, factual findings, legal analysis, and a disposition. The useful question is not merely “Does this document contain my keyword?” It is “What issue did this judge decide, on what record, under what procedural posture, and with what result?”

Where to search for opinions

DAWSON is the court’s online system for searching opinions and case records. Members of the public can begin at the court’s Find an Opinion page and select the Opinion tab. The court also lists opinions released that day under “Today’s Opinions” in the Orders & Opinions area. Practitioners can reach the same opinion search through the Advanced Search link in their DAWSON dashboard, then select Opinion.

Search fields and options can vary with the route into the system. Start with the information you have rather than trying to guess a case title or a legal citation. The court’s guide describes searching by keyword or phrase, docket number, case title or petitioner name, judge, date or date range, and opinion type.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

For a same-day check, “Today’s Opinions” is the fastest route. It is a release list, not a substitute for the broader search: an older decision will not appear there simply because it is relevant to your issue. Use the Opinion tab when you need a historical result or want to combine several filters.

How to find an opinion using the information you have

If you know the docket number

Enter the docket number with its dash; the docket suffix may be omitted. For example, if the number you have includes a suffix after the dash, the court’s guidance says you can search without that suffix. Check the result against the case caption and the docket record so you do not confuse a similarly numbered matter or an opinion filed under another docket.

The dash is easy to lose when a number has been copied from a note, email, or scanned document, so inspect the number before searching. Once a result opens, compare the complete displayed number, caption, judge, date, and type with the information you started with. If the result is a consolidated matter, verify the individual docket record as well.

If you know a party or case name

Search using the full petitioner name or the petitioner’s last name. The court’s user guidance does not support partial-name searches, so a fragment of a name may fail even when the correct case is in DAWSON. If a name search does not work, verify its spelling and try a distinctive word from the caption or opinion instead.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Do not assume that a shortened business name, an attorney’s name, or a respondent’s name will work in the petitioner-name field. Begin with the petitioner’s full or last name as the court describes it. Then use the caption displayed in the result to confirm that the parties are the ones you intended.

If you know the issue but not the case

Enter a distinctive word or phrase related to the issue. DAWSON keyword and phrase searches include the case caption, opinion content, and opinion title; searches are not case sensitive. Put quotation marks around an exact phrase when you want to look for those words together. An unquoted term can match the entered letters or word as part of a longer word, so broad terms may return results that are not about the issue you mean.

Start with a phrase that is likely to appear in the court’s wording rather than a very general subject. For example, a distinctive statutory phrase or a combination of two unusual terms will usually produce a more useful list than a single broad word. If an exact phrase produces no result, remove the quotation marks and try the important term by itself; the system may have used different wording or punctuation.

Once you have results, narrow them using the fields available for docket number, case title or petitioner name, judge, date or date range, and opinion type. If you know roughly when the opinion was issued, a date range can make a broad issue search more manageable. Avoid treating a phrase match as proof that an opinion resolves your question: open the document and confirm the issue it actually decides.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

If you know the judge or approximate date

Use the judge field or date/date-range filter to narrow the search. A date range is useful when you know approximately when a decision appeared but do not have a title or docket number. Confirm the result’s date and case details in the opinion itself and in its docket record, rather than relying on a search result alone.

A judge filter can be especially useful when a phrase is common across many opinions. Combine it with a date range or a second keyword instead of assuming that every result by that judge concerns the same legal question.

If you want the latest opinions

Check “Today’s Opinions” in the court’s Orders & Opinions area for opinions released that day. If you are looking for an older opinion, use the Opinion search rather than assuming the day’s list contains the relevant document.

A practical DAWSON search workflow

  1. Choose the Opinion route. From the public Find an Opinion page, select Opinion. Practitioners can use Advanced Search in the DAWSON dashboard and then select Opinion.
  2. Enter your strongest clue first. Use a docket number, full or last petitioner name, a distinctive phrase, judge, or date range. You do not need to fill every field.
  3. Decide whether the wording must be exact. Quotation marks request an exact phrase. Leave them off when you want the system’s broader word matching.
  4. Apply narrowing fields. Add the docket, case or petitioner name, judge, date/date range, or opinion-type selections that fit what you know.
  5. Open and verify the document. Check the caption, docket number, judge, date, and displayed type, then read the opinion rather than relying on the search preview.
  6. Record the source. Save a copy if you need a retained record and keep the case docket link for a durable way to return to the item.

Searches are not case sensitive, so capitalization should not prevent a match. The more important distinctions are whether the term is quoted, whether the docket includes its dash, whether the name is complete enough for the court’s fields, and whether a date or type filter has unintentionally excluded the result.

  • Docket number: Check that it includes the dash. If a suffix appears after the dash, try omitting it.
  • Petitioner name: Try the full name or last name instead of a partial-name fragment, and check the spelling.
  • Issue or wording: Search for a more distinctive phrase from the opinion. Use quotation marks if you need an exact phrase; remove them if an exact-phrase search returns nothing.
  • Date: Verify the date range and broaden or refine it if needed.
  • Opinion type: Check which type selections are active and adjust them if the likely document type is being excluded.
  • Result confirmation: Compare the caption, docket number, judge, date, and opinion type with the case you mean before relying on a match.

It is often useful to change only one search element at a time. If a quoted phrase fails, test the same words without quotes. If a name fails, switch to a distinctive caption term. If a date-limited search fails, broaden the range before changing the issue terms. This preserves a clear record of what you tried and why the next search is different.

The court’s DAWSON User Guides and DAWSON Petitioner Training Guide provide additional guidance on using the system and its search options.

How to interpret the opinion type

The court’s training guide lists the selectable opinion categories as T.C., Memorandum, Summary, and Bench Opinion (Order of Service of Transcript). Treat these as the document labels shown in the search system. The categories help identify what kind of document you have found, but the search guidance does not explain the legal or precedential consequences of each category. Do not infer legal effect from the filter label alone; check the opinion and applicable court rules for the question you are researching.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

In particular, do not use a document’s type as a shortcut for deciding whether it applies to your facts. First determine what issues were submitted and decided, then consider the relevant rules and authorities. The court maintains its current Rules of Practice and Procedure online.

The type is still worth recording because it helps you and another reader identify exactly which document you consulted. A search list can contain multiple documents associated with related parties or proceedings. Recording the displayed type alongside the docket and date reduces the chance that a later reader opens a different item and assumes it is the same decision.

How to read an opinion in context

Read from the case-identifying details through the disposition. This sequence is a practical reading approach, not an official court-prescribed checklist.

  1. Identify the document. Record the caption, docket number, judge, date, and displayed opinion type. These details let you verify that the document is the one you intended to find.
  2. Establish the procedural posture. Work out which tax year or years and which issues are before the court, and what the parties asked the judge to decide. A decision about a particular issue or stage of a case should not be read as resolving every question in the dispute.
  3. Separate facts from positions. Read how the court frames the facts and issues, and distinguish the facts the court relies on from what either party argues. A party’s position is not automatically a finding by the court.
  4. Follow the reasoning. Track how the judge connects the applicable law to the facts. When a passage depends on another decision or a procedural requirement, check the cited authority and, where procedure is involved, the court’s current rules.
  5. Read the disposition. Identify what the court decided and any next procedural step stated in the opinion. Do not treat a sentence quoted out of context as the full decision or assume it governs a different factual situation without analysis.

Questions to ask while reading

  • What tax year or years does the decision cover?
  • Which claims, adjustments, penalties, or procedural questions were actually submitted to the judge?
  • Which facts does the opinion adopt, and which statements are descriptions of a party’s contention?
  • What statute, regulation, rule, or earlier decision supplies the legal test?
  • How does the judge apply that test to the facts in this record?
  • Does the disposition resolve the entire case or only identified issues, and does it state a next procedural step?

The court’s definition emphasizes that an opinion determines issues tried and submitted for decision. Reading the posture, analysis, and disposition together helps you avoid treating background discussion, a party’s contention, or an isolated passage as the whole result.

How to save, link, and cite an opinion

Use a docket link for a durable reference

The court says DAWSON creates a unique link each time an opinion or order is viewed. If you need to refer someone to the document without retaining a copy, link to the case’s docket record, where the opinion can be viewed. Save a copy if you need to retain the document for your own records. See the court’s DAWSON FAQs on searches and public access.

A practical citation file should retain the case caption, docket number, opinion date, displayed type, the docket-record URL, and a saved copy when retention is important. The docket link gives another reader a route back through the case record, while the copy protects against losing the exact version you reviewed.

Check consolidated cases carefully

When cases are consolidated for trial, briefing, and opinion, the court’s FAQ says opinions appear separately under each docket number. Confirm that the docket record you cite is for the opinion and party at issue; a related consolidated case record may not be the record you intend to reference.

Do not stop at a shared caption or a familiar party name. Open the record attached to the specific docket number and make sure the opinion’s identifying details match the proposition for which you plan to cite it.

Follow the court’s current citation and style guidance

Consult the court’s Citation and Style Manual for court-specific formatting. The court states: “In January 2022, the Tax Court modified the format, citation, and style used for all opinions and orders.” Older examples may therefore use a different format. The manual and the particular opinion are the appropriate places to check the format for a specific document; do not assume a single citation template applies to every opinion type.

When updating an older memorandum or research note, compare its citation form with the current manual instead of copying the older example unchanged. The January 2022 change is a reason to verify style, not a reason to discard an otherwise relevant opinion.

What is publicly available—and what to verify

The court’s public-access guidance says opinions and docket materials are available without registration for the document categories and date ranges it specifies. That does not establish that every document in every case can be viewed publicly. If you are looking for an older filing or a non-opinion document, check the court’s stated date and category limits in its Guidance for Petitioners: Starting a Case and public-access information.

Public access also does not remove the need to verify what you are viewing. A document may be related to the case without being the opinion that decided the issue you care about. Confirm the document label and docket record, and use the court’s current rules when the question concerns filing, timing, or another procedural requirement.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Finding and reading an opinion is legal research, not advice about what to file or how a tax controversy will be decided. For case-specific procedural questions, consult the current official rules and seek qualified advice when appropriate.

Common mistakes to avoid

  • Searching only a broad word. Broad terms can match the word or its letters inside longer words and may produce an unwieldy or misleading list.
  • Leaving quotation marks on by accident. An exact-phrase search can fail when the opinion uses a synonym, different punctuation, or a slightly different form of the words.
  • Dropping the docket dash. The court’s guidance specifically calls for the dash in a docket-number search.
  • Using a name fragment. Partial-name searches are not supported by the cited user guidance; use the full or last petitioner name.
  • Assuming the type label answers the legal question. T.C., Memorandum, Summary, and Bench Opinion are search categories, not a substitute for reading the decision and checking applicable rules.
  • Citing a transient document link. DAWSON creates a unique viewing link; use the case docket record for a durable reference and save a copy when needed.
  • Ignoring consolidation. Opinions in consolidated cases appear separately under each docket number, so verify the specific record.
  • Quoting without posture. A sentence may describe an argument or background rule rather than the holding on the submitted issue.

Frequently Asked Questions

How do I find a Tax Court opinion by docket number?

Open the public DAWSON Opinion tab and enter the docket number with its dash. The suffix after the dash may be omitted. Verify the returned caption, complete docket number, judge, date, and opinion type against the docket record.

How can I find an opinion if I only know the issue?

Search a distinctive word or phrase. Keyword and phrase searches cover the caption, opinion title, and opinion content and are not case sensitive. Put quotation marks around an exact phrase; remove them or try a more distinctive term if no result appears. Then narrow by judge, date range, docket, name, or opinion type.

Does DAWSON support partial petitioner-name searches?

The court’s user guidance says partial-name searches are not supported. Enter the full petitioner name or last name, check spelling, and try a distinctive caption or opinion phrase if the name search fails.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Where do I find opinions released today?

Use “Today’s Opinions” in the Orders & Opinions area of the Tax Court website. For earlier decisions or combined filters, use the Opinion search in DAWSON.

What do T.C., Memorandum, Summary, and Bench Opinion mean?

They are selectable opinion categories listed in the court’s training guide. Use them to identify and filter documents, but do not infer a category’s legal or precedential effect from the search label alone. Read the opinion and check current court rules for the question involved.

How do I link to an order or opinion?

DAWSON creates a unique link each time an opinion or order is viewed. The court recommends linking to the case docket record, where the item can be viewed, and saving a copy if you need to retain it.

How do I cite a Tax Court opinion after finding it?

Consult the Tax Court’s current Citation and Style Manual and the particular opinion. The court says it modified the format, citation, and style for all opinions and orders in January 2022, so older examples may not reflect current formatting.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Why can’t I find an older filing or related docket document?

Public access applies to the document categories and date ranges specified by the court. Check those limits before assuming a document should be publicly viewable. In a consolidated case, look under the individual docket number because opinions appear separately under each docket.

The Bottom Line

Use DAWSON’s public Opinion tab, search with the strongest clue you have, and refine with the court’s docket, name, judge, date, and type fields. Verify the caption and procedural posture, read the reasoning and disposition together, and check the current Tax Court rules and Citation and Style Manual. For a lasting reference, save the document and link to its case docket record.
