The docket—not a news story or the restaurant’s brand name—determines whether gift cards are still accepted, whether a deposit can be claimed, and the deadline for filing paperwork.
How do I find out if a restaurant filed for bankruptcy?
Restaurant bankruptcies are filed by a legal entity, which may be a parent company, franchise operator, holding company, or operating subsidiary rather than the name printed on the menu. The most reliable search is therefore a combination of the restaurant’s public brand and the entities connected with it.

1. Create or use a PACER account
PACER is the federal judiciary’s system for viewing bankruptcy and other federal court records. Anyone can access PACER, but you must register for an account before searching or viewing records. PACER covers federal bankruptcy cases; it does not cover a state-court receivership, a county insolvency proceeding, or an ordinary business closure.
2. Search the nationwide Case Locator
Use the PACER Case Locator when you do not know which bankruptcy court received the filing. Search the restaurant’s likely legal name in quotation marks, then try variations:

- The exact brand name and common punctuation or spacing variations.
- The parent company listed on the restaurant’s website, receipt, gift card, or terms of sale.
- The operating company shown on a reservation confirmation, catering contract, or credit-card statement.
- A franchisee or local operator’s name if the restaurant is franchised.
The nationwide index is updated daily, and newly filed cases typically appear within 24 hours. A search of the particular court’s CM/ECF system can show information immediately once you know the district, so use the court-specific record for the latest status and filings.
3. Confirm that the result is the right debtor
Before relying on a case, write down the debtor’s exact legal name, case number, court, filing date, bankruptcy chapter, and current status. Compare those details with your receipt, contract, reservation email, or the legal name shown on the restaurant’s payment statement. Do not assume that a familiar restaurant name identifies the debtor. Several affiliated entities can file separate cases, and a franchise location may not be part of the case at all.
4. If no case appears
Retry with the parent and operating-company names. If you know the likely district, search that court directly and then run the locator again. If the name still produces no result, contact the federal bankruptcy clerk’s office where the company is likely based and ask whether the court can search alternate debtor names. Clerks can explain how to locate a public record, but they cannot tell you whether your claim will be paid or give legal advice.
You can also review federal bankruptcy records at a clerk’s office. Many bankruptcy courts provide limited automated telephone information. These options are useful when an online search is incomplete or a case was filed very recently.
Where can I look up a restaurant bankruptcy case?
Use the source that matches what you know. PACER’s national index is the starting point for an unknown district; a court’s own CM/ECF docket is the better source for the newest entries after you identify the court.

The locator is an index, not a substitute for the complete docket. Once you have a case number, open the court’s record and read the filings that control customer treatment and deadlines.

What should I read in the bankruptcy docket?
Begin with the petition and the earliest motions and orders, then move forward through the most recent customer-related entries. A docket description can be abbreviated or misleading; open the underlying PDF or filing whenever possible.

- Chapter: Chapter 11 usually involves an operating reorganization, although the business can later sell assets or close. Chapter 7 commonly involves liquidation by a trustee, but the practical result depends on whether assets exist.
- Filing date: This helps distinguish purchases or deposits made before the petition from transactions after the case began.
- Current status: Look for a confirmed plan, conversion to another chapter, dismissal, sale approval, or a closing order.
- Debtor entities: Check whether your location, card issuer, caterer, or contracting entity is actually listed.
Search the docket for customer-impact terms
Use the docket’s search function, or scan entries for terms such as “gift card,” “customer program,” “deposit,” “bar date,” “proof of claim,” “sale,” “liquidation,” and “claims.” This is a practical checklist, not a promise that every case will contain each type of motion.
Pay particular attention to first-day motions and orders. A Chapter 11 debtor may ask permission to honor prepetition gift cards, continue a loyalty program, or accept new deposits. The court’s order may authorize that conduct with conditions, dollar limits, expiration dates, location restrictions, or reporting requirements. A later order can change an arrangement that appeared in an earlier filing.
Find the controlling notices
Locate the notice of bankruptcy and any separate notice establishing a claims deadline. In Chapter 11, creditors receive a specific bar-date notice. In an asset Chapter 7 case, the deadline appears in the notice of bankruptcy and related court documents. The date, filing method, and address in your case’s notice control; never copy a deadline from another restaurant, another chapter, or a generic web page.
Can I still use my gift card if a restaurant files for bankruptcy?
Possibly, but a filing alone does not answer the question. Check whether the location is still operating, whether the debtor asked the court to honor prepetition cards, and whether an order authorizes redemption. Also confirm that the card was issued by the debtor or an affiliate covered by the order.

Operating Chapter 11 restaurant
An operating Chapter 11 debtor may request authority to redeem cards sold before the filing. A court can approve redemption subject to conditions. The order may specify which stores accept the cards, whether cards can be used for food only or also gratuity, a cutoff date, or a maximum amount. Read the order itself and any customer notice rather than relying on a social-media post or a news summary.

Restaurant that closes or liquidates
If locations close, a sale is approved, or a liquidation begins, practical redemption can end even if the plastic card has an unused balance. The remaining value may become a monetary bankruptcy claim. A purchaser of selected assets is not automatically responsible for cards issued by the old debtor; the sale order and customer notices determine whether a buyer assumed that obligation.
Different location or franchise operator
A nearby restaurant with the same brand may be owned by a different franchisee or affiliated company. That location may accept the card, refuse it, or be outside the bankruptcy order. Compare the legal entity on your receipt with the debtor names in the petition and order. Do not treat brand recognition as proof that two operators are legally the same.
Cards bought before and after the filing
Record when you purchased the card. The legal and practical treatment of prepetition value can differ from value sold after the petition date. A court order may address only prepetition cards, only postpetition sales, or both. Your purchase date, the issuing entity, and the exact order all matter.
What happens to a restaurant gift card in Chapter 11?
There are three separate questions: whether you can spend the card now, whether the debtor will honor it at the relevant location, and what remedy exists if redemption stops. A “yes” to the first question does not guarantee the second indefinitely or establish a cash refund.

A 2017 U.S. bankruptcy court opinion involving a restaurant illustrates why there is no nationwide automatic answer. The opinion explains that a Chapter 11 debtor can seek authority to honor prepetition cards and that a court may permit redemption while the business remains open. It also states: “The Bankruptcy Code does not explicitly provide for the treatment of pre-petition gift card claims.” The opinion describes decisions reaching different conclusions—some treating unredeemed balances as deposits eligible for priority treatment and others treating them as general unsecured claims. The court allowed redemption in that case but did not establish a universal priority rule.
How do I find the deadline to file a claim for a restaurant deposit?
Find the case-specific bar-date notice in the docket. The notice tells you whether you must file a proof of claim, the deadline, the permitted filing method, and where to send or upload it. A deadline is not inferred from the petition date or from another company’s case.

What counts as a deposit?
A reservation, banquet, catering, or event payment is not automatically treated like a gift card. Official Form B 410 includes a limited priority category for certain deposits toward personal, family, or household property or services. Whether your payment meets that category depends on the transaction, the amount, the purpose, the parties, and the applicable statutory requirements.
For example, preserve the contract and cancellation terms for a wedding reception, the invoice for a catered event, or the reservation confirmation for a prepaid booking. A business event, a corporate account, and a personal household reservation can present different facts. Do not label every prepaid amount a “priority deposit” on the assumption that the court will agree.
Gather evidence before filing
- Receipt, invoice, or gift-card purchase confirmation.
- Gift-card number and a record of the balance, such as an account screenshot or written balance inquiry.
- Reservation confirmation, catering or banquet contract, and cancellation or refund terms.
- Credit-card or bank statement showing the payment and date.
- Emails or messages documenting cancellation, refusal to honor the card, or an agreement to reschedule.
- The restaurant, parent, franchisee, or operator’s legal name shown on the transaction.
Use the current official form
Official Form B 410 is the federal Proof of Claim form. The official listing identifies an update dated April 1, 2025, with the form effective December 1, 2024. Use the current version and its instructions, plus the bankruptcy court’s local filing directions. The form asks you to state the debt and provide documentation establishing the claim and supporting evidence. Attach the records the form and local procedures require, while protecting sensitive personal information.
File according to the case instructions
- Read the bar-date notice and confirm the exact deadline, time zone, and filing channel.
- Complete Form B 410 using the debtor and case number exactly as shown in the docket.
- Describe the transaction clearly: gift-card balance, reservation deposit, catering payment, or another amount, and identify the purchase or payment date.
- State the amount you believe is owed and indicate the basis for any priority request only if the facts and form support it.
- Attach receipts, contracts, statements, and correspondence as required.
- Submit through the court’s approved electronic or paper process and keep the confirmation, stamped copy, or mailing proof.
Filing a proof of claim does not guarantee payment. Recovery depends on the debtor’s assets, the confirmed plan or liquidation, claim objections, priority rulings, and available distributions.

Not categorically. Courts have treated unredeemed prepetition gift-card claims differently. Some decisions have viewed them as deposits that may qualify for priority treatment; others have classified them as general unsecured claims. The Bankruptcy Code does not expressly settle the treatment of prepetition gift cards, and the relevant case law is limited.

The 2017 restaurant case is useful as an example of the process, not as a rule for every debtor. It permitted redemption during the Chapter 11 operation but expressly left the general priority question unresolved. In your case, the debtor’s motions, the court’s orders, the timing of your purchase, and any claim objection matter more than the label printed on the card.

Keep two issues separate:
- Redemption: whether the business or an authorized operator will accept the card now.
- Claim classification: how the unused balance is treated if redemption ends and you seek payment through the bankruptcy.
What if the docket does not answer my question?
Ask the bankruptcy clerk about the record
Clerks can help you locate a docket entry, identify where a notice was filed, or explain the court’s public-record process. They generally cannot interpret an order for your personal facts, classify your claim, or predict recovery. Have the case number and debtor name ready.
Read later orders, not just the first customer motion
Gift-card authority can be extended, narrowed, or terminated. A sale order can transfer some customer obligations and exclude others. A plan or claims-resolution order can set procedures different from the initial notice. Always check the newest relevant order before using a card or filing.
Check whether you are dealing with a nonbankruptcy proceeding
If PACER shows no federal case, the company may be in a state receivership, assignment for the benefit of creditors, or ordinary closure. Those proceedings use different records and deadlines. PACER cannot confirm or rule out every form of financial distress.

If the debtor disputes your amount, the issuer is unclear, a large event deposit is at stake, or the deadline has passed, a bankruptcy lawyer can evaluate your options. This guide explains how to locate the public record; it is not legal advice.
A practical checklist for diners and event customers
- Save the card, receipt, contract, reservation email, and payment statement immediately.
- Search the restaurant’s brand, parent, franchisee, and operating-company names in PACER Case Locator.
- Record the exact debtor, case number, court, chapter, filing date, and status.
- Open the complete docket and read customer-program motions, gift-card orders, sale or liquidation orders, and claims notices.
- Confirm whether your card or deposit was issued or accepted by a debtor covered by the order.
- Write down the controlling bar date and filing instructions from the case notice.
- Use the current Form B 410 if a proof of claim is appropriate, and attach documentation.
- Keep your filing confirmation and continue monitoring the docket for amended notices, objections, or plan orders.
The decisive facts are always the named debtor, the transaction date and documentation, the latest court order, and the deadline in your case’s notice. Bankruptcy does not automatically cancel every gift card, guarantee redemption, or promise a refund for every deposit.
