Ask how they will classify each loan, assess the legal standard that applies, and explain fees and likely next steps. Discharge is possible in some cases, but it is not automatic: for debts covered by Bankruptcy Code section 523(a)(8), a bankruptcy court generally must determine that repayment would impose an undue hardship.
Why student-loan bankruptcy cases need specific legal experience
Bankruptcy can discharge some student-loan debt, but the rules depend on the kind of debt and the facts of the case. For debts covered by section 523(a)(8) of the Bankruptcy Code, a borrower generally must ask the bankruptcy court for an undue-hardship determination through a separate adversary proceeding. That proceeding is distinct from the bankruptcy case itself.

The U.S. Department of Justice (DOJ) has a process for its attorneys to review certain student-loan cases involving the federal government. Its November 17, 2022 guidance, developed with the Department of Education, directs government attorneys to assess a borrower’s present ability to pay, whether the inability is likely to persist, and whether the borrower made good-faith efforts to repay. The DOJ says attorneys should stipulate to supporting facts and recommend discharge when the information establishes the relevant conditions. A recommendation may support full or partial discharge, but it does not decide the case.
The judge makes the final decision, independently applying the law. The U.S. Bankruptcy Court for the Northern District of California explains this process for Department of Education-held loans; that court’s explanation does not establish that every loan or every case follows the same path. DOJ guidance is for government attorneys, not a promise that the government will recommend discharge. A lawyer should identify which rules apply to your specific loans and court.

Loan classification matters, too. Some private loans used for education expenses may be dischargeable under ordinary bankruptcy rules rather than the special undue-hardship standard. Whether that applies depends on what the loan financed and its legal characteristics. Do not rely solely on a servicer’s label or your own shorthand for the debt; have counsel review the underlying documents.
These distinctions are one reason a general promise that “student loans are” or “student loans are not” dischargeable is not enough. A single borrower may have more than one education-related debt, and the relevant documents may identify different lenders, holders, guarantors, or uses of proceeds. Ask the lawyer to explain the classification loan by loan, including what remains uncertain and what records could resolve it.
Likewise, the federal review process is one part of some cases, not a substitute for the court proceeding. Ask whether the lawyer has experience with the adversary proceeding itself, how a government review may fit into the case, and what the lawyer would do if a government recommendation is not made. The judge remains responsible for the final determination.

Where to look for a qualified attorney
Start with a state or local bar referral service
Contact the bar association in the state or locality where your bankruptcy case would be handled and ask whether it offers a lawyer-referral service. The Consumer Financial Protection Bureau (CFPB) recommends using local bar referrals and verifying that the attorney is licensed in the relevant state. Ask the referral service whether it can direct you to lawyers who handle bankruptcy cases involving student-loan dischargeability.
If you are unsure where a case would be handled, start by identifying the bankruptcy court district that serves your location, then ask the bar association which referral service covers it. A referral is a way to find candidates, not an endorsement or a finding that a particular lawyer has the experience you need. Confirm licensure and ask about the lawyer’s own work with student-loan matters.
Check legal-aid options if cost is a concern
The CFPB provides state-by-state information about legal-aid options. Eligibility and available services vary, so contact the organization serving your area to ask whether it handles bankruptcy advice or representation and what income, case, or other requirements apply. Do this early: if an organization cannot take your case, you will still have time to pursue other referrals.
When contacting a provider, describe that you need help assessing bankruptcy and student-loan debt, and ask whether its service includes advice, representation, or only a referral. Do not assume that an organization offering general legal assistance can take a bankruptcy adversary proceeding. If it cannot represent you, ask whether it can identify another local resource or explain how to continue looking.

Use personal referrals as leads, not as verification
You can ask people you trust whether they know a bankruptcy lawyer, or ask an attorney you already know for a referral. A recommendation is a starting point, not proof of relevant experience. Independently check the lawyer’s license and ask about their work with student-loan adversary proceedings.
For general lawyer-finding and affordability guidance, see the CFPB’s page, “How do I find an attorney in my state?” The Administrative Office of the U.S. Courts also lists legal-help resources. Neither resource replaces checking a particular lawyer’s credentials, scope of service, and fit for your case.
How to screen candidates before hiring
When you contact a lawyer, explain that you are looking for advice about bankruptcy and student-loan debt. Ask for a consultation focused on whether the attorney can assess the specific loan types and any dischargeability proceeding that may be needed. The questions below are practical screening suggestions based on the court process and official lawyer-finding guidance; they are not an official government checklist.
| What to assess | Questions to ask | What a useful answer should clarify |
|---|---|---|
| Bankruptcy and adversary-proceeding experience | Have you handled adversary proceedings asking a bankruptcy court to determine whether student-loan debt is dischargeable? What role did you have in those cases? | Whether the lawyer has relevant experience beyond filing ordinary bankruptcy petitions, and what work they would handle in your case. |
| Loan classification | How will you determine which legal standard applies to each of my loans? What records do you need to review? | How the attorney will examine the loan documents, use of proceeds, and other relevant characteristics rather than relying on a label alone. |
| Federal-loan process | If a federal loan is involved, are you familiar with the DOJ process for government review? How does it affect the court case? | The distinction between a government attorney’s review or recommendation and the bankruptcy judge’s independent decision. |
| Case assessment | Which facts could matter to my present ability to pay, the likely persistence of hardship, and my past repayment efforts? What facts could weaken the case? | A case-specific explanation of relevant facts and uncertainties, rather than a guarantee based on a short description. |
| Local practice and licensure | Are you licensed in the state where my case would be filed? Have you handled bankruptcy matters in the relevant court? | Whether the attorney is authorized to practice where the case will proceed and has familiarity with the local forum. |
| Fees and scope | What work does your fee cover? Which court costs or additional services might be charged separately? How are payments handled? | A written explanation of the engagement’s scope, payment terms, and costs that may not be included in the quoted fee. |
| Communication and documents | What should I bring? Who will be my main contact, and how will you update me about developments? | A clear plan for gathering records and communicating, including who is responsible for answering questions. |
For a more useful consultation, ask how the attorney will move from the documents to a case assessment. For example: will the lawyer first inventory each debt and identify the applicable standard, then review financial and repayment records, and explain what further evidence is needed? This helps you understand both the analysis and the work the lawyer expects to perform. You can also ask whether the firm has handled matters involving loan types similar to yours, without expecting it to disclose confidential details about other clients.
Compare candidates on their answers, not just on how confident they sound. Be cautious if a lawyer guarantees a discharge, cannot explain how the loan type affects the analysis, or is vague about what the fee includes. The official materials do not establish a typical attorney fee, case timeline, success rate, or probability of discharge, so do not treat an unsupported number or prediction as a reliable benchmark.
What to bring to an initial consultation
Ask the attorney’s office for its own intake list before sending sensitive financial records. The following documents can help counsel identify the loans, understand the financial picture, and discuss the history of repayment. You may not have every item, and the lawyer can tell you what is necessary.
- Loan records: promissory notes, current statements, account histories, and notices that identify the lender, servicer, guarantor, or holder, if available.
- Education records: documents showing the school, program, enrollment period, and how the loan proceeds were used, where relevant.
- Repayment history: records of payments, deferments, forbearances, collection activity, and communications with lenders or servicers.
- Income and expenses: recent pay or benefit records, tax returns, bank information, and a current household budget, as requested by counsel.
- Other debt and bankruptcy information: a list of debts, prior bankruptcy filings, and any notices or court papers related to collection or bankruptcy matters.
- Hardship-related information: records relevant to health, work, caregiving, or other circumstances affecting your ability to earn or repay, if they bear on your situation.
Keep copies and note any gaps or conflicting details rather than trying to resolve them by guessing. A lawyer needs a sufficiently accurate picture to advise you about which facts matter and what additional records to seek.

A short written inventory can make the first meeting more focused. For each loan, note the name shown on the latest statement, the balance if known, whether payments are current or paused, and any collection or repayment communications. Mark anything you cannot verify. This is not a substitute for the original records: the lawyer may need the notes and account documents to determine what kind of obligation each loan is.

How to evaluate the advice you receive
Expect a fact-based explanation, not a promised result
A lawyer should be able to explain which legal standard may apply to each loan, what information is missing, and how the known facts could affect the case. For loans covered by section 523(a)(8), the DOJ guidance describes factors government attorneys consider: current ability to repay, whether the inability is likely to continue, and good-faith efforts to repay. Those factors help explain the federal review process; they are not a guarantee of how a judge will rule in your case.
The DOJ guidance says government attorneys may recommend full or partial discharge when information supports it. The recommendation is not binding on the court. As the DOJ guidance states, quoting the Supreme Court’s decision in United Student Aid Funds, Inc. v. Espinosa, 559 U.S. 260, 278 (2010): “The bankruptcy court must make an independent determination of undue hardship . . . even if the creditor fails to object or appear in the adversary proceeding.” Ask counsel to explain how that principle and the governing law apply in the court where your case would be heard.
Ask for uncertainty to be made explicit
There may be unresolved questions about the nature of a loan, the evidence available, or the application of the law. Ask the attorney to distinguish what is known from what still needs to be verified. If you receive a broad statement such as “private loans are dischargeable” or “federal loans cannot be discharged,” ask how it applies to each loan’s documents and circumstances.

It is also reasonable to ask what the lawyer cannot yet determine and why. The answer may depend on obtaining a loan agreement, identifying the purpose of the funds, reviewing payment records, or applying the law in the relevant jurisdiction. Because no state or court district is specified here, a general description cannot settle the controlling undue-hardship test for an individual case. A lawyer should be able to identify the applicable local law rather than treating a federal process summary as the entire legal analysis.
Get the engagement terms in writing
Before hiring, review the written agreement. Confirm which services are included, whether the attorney will handle an adversary proceeding if needed, who will perform the work, how fees are calculated, and what costs could be additional. If the proposed scope excludes a possible student-loan proceeding, ask what that means for your options and whether a separate engagement would be required.

Understand cost and representation options
There is no reliable standard fee or total cost established here for student-loan bankruptcy representation. Fees can depend on the lawyer, location, work required, and whether a separate adversary proceeding is involved. Request a written fee explanation from each candidate and ask what is excluded; do not assume a bankruptcy-petition fee also covers litigation about student-loan dischargeability.
Ask whether the quoted amount covers an initial assessment only, representation in the bankruptcy case, the separate adversary proceeding, or some combination. Find out how any additional work is approved and billed, whether court costs are separate, and what payment arrangements are available. There is no official typical fee or timeline to use as a benchmark, so compare what each lawyer proposes to do rather than treating the lowest initial quote as the least expensive option overall.

- Identify the court location. Confirm the state and bankruptcy court district where a case would be handled, then use that state or local bar association’s referral service.
- Verify the attorney’s license. Check that the lawyer is licensed in the relevant state before discussing representation.
- Contact several suitable candidates if available. Ask whether they handle bankruptcy matters involving student-loan discharge adversary proceedings, and request a consultation and intake requirements.
- Prepare a loan and financial summary. List each debt, the names shown on statements, balances if known, repayment status, and the records you can provide. Avoid assuming that similar-looking loans receive identical treatment.
- Ask the screening questions. Cover the lawyer’s experience, loan classification, federal process, case-specific facts, fee scope, and communication plan.
- Compare written terms and explanations. Choose based on relevant experience, clarity about uncertainty, state licensure, local familiarity, and affordability—not a promised result.
- Check legal aid if needed. Use the CFPB’s state-by-state legal-aid information and contact local providers directly about eligibility and available services.
It can help to keep a simple comparison record after each consultation: the lawyer’s relevant experience, which loans or documents still need review, the stated scope and fees, and your unanswered questions. That makes it easier to compare actual explanations rather than rely on memory or a single confident-sounding prediction. If a candidate cannot answer a question in the first meeting, ask when and on what basis they could provide a more informed answer.
Common mistakes to avoid
- Hiring a lawyer who only handles routine bankruptcy filings. Ask directly about student-loan dischargeability litigation and adversary proceedings.
- Treating all education debt alike. Ask counsel to classify every loan from its documents and circumstances.
- Assuming the DOJ process decides the case. It guides government attorneys’ review; the bankruptcy judge independently decides dischargeability.
- Accepting a guaranteed outcome. Neither an attorney’s assurance nor a government recommendation binds the judge.
- Choosing based only on the initial quote. Confirm whether the quote includes advice, the bankruptcy case, an adversary proceeding, and related costs.
- Relying on a petition preparer for legal advice. A non-attorney preparer may fill in forms but cannot advise you or represent you in bankruptcy court.
- Waiting until you have every document. Ask a lawyer what to collect and how to proceed; missing records can be identified and addressed rather than guessed at.
- Assuming a referral confirms a lawyer’s fit. Use bar referrals and personal recommendations to find candidates, then verify licensure, experience, communication, and scope yourself.

Frequently Asked Questions
Do I need a bankruptcy attorney to try to discharge student-loan debt?
A borrower generally must seek an undue-hardship determination through a separate adversary proceeding for debts covered by Bankruptcy Code section 523(a)(8). A qualified attorney can help identify which standard applies, prepare the case, and represent you in court. U.S. Courts says non-attorney petition preparers may enter information on forms but cannot give legal advice or assist in bankruptcy court.

What should I ask a student-loan bankruptcy lawyer before hiring them?
Ask whether they have handled student-loan discharge adversary proceedings, how they will classify each loan, what records they need, and whether they understand the DOJ process for relevant federal loans. Also ask what facts could matter to your case, what work the fee includes, what costs may be additional, and who will communicate with you.

Does the DOJ decide whether my student loans are discharged?
No. DOJ guidance describes how government attorneys assess certain cases and may recommend full or partial discharge. The bankruptcy judge makes the final decision independently, and the guidance is not a guarantee of a recommendation or discharge.
Are private student loans dischargeable in bankruptcy?
Some private loans used for education expenses may be treated under ordinary bankruptcy rules rather than the special undue-hardship standard. The result depends on what the loan financed and its legal characteristics. Have a lawyer review the underlying documents for each loan instead of relying on the servicer’s label.
How much does a lawyer cost for student-loan bankruptcy help?
There is no reliable standard fee established here. Cost can depend on the lawyer, location, work required, and whether a separate adversary proceeding is involved. Ask for written terms that specify what is included, whether court costs are separate, and how additional work is billed. If cost is a barrier, check local legal-aid eligibility and bar referral options.
Where can I find low-cost or free legal help?
The CFPB provides state-by-state legal-aid information, and state or local bar associations may offer lawyer-referral services. Contact providers directly to ask whether they handle bankruptcy advice or representation, what services are available, and what eligibility requirements apply.
What documents should I bring to a consultation?
Ask the lawyer’s office for its intake list. Useful records may include loan notes and statements, documents identifying the school and use of proceeds, repayment and collection history, income and expense information, other-debt lists, prior bankruptcy information, and records relevant to health, work, or caregiving circumstances. Bring what you have and identify gaps rather than guessing.
The Bottom Line
Use a state or local bar referral service or legal-aid resource to find candidates, then verify state licensure and ask specifically about student-loan discharge adversary proceedings. Have the attorney classify each loan from its documents, explain the applicable legal standard and uncertainties, and put the fee scope in writing. A DOJ recommendation may inform some federal cases, but only the bankruptcy court makes the final dischargeability decision.
