How to Evaluate a Property Developer Before Buying a Home

A practical, jurisdiction-aware checklist for checking a property developer, verifying the land and project, understanding contract risks, and comparing documented delivery and quality.

Evaluate the company, the land, the contract, the money protections and the home’s quality separately. A persuasive sales pitch or well-known brand cannot establish who is legally responsible, whether the project is approved, or what happens to your deposit if construction is delayed. Before paying, ask an independent local property lawyer or conveyancer to verify the specific land and review the agreement.

Start by identifying who is actually selling and building the home

A development may be marketed under a familiar brand while the contract names a separate company. Ask for the full legal names of the seller, developer, landowner and any project company. Have your lawyer identify which entity is responsible for construction, transferring the property, returning money if required, and meeting other contractual promises. A parent company’s reputation does not automatically make it liable for a project company’s obligations.

Check whether the builder or developer is licensed or registered where local law requires it, and look for regulator records or official buyer directories. The information available varies by jurisdiction. Ontario’s Home Construction Regulatory Authority (HCRA), for example, advises buyers to check builder licensing and its Ontario Builder Directory, which includes fields such as years in operation and homes built. Those checks concern Ontario; they are not a universal licensing system. Singapore’s Urban Redevelopment Authority (URA) provides public information about developers’ construction-quality performance under Singapore’s system.

For completed projects, look for verifiable delivery dates, workmanship or inspection information where available, and how defects were handled. Treat testimonials, awards and sales claims as leads to verify, not proof of performance. A good track record is useful context, but it does not prove that this project has permission to proceed or that your deposit is protected.

Verify the land, approvals and the exact home independently

Ask a local property lawyer or conveyancer to check the title or other ownership rights being sold, the seller’s authority to sell, land-use permissions, planning status and relevant restrictions. Confirm that the unit, plot, plans and specifications in the transaction correspond to approved documents. Do not rely only on a brochure, sales-office explanation, show flat or model.

The searches available and their scope depend on the place. UK government guidance for England and Wales says a legal representative can identify title or planning issues and advise on searches. Local-authority searches may reveal restrictions and certain external factors, while specialist searches may be needed for risks such as flooding or mining. A local-authority search does not necessarily tell you about development on neighboring land; ask whether a separate search or other inquiry is appropriate.

Visit the site and surrounding area if you can. Consider access, nearby uses and conditions that matter to you, and questions about future development that may not be answered by a standard search. Ask your adviser what must be checked through official records and what requires a separate inquiry.

Some rules have a limited legal scope. For example, the US Consumer Financial Protection Bureau’s 12 CFR § 1010.109 addresses title, land use, recording, title insurance and certain purchaser-payment protections for covered land sales. It is not a general escrow or disclosure rule for every US home purchase, much less for transactions in other countries. Ask how your interest is recorded and who controls your money under the rules that actually govern your transaction.

Have the contract explained before you pay

Ask an independent property lawyer or conveyancer to review the reservation form as well as the main purchase agreement before you commit funds. Sales materials and verbal assurances are not substitutes for the signed contract and approved plans. Have the adviser explain in plain language who owes each obligation and what happens if either side does not perform.

  • Reservation payment: Is it refundable, under what conditions, and by what date must you sign the main contract? UK government guidance for England and Wales notes that a reservation fee may be refundable only in specified circumstances; the actual answer depends on your documents and local law.
  • Deposit custody and protection: Which legal entity receives the deposit, where is it held, and what happens if the developer defaults or cannot transfer title? Ask whether an independent escrow holder or a local protection scheme is involved, and get the arrangement confirmed in writing. The US federal regulation cited above sets conditions for protective escrow treatment within its scope. Arizona’s Department of Real Estate checklist also tells buyers to note whether earnest money is held in escrow or in the developer’s own funds. Neither example should be assumed to govern elsewhere.
  • Installments and default: When is each payment due, what event or construction milestone triggers it, and what remedies apply if you or the seller defaults? Do not assume that payments are tied to completed work unless the contract says so and your adviser confirms the consequences.
  • Completion and delay: What is the expected handover date? Is there a long-stop date, and what can you do if it is missed? Check when you may withdraw, whether money is returned, and whether any deadlines or conditions apply. In England and Wales, government guidance describes a long-stop date as a possible contractual route to withdraw after a lengthy construction delay; it is not an automatic right in every contract or jurisdiction.
  • Changes to the home: Can the developer change plans, materials, fixtures or specifications? What is the process if a change is made, and what happens if the substitute is not acceptable? Ontario HCRA advises buyers of pre-construction homes to put expectations for the final product in the contract.
  • Ongoing costs: Identify service charges, estate facility charges, management fees and other continuing obligations, including who sets them and how they may change. England and Wales government guidance specifically cautions buyers about additional estate facility charges.

If the developer recommends a lawyer or mortgage adviser, you are not necessarily required to use that firm. England and Wales government guidance says buyers are not obliged to use referred firms and that referral fees should be disclosed. Choose advisers independently where possible, ask about referral relationships, and check the rules that apply locally.

Check the warranty and plan for defects

Ask for the warranty provider’s name, the certificate or evidence of enrollment, the start date, full policy wording, exclusions, claim procedure and deadlines. Confirm which parts of the home and any attached land are covered, who handles each type of claim, and how to report a defect. A warranty’s headline duration alone does not tell you what remedy is available.

Warranty arrangements differ. UK government guidance for England and Wales says most new-build homes in that context have a 10-year warranty for major structural problems and a 2-year period for general defects, while cautioning that coverage may not extend to the entire property or attached land. These are descriptions of common arrangements in that jurisdiction, not guaranteed terms for every home or policy. In Ontario, HCRA handles builder licensing and regulation while Tarion administers warranties; buyers should check enrollment and the applicable delay and deposit terms rather than assume one organization performs both roles.

If the contract and local process allow it, arrange an independent snagging survey after construction and before completion. A snagging inspection looks for defects or unfinished work. Record issues, send them to the developer in writing, keep the response, and agree a clear correction timetable. UK government guidance recommends considering a pre-completion snagging survey; whether the timing and process are available to you depends on the transaction and local rules.

Compare developers using the same evidence

When you have more than one genuine option, compare the same categories for each project. Use official records and contract documents where possible; mark an item “not verified” rather than treating a sales answer as established fact.

What to compare Evidence to request or verify Why it matters
Identity and oversight Legal names of seller, developer and landowner; required licence or registration; regulator findings; relevant connected companies. Shows who is accountable and whether the relevant local rules are being followed.
Delivery and quality Completed projects, verifiable handover history, public quality or inspection records, and documented defect responses. Gives more useful evidence than reputation claims alone.
Land and permissions Title or ownership rights, approved use and plans, restrictions, planning status, and searches for the exact site. Checks that the seller can convey the promised interest and that the project matches its approvals.
Money and timing Deposit holder and protections, payment milestones, completion terms, delay provisions, long-stop date and withdrawal rights. Clarifies when money is at risk and what the contract provides if the project changes or is late.
Warranty and aftercare Provider, enrollment, actual policy scope and exclusions, reporting deadlines, and defect-response process. Shows who will address covered problems and what the buyer must do to make a claim.
Total ownership obligations Service or estate charges, management arrangements and other continuing costs in the contract. Reveals obligations that are not captured by the purchase price alone.

Singapore illustrates why local frameworks must be read on their own terms: a 22 May 2026 circular from URA and the Building and Construction Authority describes construction-quality checks and developer deterrence measures, including public CONQUAS performance disclosure and enhanced checks for certain developers, with stated scope and exclusions. Do not treat that Singapore framework as a measure of developers in another market or assume it applies to every Singapore project without checking its terms.

In Singapore, URA also directs buyers to review project and unit information at the show flat and says plans, models and show units must comply with local rules. Even there, check the approved specifications and contractual description for the particular unit. Arizona’s Department of Real Estate offers a separate caution in its public-report context: “Not all of the information in this report has been verified by the Department; certain information has been accepted by the Department as true and accurate based on attestation of the subdivider and/or the subdivider’s agents.” That warning is specific to Arizona’s public-report process, but it underscores why buyers should independently verify important claims.

Use a proceed-or-pause check before committing

Before paying a non-refundable amount or signing the main agreement, make sure you can answer these questions with documents or independent confirmation:

  • Which legal entity is selling the home, and which entity is responsible for each promise?
  • Has an independent adviser checked title or ownership rights, project approvals and relevant searches for the exact property?
  • Do you understand who holds your deposit, when each payment is due, and what protection or recovery rights apply?
  • Are the completion, delay, cancellation and plan-change terms clear in the contract?
  • Have you seen the actual warranty terms, and do you know how to report and document defects?
  • Have you accounted for ongoing charges and management obligations as well as the purchase price?

If an answer is unclear, ask for the relevant document and have your independent adviser resolve the point before committing. A developer comparison is only as reliable as the evidence behind it; legal protections, regulators, search systems and warranty arrangements differ by country and sometimes by locality.
