Treat an AI agent as a preparation aid, not as the taxpayer, tax practitioner or auditor responsible for a tax position. For every material AI-assisted decision, preserve the evidence, the agent’s output and changes, and a traceable human review tied to the exact version acted on. Keep that packet alongside—not instead of—the statutory records required for the relevant tax regime.
What should an AI decision record contain?
There is no universal AI tax-log template established by the official materials discussed here. The following is a practical record design, not a quoted statutory form. Create a packet for each material tax position or filing action, and link it to the accounting entry, return, payment or other outcome.
- Scope and ownership: taxpayer or entity, tax regime, tax year or return period, issue identifier, responsible business owner, and whether the decision remained a draft or was acted on.
- Evidence: copies or stable references to relevant invoices, ledgers, contracts, reconciliations, returns, notices and other source records. Record each document’s origin, date and version, and show which evidence supports each material conclusion.
- System context: agent or application name, model and version where available, run timestamp, task or prompt version, connected tools or data sources, and material configuration changes. Record what is available; do not invent or backfill missing metadata.
- Decision history: the question asked, agent output, assumptions, cited records or tax provisions, uncertainty flags, and human edits, rejection or override. Preserve prior versions and edits instead of silently replacing an answer.
- Approval: reviewer’s name or unique user ID, role and authority, what was reviewed, decision, timestamp and any conditions. Bind the approval to the exact version reviewed.
- Outcome and retention: final journal entry, return or form version, payment or withholding action, filing acknowledgment, and the applicable retention schedule or legal hold. Keep statutory books independently of a chat transcript or vendor dashboard.
This makes it possible to trace a conclusion from source evidence, through the agent’s contribution and accountable review, to the action taken.
Which underlying tax records must remain available?
GST accounts and electronic edits
Section 35 of the Central Goods and Services Tax Act requires registered persons to keep true and correct accounts for specified matters, including inward and outward supplies, stock, input tax credit and output tax. Electronic accounts are permitted in the prescribed manner. An AI summary does not replace the invoices, books, supply records, stock information or other evidence needed for the taxpayer’s circumstances. See CGST Act section 35.

For records covered by rule 56 of the CGST Rules, incorrect entries must not be erased or overwritten; where registers and other documents are maintained electronically, “a log of every entry edited or deleted shall be maintained.” The rule also provides for electronic maintenance and digital-signature authentication of records under the chapter. Preserve the change history for the underlying electronic books, not just the AI conversation. See CGST Rules rule 56.
Income-tax electronic books
The Notified Income-tax Rules, 2026 specify, for the books and documents covered by the relevant rule, that electronic records must remain accessible in India at all times and daily backups must be kept on servers physically located in India. These requirements concern the covered tax books and documents; they do not automatically establish where every AI prompt, model log or other data object must be hosted. Check that the provision applies to the taxpayer and record set before configuring a system. See the Notified Income-tax Rules, 2026.

How long should Indian tax records be kept?
Do not apply one retention period to every Indian tax record. The cited GST and income-tax provisions use different triggers and cover different records.

Apply the relevant trigger to the correct tax period and record set, and account for any open proceeding, legal hold or other applicable retention requirement. A provider’s default chat-history setting is not a substitute for that decision.

Can an AI agent approve or certify a tax return?
An internal workflow can record that a human reviewer approved an AI-assisted draft, but that does not make the agent an accountant or turn its output into a signed report. The Income Tax Department’s Form 3CB-3CD guidance describes the applicable workflow as involving an accountant’s examination and opinion or certification, with submission using the accountant’s digital signature certificate. The manual’s described service flow includes active DSC prerequisites for the CA and taxpayer and says the CA uploads the form using their DSC. This guidance concerns that form workflow; it is not a universal approval rule for every tax decision. See the Form 3CB-3CD User Manual.
What should an auditor or reviewer be able to trace?
For any material conclusion, a reviewer should be able to follow the chain from the evidence to the action without relying on an unexplained AI answer:

- Identify the taxpayer, tax period, issue and person responsible for the decision.
- Open the source records and establish which versions the agent received.
- See the agent and task context that is available, the output produced, and any uncertainty or escalation flags.
- Compare the original output with human changes, including rejection or override, and identify who made each material change.
- Confirm who reviewed the precise version, their role, the decision and its timestamp.
- Match the approved position to the resulting accounting entry, return, payment or filing acknowledgment.
- Locate the underlying statutory records, edit history and retention or legal-hold instructions.
How should teams handle personal data in agent inputs?
Tax files and agent inputs may contain personal data. Map what is processed, who can access it, where it is stored and how long it is retained against the laws and commencement dates that apply to the particular processing. India’s DPDP Act and the Digital Personal Data Protection Rules, 2025 have phased commencement: the MeitY notification of 13 November 2025 schedules some provisions for one year and others for eighteen months after publication. As of 7 October 2026, those future dates have not all elapsed; verify the current official timeline, any corrigenda and the specific provisions in force before treating a duty as operative. The cited materials do not establish a general India-only hosting mandate for all personal data or AI records.
