How to Correct an Unreported Foreign Account on a U.S. Tax Return

An unreported foreign account can involve omitted income, a late FBAR, Form 8938 and other international returns. Follow this year-by-year process to identify each obligation and choose the appropriate IRS correction procedure.

Do not treat an unreported foreign account as a single form error. You may need to correct omitted interest or other income on an amended federal return, file a delinquent FBAR (FinCEN Form 114), add Form 8938, and possibly submit another international information return. Each obligation has different triggers and correction rules. Start by reconstructing the account and your filing history, then choose the IRS procedure that fits your residence, intent, filing history, and whether the IRS has contacted you.

What “unreported foreign account” can mean

A foreign account’s existence does not, by itself, prove that every international form was required. The answer depends on the account type, highest balance, ownership or signature authority, income, transactions, residence, and the tax year. One omission can create several separate problems:

As an Amazon Associate I earn from qualifying purchases.

Potential obligation When it can apply How it is generally corrected
Taxable income Interest, dividends, gains, or other income from the account was left off the federal return File an amended federal income tax return, report the income and pay additional tax and statutory interest
FBAR (FinCEN Form 114) The aggregate value of foreign financial accounts exceeded $10,000 at any time during the calendar year, subject to the applicable rules File electronically through FinCEN’s BSA E-Filing System; do not attach the FBAR to the income tax return
Form 8938 Specified foreign financial assets met the Form 8938 definitions and thresholds for the taxpayer’s filing circumstances Attach Form 8938 to the required income tax return, usually through an amended return when the original filing omitted it
Other international information return The ownership, entity, transfer, gift, trust, or investment facts trigger a separate reporting form Submit the applicable delinquent or amended information return under the procedure that fits the facts

Examples of other forms the IRS identifies include Forms 3520, 3520-A, 5471, 5472, 926, and 8621. An account held through a company, trust, fund, or other structure can create obligations that are not solved by filing an FBAR alone.

Step 1: Build a year-by-year inventory before filing anything

Gather every relevant U.S. return, account statement, tax document, and correspondence. Work one calendar year at a time because the FBAR uses calendar years while income tax returns use tax years.

  • Determine the highest balance or value during each year, converting foreign currency consistently and retaining the statements used.
  • Identify interest, dividends, capital gains, distributions, withholding, and fees shown on foreign statements.
  • Mark whether an FBAR, Form 8938, or another international information return was filed, and whether the filing was complete.
  • Note whether an original income tax return was filed for each year and whether the IRS, FinCEN, or another agency has contacted you, started an examination, or opened an investigation.

Do not destroy or alter account records. Keep a written explanation of how you discovered the omission and why it occurred; that explanation may matter when evaluating non-willfulness or reasonable cause.

Step 2: Correct omitted income on the federal tax return

If the account produced taxable income that was absent from a filed return, the income-tax problem is separate from any FBAR problem. Prepare an amended federal income tax return for each affected year, include the omitted income and any associated deductions or foreign tax credit allowed under the applicable rules, and pay the resulting tax and statutory interest.

Amending the return does not automatically file an FBAR, Form 8938, or another international information return. Conversely, filing an FBAR does not report income or change the tax shown on a return. Reconcile the amended return to the account statements so the amounts reported on each filing agree.

If an affected year’s original return was never filed, do not assume that a procedure designed for amended returns will accept it. The domestic streamlined procedure, for example, requires previously filed returns for each of its covered years and is not the route for filing missing original income tax returns.

Step 3: File or correct the FBAR separately

When the FBAR is required

IRS guidance describes the general FBAR trigger as an aggregate value over $10,000 in foreign financial accounts at any time during the calendar year. Add the maximum values of all reportable foreign accounts; do not test each account in isolation. Ownership, financial interest, and signature-authority rules can affect whether an account belongs in the filing.

How to file a late FBAR

  1. Use FinCEN’s BSA E-Filing System and select FinCEN Form 114 for each delinquent calendar year.
  2. Enter the account details and maximum values for that year from the records you reconstructed.
  3. Provide the requested explanation for the late filing and preserve supporting documents.
  4. Submit each year electronically and retain the confirmation.

The FBAR is not an attachment to the federal income tax return. A properly reported late FBAR may avoid a penalty when the IRS finds reasonable cause, but that outcome is fact-dependent and not guaranteed.

How to amend an FBAR that was already filed

If a previously filed FBAR contains an error or omitted account, IRS guidance says to submit a new FBAR with the corrected information and mark it as amended. Correcting an FBAR does not amend the income tax return or Form 8938.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Step 4: Determine whether Form 8938 or another information return is required

Form 8938

Form 8938 has its own definitions and filing thresholds; they are not the same as the FBAR’s $10,000 test. Review the current Form 8938 instructions for your filing status, residence, asset type, and applicable threshold. When required, attach Form 8938 to the federal income tax return. If the omission affects a filed return, include it with the amended return for that year.

The IRS states that reasonable cause for a Form 8938 failure is decided case by case. Its instructions say: “The determination of whether a failure to disclose a specified foreign financial asset on Form 8938 was due to reasonable cause and not due to willful neglect will be determined on a case-by-case basis, taking into account all pertinent facts and circumstances.” A reasonable-cause position therefore requires a factual explanation and does not automatically erase a penalty.

Other international information returns

Review whether the account was connected to a foreign trust, corporation, partnership, transfer, gift, passive investment, or other reportable arrangement. The IRS lists Forms 3520, 3520-A, 5471, 5472, 926, and 8621 among possible international information returns. The correct form depends on the underlying asset and transaction, not merely on the fact that a bank account was omitted.

Step 5: Choose the IRS correction path

The IRS currently lists three principal correction paths for prior failures involving foreign assets: the Criminal Investigation Voluntary Disclosure Practice, the Streamlined Filing Compliance Procedures, and the Delinquent International Information Return Submission Procedures. They are not interchangeable. Before sending a package, compare the following facts:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
Decision factor Why it matters
Willfulness Streamlined procedures require non-willful conduct. Possible intentional concealment or other willful conduct calls for individualized legal advice rather than an automatic streamlined filing.
Residence Domestic and foreign streamlined procedures use different residence tests and have different penalty treatment.
Filing history The domestic streamlined procedure requires previously filed returns for its three covered years; it is not a substitute for filing missing original returns.
IRS or FinCEN contact The delinquent-information-return procedure is described for taxpayers who are not under civil examination or criminal investigation and have not already been contacted about the delinquent returns.
Type of omission Income, FBAR, Form 8938, and other information returns may need different filings in the same package.
Expected exposure Estimate tax, interest, procedure-specific penalties, and possible ordinary information-return or FBAR penalties before choosing a route.

Streamlined Filing Compliance Procedures

Streamlined domestic offshore procedures

These procedures are generally for eligible U.S. residents whose failures were non-willful. The IRS describes non-willful conduct as negligence, inadvertence, mistake, or a good-faith misunderstanding of legal requirements. The package generally includes amended income tax returns for the most recent three tax years whose due dates have passed, required information returns, and delinquent FBARs for the most recent six FBAR years whose due dates have passed.

Participants must pay the additional tax, statutory interest, and a Title 26 miscellaneous offshore penalty. The domestic procedure also requires the applicable certification and other documents specified in current IRS instructions. Because the procedure is limited to eligible taxpayers with filed returns for the covered years, do not use it as a generic late-filing shortcut.

Streamlined foreign offshore procedures

Eligible taxpayers who meet the IRS non-residency test and whose conduct was non-willful generally submit delinquent or amended returns and required information returns for the most recent three due tax years, plus delinquent FBARs for the most recent six due FBAR years. They must pay tax and interest.

The IRS states that compliant eligible participants in the foreign procedure are not subject to the specified failure-to-file, failure-to-pay, accuracy-related, information-return, or FBAR penalties under the procedure. Eligibility depends on satisfying the residence and other requirements; living abroad for part of a year is not, by itself, a determination that the test is met.

Criminal Investigation Voluntary Disclosure Practice

The IRS lists its Voluntary Disclosure Practice as an option for undisclosed foreign assets. It is distinct from streamlined filing and does not have the same eligibility rules or consequences. If the facts could involve willfulness, concealment, false statements, or significant criminal exposure, obtain advice from a qualified tax attorney before making disclosures. Do not submit a streamlined certification that you cannot truthfully sign.

Delinquent International Information Return Submission Procedures

This route is aimed at taxpayers who are not under civil examination or criminal investigation and have not already been contacted about the delinquent returns. The IRS says most delinquent international information returns, other than Forms 3520 and 3520-A, should be attached to an amended income tax return.

Penalties may be assessed. You may attach a reasonable-cause statement explaining the facts, the steps taken to become compliant, and why the failure was not willful neglect. For many forms, the IRS may assess a penalty before considering the statement, so be prepared to answer the resulting correspondence with documentation.

How penalties, tax, and interest can differ

Domestic streamlined offshore penalty

The domestic streamlined procedure includes a 5% miscellaneous offshore penalty calculated under a defined method. The IRS FAQ describes valuing certain accounts and assets at year-end for each of the three covered tax years and using the highest aggregate amount, with exclusions for years in which relevant accounts or assets were compliant. It is not simply 5% of every foreign account or 5% of every balance ever held. Use the current Form 14654 instructions and IRS FAQ to identify the assets in the base and perform the calculation.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Foreign streamlined treatment

The eligible foreign procedure does not impose the Title 26 miscellaneous offshore penalty, but tax and statutory interest remain due. Ordinary penalties can still matter outside the protection described for compliant participants in that procedure.

FBAR and information-return penalties

FBAR penalties and reasonable-cause treatment depend on the year, violation, conduct, and applicable law. Avoid relying on a penalty ceiling quoted without those qualifications. Delinquent information returns can also draw penalties, and a reasonable-cause statement is not an automatic waiver.

What changes if the IRS has already contacted you?

Contact from the IRS, FinCEN, or another agency can change the available route. The delinquent international information-return procedure is described for taxpayers who have not been contacted about the delinquent returns and are not under civil examination or criminal investigation. An examination or investigation can also affect whether a streamlined certification is available.

Read the notice carefully, preserve the response deadline, and obtain individualized advice before filing a package that makes factual or willfulness certifications. Do not ignore a notice while assembling records; request an extension through the channel identified in the correspondence when appropriate.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Correcting a prior streamlined submission

If a previous streamlined submission itself contained an error, the IRS foreign streamlined FAQ says a taxpayer may correct it with amended returns and/or an amended certification when the prior filings are not under examination. Explain the facts and circumstances, identify every affected year and form, and follow the current IRS labeling and submission instructions.

Common mistakes that make the problem worse

  • Filing only an FBAR: This does not report omitted interest or satisfy Form 8938 or another information return.
  • Attaching the FBAR to the tax return: The FBAR is filed electronically with FinCEN, separately from the federal return.
  • Assuming the $10,000 test controls Form 8938: Form 8938 has different definitions and thresholds.
  • Using the domestic streamlined procedure for missing original returns: Its covered-year filing requirement must be met.
  • Calling an intentional omission “non-willful” without analysis: The streamlined certification must be accurate and supportable.
  • Using one year’s records for every year: FBAR reporting is calendar-year specific, and account balances and income can change.
  • Ignoring non-bank assets or structures: A foreign trust, company, fund, transfer, or passive investment may trigger another form.
  • Relying on a generic reasonable-cause paragraph: The IRS evaluates the particular facts, documentation, and actions taken to correct the failure.

When professional advice is warranted

The IRS encourages professional tax or legal advice because eligibility and liability vary. Consult a cross-border tax professional or tax attorney before filing when any of these apply:

  • You are unsure whether the conduct was non-willful.
  • You had unreported cash transfers, nominee arrangements, false answers, or instructions to keep the account hidden.
  • The account belongs to or is connected with a company, trust, partnership, foundation, or passive foreign investment.
  • You never filed one or more original tax returns for the years involved.
  • The IRS or FinCEN has sent a notice, opened an examination, or begun an investigation.
  • You previously used a disclosure procedure and now believe the submission was incomplete or inaccurate.

A professional cannot guarantee penalty relief, but can map each asset and year to the required forms, test eligibility, calculate the domestic streamlined base when relevant, and coordinate amended returns with separate FinCEN filings.

A filing checklist

  1. Collect account statements, tax documents, prior returns, and all government correspondence.
  2. Create a calendar-year FBAR schedule and a tax-year income schedule.
  3. Calculate omitted interest, dividends, gains, and other taxable amounts.
  4. Identify whether Form 8938 or another international information return applies.
  5. Confirm whether every covered original income tax return was filed.
  6. Check for IRS, FinCEN, or examination contact before selecting a procedure.
  7. Evaluate willfulness, residence, and the domestic-versus-foreign streamlined requirements.
  8. Prepare amended returns and information returns with consistent numbers and explanations.
  9. File delinquent or amended FBARs electronically through FinCEN’s BSA E-Filing System.
  10. Pay tax, interest, and any procedure-specific amount, and retain proof of filing and payment.
  11. Monitor notices and respond by the stated deadline.

The key is coordination: an amended tax return addresses income and, when required, Form 8938; a separate FinCEN filing addresses the FBAR; and another IRS information return may be needed for the underlying ownership or transaction.
