How to Correct an Indian GST Invoice Issued With the Wrong Tax Rate

For an Indian GST invoice with the wrong tax rate, verify the correct treatment, then use a credit note for excess tax or a debit note for an undercharge and amend reported details when needed.

If an Indian GST invoice shows the wrong tax rate, first verify the rate that applies to the supply, then correct the document according to whether it charged too much or too little tax. Under section 34 of the CGST Act, excess tax may be corrected with a credit note; an undercharge requires a debit note, which includes a supplementary invoice. If the invoice was already reported, the supplier may also need to amend its GSTR-1 record.

1. Verify the correct GST rate before changing the invoice

Do not assume the rate on the original invoice was correct simply because it was used previously. Establish the supply’s classification and relevant facts, check the applicable current rate notification, and determine whether the supply is intra-state or inter-state so the tax treatment is correct. The correction document should reflect the tax actually payable, not just reproduce the original invoice’s assumptions.

The general correction rules do not decide the correct rate for a particular supply. If classification or place of supply is uncertain, resolve that question before calculating the difference.

2. Choose the correction based on whether tax was overcharged or undercharged

The Central Goods and Services Tax Act, 2017 uses mandatory wording for an undercharge: “the registered person, who has supplied such goods or services or both, shall issue to the recipient a debit note containing such particulars as may be prescribed.” By contrast, for excess tax, section 34(1) says the supplier “may issue to the recipient a credit note containing such particulars as may be prescribed.” See the CBIC-published CGST Act, section 34.

3. Prepare a note that identifies the original invoice

Use the currently applicable prescribed format and include the required particulars. CBIC’s invoice rules specify information including:

  • Supplier name, address and GSTIN.
  • The nature of the document, its consecutive serial number and issue date.
  • Recipient details.
  • The serial number and date of the corresponding invoice or invoices.
  • Taxable value, tax rate and tax amount.
  • Supplier signature or digital signature.

Refer to the CBIC rules on tax invoices, credit notes and debit notes and confirm the rules and format applicable when you issue the correction. The reference to the original invoice is important: the correction should be traceable to the transaction it changes.

4. Correct the return record if the invoice was already reported

A correction document and a return amendment address different records. If the invoice has already been included in GSTR-1, review the relevant return-period workflow and amend the invoice details where appropriate. GSTN’s additional IMS FAQ, dated 17 October 2024, advises amending an incorrect invoice in GSTR-1 rather than issuing an unlinked credit note for that incorrect invoice: an unlinked note does not tell the portal whether the recipient accepted or rejected the original invoice. Check the live portal instructions for the relevant period.

The GST portal’s GSTR-1 manual describes outward-supply reporting and amendments. Its IFF manual notes that changing an invoice’s rate or tax amount may result in differential tax liability. Follow the workflow applicable to the return period rather than assuming that a note alone updates the reported invoice.

5. Check deadlines and tax-adjustment limits

Section 34(2) sets a deadline for reporting credit notes: no later than September following the end of the financial year of the supply, or the date the relevant annual return is filed, whichever is earlier. It also restricts reducing the supplier’s output tax liability where the incidence of tax and interest has been passed on to another person. These conditions can affect whether a credit note produces a tax adjustment.

For debit notes, section 34(4) requires the supplier to include their details in the return for the month in which the debit note is issued. Because applicable rules and portal procedures can change, verify the provisions and filing instructions for the specific period before acting. The statutory text is in section 34 of the CGST Act published by CBIC.

Correction checklist

  1. Confirm the supply classification, place of supply, current rate notification and correct tax treatment.
  2. Compare tax charged on the original invoice with tax payable, and calculate the difference.
  3. For excess tax, assess a section 34(1) credit note; for an undercharge, issue the section 34(3) debit note, including a supplementary invoice if applicable.
  4. Include the prescribed particulars and link the note to the original invoice.
  5. If the invoice was reported, check whether its GSTR-1 record must be amended under the applicable portal workflow.
  6. Check the credit-note reporting deadline, passed-on-tax restriction, debit-note return period and current filing instructions before submitting returns.

This is general compliance information for Indian GST, not a determination of the rate for a particular supply or advice on a specific filing. Where the rate classification is uncertain, a return has already been filed, or a credit-note adjustment may be restricted, consult a qualified GST practitioner.
