First identify the assessment year (AY), then check whether you already filed a return and whether it was verified. If you have not filed, you may need a belated return; if you filed but made an error, a revised or updated return may be relevant. The routes have different deadlines and consequences. For AY 2026–27, the Income Tax Department says a belated return may be filed by 31 December 2026 or before assessment is completed, whichever comes first. That deadline is specific to AY 2026–27 and should not be reused for another year.
The key is to match the problem to the route before submitting anything: a first filing after the due date, an error in a return already filed, and a late refund or loss claim are different situations. A late filing can also involve a fee or interest, and an uploaded return may not be complete until it is verified.

Start with the assessment year and your return status
In India, the assessment year is the period in which income from the preceding financial year is assessed. For example, income earned in FY 2025–26 is reported for AY 2026–27. Use the AY shown for the income you need to report, rather than assuming that a deadline for the current filing season applies to an older or newer year.

- No return filed, and the permitted late-filing window is open: consider a belated return.
- A return was filed, but it contains an omission or incorrect statement: check whether a revised return is still permitted; if not, assess whether an updated return is available and suitable.
- The ordinary filing and correction windows have passed, and you need to pursue a refund or carry forward a loss: a condonation request may be relevant in qualifying hardship cases.
- A return was uploaded but not verified: check its verification status and act promptly. Uploading alone may not complete filing.
These are not interchangeable ways to submit the same return. In particular, an updated return is restricted and cannot be used to increase a refund or reduce tax liability.
A useful way to frame the problem is to ask four questions in order: Which AY does the income belong to? Is there already a return for that AY? Has that return been verified? What are you trying to achieve—file for the first time, correct reported information, pay tax on an additional disclosure, or seek a late refund or loss carry-forward? Answering those questions first can prevent a second filing that does not correct the original one, or an application that cannot produce the outcome you want.
Which route fits your situation?
| Route | When it may fit | Important limit |
|---|---|---|
| Belated return | You are filing the original return after its due date and the statutory late-filing window remains open. | The deadline depends on the AY and can be earlier if assessment is completed. |
| Revised return | You already filed a return and need to correct an omission or wrong statement. | Availability depends on that year’s deadline and assessment status. |
| Updated return (ITR-U) | You may be eligible to make an additional or corrected disclosure, including in some cases where no earlier return was filed. | It cannot create an enhanced loss, reduce tax liability, or increase a refund; additional tax is payable. Eligibility and the applicable time window must be checked for the specific year. |
| Condonation request | You missed the ordinary window for a qualifying refund or loss carry-forward claim and genuine hardship applies. | Approval is required under the process described by the Department under section 119(2)(b); relief is not automatic. |
The practical comparison is not simply which route sounds easiest. A belated return is a late first filing; a revised return starts from an existing filing and corrects it; an updated return is a restricted route for eligible additional or corrected reporting and involves additional tax; condonation asks for approval to pursue certain delayed refund or loss claims. The right answer depends on the return’s status, the result you need, the AY-specific time window and the effect the route is allowed to have on tax, refunds, or losses.

The Department also describes a new framework for later tax years and proposed changes to some deadlines. Treat any date or statutory provision as year-specific, and verify the rules applicable to your AY on the official portal.
This transition makes checking the AY especially important. Do not infer the rule for a later or earlier year from the AY 2026–27 example, and do not carry a section reference or deadline across years without checking. The Income Tax Department’s FAQ accessed in 2026 expressly places AY 2026–27 under the 1961 Act; it does not make the same blanket statement about every other AY.
How to file a belated return
A belated return is the route for filing an original return after the due date, while the law still permits it. The Income Tax Department states that for AY 2026–27, a belated return may be furnished on or before 31 December 2026, or before completion of assessment, whichever is earlier. This is not a general deadline for every AY.
- Confirm the AY. Match the return to the financial year in which the income was earned. Check that year’s deadline and applicable filing rules on the official Income Tax Department portal.
- Check for an existing return. If you already filed for that AY, do not treat a second original filing as a correction. Check whether the first return was filed and verified, then use the route that applies to an existing return.
- Prepare the return using complete and accurate information. Include the income and other details required for your circumstances. If your case involves foreign income or assets, business income, a tax notice, or material uncertainty, seek qualified tax advice rather than guessing how to report it.
- Check the tax and late-filing fee shown for your case. For AY 2026–27 under the 1961 Act, the Department FAQ states a section 234F fee of ₹1,000 where total income does not exceed ₹5 lakh and ₹5,000 in other cases. Interest may also apply when tax is payable. These figures are specific to that AY and do not by themselves establish your total liability.
- Submit the return and complete e-verification. Follow the portal’s current filing and verification prompts. Keep the acknowledgement and check the return status afterward so you know whether the filing is complete.
The Department’s quoted AY 2026–27 deadline is “31st December 2026, or prior to the completion of the assessment, whichever occurs earlier.” Because completion of assessment can make the practical window shorter, do not wait until the calendar date if your return is still outstanding.

After confirming the applicable window, keep the task focused: establish the correct AY, make sure you are not duplicating a return, prepare the filing with accurate details, review the fee and any tax payable, submit it, and verify it. Save the acknowledgement and check the portal status rather than assuming the process ended when the return was uploaded. If the portal indicates that assessment is complete, or you cannot tell whether the late-filing window remains open, confirm the position before proceeding.
For AY 2026–27, the fee stated by the Department is based on whether total income exceeds ₹5 lakh, not a universal fixed amount for all late filers. A fee is separate from interest that may apply if tax is payable. The final amount therefore depends on the person’s facts and year-specific rules; the fee figures do not mean that a filer with tax due will owe only ₹1,000 or ₹5,000.
If you filed but need to correct the return
Check whether a revised return is still available
A revised return is generally the relevant route when you have already filed and need to correct an omission or wrong statement. Its deadline and availability depend on the AY and assessment status. Confirm both before preparing a correction; the belated-return deadline is not automatically the deadline for revising an already-filed return.
Use the return status and the information in your filed return to identify what needs correction. If the correction involves omitted income, do not assume that a revised return is still allowed simply because you have discovered the error recently. Check the current year-specific rules on the Department portal.

Start by comparing the filed return with the information you now know needs correction. Identify whether the problem is an omission or an incorrect statement, and confirm that the return is actually on record and verified. Then check the revision deadline for the relevant AY and whether assessment status affects availability. If the revision period has ended, do not simply try to submit a second original return; assess whether an updated return is eligible for the facts and whether its restrictions allow the result you seek.
Consider an updated return only if its restrictions fit
ITR-U may be available in certain cases, including some situations where an earlier return was not filed. It is not a general substitute for a belated or revised return. The Department says an updated return cannot result in an enhanced loss, a reduction in tax liability, or an increase in refund, and that additional tax is payable. Confirm the applicable law, time window, and eligibility for the relevant year before choosing this route.
That restriction matters especially if your purpose is to claim or enlarge a refund, reduce an amount due, or report a loss that you want to carry forward. Do not file an ITR-U on the assumption that it can secure those outcomes.

Think of ITR-U as a possibility to check, not a fallback that is automatically available once another deadline has passed. The permitted time window and eligibility must be checked under the law for the specific year. Even where the route may be available, its permitted effect matters: it cannot be used to produce a higher refund, lower tax liability, or enhanced loss, and additional tax is payable. If one of those barred results is the reason you want to file, this route may not solve the problem.
Do these 3 things before closing this tab:
1Clear out junk files and repair common Windows errors2Scan for outdated or missing drivers - takes under a minute3Repair Windows errors before they cause bigger problemsWhere the facts involve omitted income, additional tax exposure, or an existing notice, avoid selecting a route solely by its name. Confirm how the rules apply to the particular AY and return status, and consider qualified professional advice if the choice is uncertain or the amount is substantial.
If you missed the window for a refund or loss claim
For certain delayed refund or carry-forward-of-loss claims, the Department describes a condonation request under section 119(2)(b) where genuine hardship applies. This is a request for relief, not an automatic extension or a guaranteed refund. Approval is required.
Check the Department’s current instructions for the relevant year and the type of claim before applying. Explain the circumstances and follow the prescribed process; do not assume that submitting a request alone means the delayed claim has been accepted. If the amount is significant or the facts are complex, get help from a qualified tax professional.
Condonation is distinct from filing a belated return or correcting an existing return: it concerns specified delayed refund or loss carry-forward claims after the ordinary window has passed. The Department’s description ties the request to genuine hardship and approval. It should therefore be approached as a case-specific request, not as a way to restore every expired filing option. Check that the kind of claim you have is within the described process before relying on it.
Be clear about the outcome you are seeking. A late refund claim and a loss carry-forward claim are the situations identified for this route; the fact that a deadline was missed by itself does not establish eligibility. The Department’s current instructions for the AY and claim type should guide the request, and approval cannot be assumed in advance.
Do not overlook e-verification
After uploading a return, verify that the portal records it as verified. The Department says that if a return is uploaded by its due date but verified more than 30 days later, the verification date is treated as the return-furnishing date and late-filing consequences may follow. The 30-day point is the interval cited in the Department’s ITR-V FAQ; check the applicable instructions for your AY and verify promptly.

- Use the portal status to confirm whether verification is complete, rather than relying only on the fact that you uploaded a return.
- If the return still shows as unverified, follow the portal’s available verification instructions and retain the resulting acknowledgement.
- If the status is unclear or the applicable time limit may have passed, check the Department’s guidance or ask a tax professional how to proceed for that year.
The 30-day point is important because an upload date and the date treated as the filing date can differ when verification is late. The Department’s ITR-V FAQ says that when a return is uploaded by the due date but verified more than 30 days later, the verification date is treated as the date the return is furnished. Late-filing consequences may then follow. Do not assume that uploading on time protects you if verification was delayed.
Make verification a final filing check: look for the portal’s verified status, keep the acknowledgement, and revisit the status if it has not updated as expected. If the return remains unverified, use the portal’s current instructions promptly. The interval and consequences should be checked for the relevant AY, so do not treat the FAQ’s 30-day point as a substitute for checking the applicable instructions.

What late filing can cost
For AY 2026–27 under the Income-tax Act, 1961, the Department FAQ gives these section 234F delayed-filing fees:
| Total income | Delayed-filing fee for AY 2026–27 |
|---|---|
| Does not exceed ₹5 lakh | ₹1,000 |
| Exceeds ₹5 lakh | ₹5,000 |
The fee is not necessarily the full amount payable. Interest may also apply if tax is due, and the actual liability depends on your facts and the rules for that AY. Confirm the amount calculated for your return rather than assuming that every late filer owes the same total. Do not apply these AY 2026–27 figures to a different year without checking its rules.
Use the table as a year-specific guide to the fee described in the Income Tax Department’s FAQ accessed in 2026, not as a calculation of your full tax bill. Whether interest applies depends on whether tax is payable; the amount due is individual. A person whose total income falls in one band should not infer that the fee is the only payment required, and a person filing for a different AY should not carry these amounts forward without checking that year’s rules.
Common mistakes to avoid
- Using a deadline from the wrong year: identify the AY first. A deadline stated for AY 2026–27 is not a general filing deadline.
- Filing a second original return to correct an earlier one: check the existing return’s status and the rules for a revised or updated return.
- Assuming ITR-U can recover a refund or reduce tax: the Department’s stated restrictions rule out an increased refund or reduced tax liability through this route.
- Stopping after upload: check that e-verification is complete and confirm the portal status.
- Treating a condonation application as approval: a request for delayed refund or loss relief is subject to approval.
- Ignoring notices or complex income: notices, foreign income or assets, business income, or substantial tax exposure can require fact-specific advice. Consult the Department portal or a qualified tax professional.
Another avoidable mistake is choosing a route based on the word “late” alone. A person with no return on record may need a belated return if the statutory window is open; a person with an existing return needs to examine revision or ITR-U rules; a person pursuing a qualifying refund or loss claim after the ordinary window may need to consider condonation. The return’s status and the intended result matter as much as the date.

Frequently Asked Questions
I missed the ITR filing deadline. Can I still file?
Possibly. First identify the assessment year and check whether its statutory belated-filing window is still open. For AY 2026–27, the Income Tax Department says a belated return may be filed by 31 December 2026 or before assessment is completed, whichever is earlier. That date does not apply automatically to other years.
What should I do if I already filed but found an error?
Check the filed return’s status and whether a revised return remains available for that AY. A belated return is for an original filing after the due date, not a way to correct an existing return. If revision is no longer available, check whether ITR-U is eligible and whether its restrictions fit your situation.
Can I use ITR-U to get a refund or lower my tax?
The Income Tax Department says an updated return cannot result in an increased refund, reduced tax liability, or enhanced loss. Additional tax is payable. Check the year-specific eligibility and time window before considering ITR-U; it is not a general replacement for a belated or revised return.
What if I missed the deadline to claim a refund or carry forward a loss?
For certain delayed refund or loss carry-forward claims, the Department describes a condonation request under section 119(2)(b) where genuine hardship applies. Approval is required, so submitting a request does not guarantee relief. Check the current instructions for the AY and claim type.
Does uploading my return mean it is filed?
Not necessarily. Check that the portal shows the return as e-verified. The Department says that if a return is uploaded by its due date but verified more than 30 days later, the verification date is treated as the furnishing date and late-filing consequences may follow. Verify promptly and check the applicable instructions for your AY.
How much is the late-filing fee for AY 2026–27?
Under the Income-tax Act, 1961, the Department FAQ states a section 234F fee of ₹1,000 where total income does not exceed ₹5 lakh and ₹5,000 in other cases. Interest may also apply if tax is payable, so the fee is not necessarily the full amount due. These figures are specific to AY 2026–27.
Does the AY 2026–27 deadline apply to every tax year?
No. The Department’s 2026 FAQ says AY 2026–27, for income earned in FY 2025–26, remains governed by the Income-tax Act, 1961, and gives a specific belated-return date for that AY. Check the official portal for the rules and deadline for any other year.
The Bottom Line
Identify the AY and check whether the return already exists and has been verified before choosing a remedy. Use a belated return for an eligible late first filing, a revised return to correct an existing filing when permitted, ITR-U only if its restrictions fit, and condonation for qualifying delayed refund or loss claims that require approval. For AY 2026–27, the Department’s stated belated-return deadline is 31 December 2026 or completion of assessment, whichever comes first; verify promptly and confirm the year-specific rules on the official portal.
