How to Compare U.S. and Non-U.S. Cloud Providers for Compliance and Data Residency

A provider’s nationality and a cloud region do not decide compliance. This practical guide shows how to map data flows, verify EU–U.S. transfer mechanisms, assess jurisdiction and government access, review contracts and score providers for a specific workload.

The right comparison is not “U.S. versus non-U.S.” It is whether a specific provider, service, contracting entity and operating model satisfy the laws governing your organization and data. Start with applicable law and transfer mechanisms, then trace every data flow, verify residency and access controls, and read the service-specific contract. A European storage region, a local corporate headquarters or a compliance badge can each be useful evidence, but none is a complete compliance conclusion.

What you are actually comparing

Cloud nationality is a shorthand, not a legal test. A U.S.-incorporated provider may offer European regions, customer-managed encryption keys and contractual transfer safeguards. A provider incorporated in Europe may use U.S. subprocessors, support personnel or control-plane services. The relevant facts are the laws that apply to your processing, the entities that control the service, the places data moves, and the technical and contractual limits on access.

As an Amazon Associate I earn from qualifying purchases.

Compliance is also shared. The provider operates infrastructure and supplies controls, reports and contract commitments; the customer determines purposes, configures the service, selects regions, manages identities and keys, and documents its legal basis and risk assessment. Google Cloud states that a provider cannot formally certify a customer’s compliance. AWS similarly tells customers to evaluate the laws and practices relevant to their own use, purposes and data categories.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

There is no generally comparable statistic showing that U.S. providers, as a class, have better or worse residency, compliance or government-access outcomes than non-U.S. providers. Make a service-level decision from current evidence rather than a country label.

1. Identify the governing law before looking at regions

List the rules that apply to your organization, the people represented in the data, the industry and the activity. Depending on the workload, these can include privacy, cybersecurity, financial-record, health, public-sector, procurement, records-retention and national-residency requirements. The applicable law may differ for an employee database, payment records, a public website and an internal analytics log.

Build a legal-scope statement

  • Organization: Identify the legal entity acting as controller, processor, business, public authority or equivalent, and the countries in which it operates.
  • People and data: Record whose personal data is involved, whether it includes sensitive, financial, health, children’s or confidential business information, and how long it must be retained.
  • Purpose: Describe the exact use, such as hosting an application, processing payments, backup, customer support or machine-learning analysis.
  • Regulators and rules: Name the responsible regulator and any sector or public-sector requirements. Do not assume that a general privacy law answers a sector-specific residency rule.
  • Roles: Decide which party is controller, processor, subprocessor or an independent recipient for each flow.

Have privacy counsel or the responsible compliance officer confirm this scope before comparing vendors. A region selector cannot cure a prohibited purpose, inadequate notice, missing processor terms or an unlawful onward transfer.

2. Map the complete data flow, not just the primary database

Ask the provider to document where each category of data is stored, processed, copied, logged, backed up and accessed. Draw a flow for production content and separate flows for metadata and operations. Include:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • Primary storage and compute in the selected region.
  • Replicas, disaster-recovery copies and backups.
  • Control-plane records, identity data, billing records, telemetry and diagnostic logs.
  • Customer-support tools, remote administration and emergency access.
  • Security monitoring, abuse prevention and service-improvement processing.
  • Every subprocessor and the countries in which it operates.
  • Data exported to your own offices, contractors, analytics systems or regulators.

Require the provider to identify service-specific exceptions in writing. AWS says customers can select European Regions and that customer data stays in the selected Region, while also disclosing that a small number of services involve transfers, including transfers needed for service improvement or essential service functions. Treat that as a provider statement to verify against the exact product, configuration, contract and current subprocessor list—not as a blanket promise for every AWS service.

Questions that expose hidden transfers

  • Does the service send content or metadata outside the selected geography for support, abuse investigation, billing or reliability?
  • Are global identity, key-management or monitoring services outside the data region?
  • Can support staff view plaintext, and from which countries can they connect?
  • Where are backups restored after a regional outage?
  • Can a subprocessor change without prior notice, and what objection or termination right do you have?

3. Compare transfer mechanisms for the specific route

Once a flow leaves the European Economic Area (EEA), identify the legal mechanism covering that exact exporter, importer, data and service. The European Commission lists adequacy decisions, standard contractual clauses (SCCs), binding corporate rules, approved certification mechanisms, codes of conduct and limited derogations among the available tools.

Mechanism What it does What the buyer must verify
Adequacy decision Recognizes that a destination or covered framework provides an adequate level of protection for the specified scope. Whether the decision is current, covers the destination and applies to the receiving entity and activity.
Standard contractual clauses Impose contractual obligations on exporter and importer for defined transfer modules. The correct module, parties, onward transfers, technical measures, supplementary safeguards and completed annexes.
Binding corporate rules Provide an approved framework for qualifying intra-group transfers. Whether the provider’s relevant entity and your route are inside the approved rules.
Certification or code of conduct Can provide a recognized transfer framework when the recipient and processing fall within its scope. Current certification, scope, enforceability and how onward transfers are handled.
Derogation Permits narrow, exceptional transfers in circumstances defined by law. That the situation is genuinely occasional and meets the applicable conditions; it is not a routine cloud architecture.

The EU–U.S. example

The Commission’s current adequacy list includes the United States for commercial organizations participating in the EU–U.S. Data Privacy Framework (DPF). The Commission adopted that adequacy decision on July 10, 2023 and says personal data can flow freely from the EU to participating U.S. companies under the framework. A joint Commission and U.S. Department of Commerce statement reported more than 2,800 participating enterprises by July 2024, with 70% identified as small and medium-sized businesses. That dated enrollment figure is not a current count and does not establish that any particular cloud workload is compliant.

Check that the provider’s contracting entity and the relevant activity are actually within the DPF’s scope. The DPF does not remove other GDPR obligations: you still need a lawful purpose, transparency, purpose limitation, security, processor terms, retention controls and a review of onward transfers. The Commission periodically reviews adequacy decisions; confirm the status at procurement and after material legal changes. Its first periodic review report was published on October 9, 2024.

Google’s transfer terms state that Google LLC certified to the EU–U.S. DPF for EU/EEA transfers to and onward from the United States as of September 1, 2023. The same terms describe different positions for United Kingdom and Swiss personal data and for other transfer situations, so do not generalize the statement across jurisdictions or products. AWS describes SCCs and transfer assessments for relevant transfers and says the precise assessment depends on how the customer uses AWS.

4. Separate physical residency from provider jurisdiction

Storage location answers where bytes are held; it does not by itself answer which laws can reach the provider, who can administer the service or where support and metadata operations occur. Record these as separate comparison fields:

Question Evidence to request
Where is content physically stored and processed? Service-region documentation, replication map, backup policy and contractual region commitment.
Which entity contracts with you? Signed order form, terms, data-processing agreement and the entity’s incorporation and operating locations.
Who has custody or legal control? Corporate structure, service operator, subprocessor arrangements and government-request process.
Where can personnel access the service? Support locations, privileged-access workflow, approval rules, session recording and access logs.
Which systems remain global? Identity, control plane, billing, telemetry, security, key management and incident-response documentation.

When a provider advertises “data residency,” ask whether the commitment covers customer content only or also metadata, backups, logs, support and keys. Ask what happens during disaster recovery and whether a feature, upgrade or support case can move data outside the selected geography.

5. Assess government-access exposure without overstating it

The EDPB–EDPS joint assessment of the U.S. CLOUD Act explains that certain U.S. law-enforcement requests can reach provider-held records within the provider’s possession, custody or control, regardless of where those records are stored. The assessment also describes procedures to quash or modify some warrants under limited conditions. It characterizes the Act as involving targeted requests and procedural safeguards, not authorization for systematic, large-scale or indiscriminate collection.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

That 2019 assessment is an initial analysis, not a current legal opinion on every provider structure or later development. It also identifies unresolved questions about the meaning of “control” and some cross-border applications. Use it to frame diligence questions, not to claim that a U.S. provider automatically can read every European file.

Controls to compare

  • Legal control: Which entity receives a request and which entity can technically produce data?
  • Notice: Does the contract require notice before disclosure where legally permitted?
  • Challenge: Will the provider challenge an overbroad request when it has appropriate grounds?
  • Minimization: Can the provider disclose only the records identified in a valid request?
  • Encryption: Can you use customer-controlled keys, split-key designs or an external key manager so provider personnel cannot decrypt content by default?
  • Logging: Are administrative and key-use events recorded and available for your investigation?
  • Reporting: What aggregate government-request information and incident notifications can the provider share?

A locally incorporated provider is not automatically immune from foreign law, and a local region is not automatically shielded from the provider’s corporate control. Verify ownership, subprocessors, technical operations and the exact service scope.

6. Examine sovereignty and isolation claims precisely

“Sovereign cloud” can refer to different combinations of governance independence, local operations, data residency and technical isolation. Ask the provider to define each term and identify exclusions. An isolated environment may limit foreign operational access, but it can also have a narrower service catalog, separate identity systems, different support arrangements or migration constraints.

AWS’s European Sovereign Cloud material describes sovereignty across governance independence, operational control, data residency and technical isolation while expressly retaining customer responsibility. Its wording is direct: “AWS European Sovereign Cloud customers remain responsible for complying with applicable compliance laws, regulations and privacy programs in their jurisdictions.” Treat that statement as a reminder that infrastructure controls do not transfer your legal duties.

Isolation checklist

  • Is the environment operated by a separately governed entity?
  • Are support personnel and administrators restricted to a defined jurisdiction?
  • Are control-plane services, backups, telemetry and keys inside the boundary?
  • Can the environment exchange data with the provider’s global platform?
  • Which products, regions, APIs and third-party integrations are unavailable?
  • What happens if the provider needs emergency access or a disaster-recovery failover?

7. Read the contract and evidence package line by line

Do not rely on a marketing page or a certificate logo. Obtain the current documents that govern the purchased service and retain the version used in your assessment.

Document or term Specific point to compare
Contracting entity and order form Legal counterparty, service SKU, region, renewal, governing law and precedence among documents.
Data-processing agreement Controller/processor roles, instructions, confidentiality, deletion, assistance and audit rights.
Transfer clauses Applicable SCC module or other mechanism, supplementary measures, onward transfers and change process.
Service and region terms Residency promise, exceptions, backups, support, metadata, control plane and disaster recovery.
Subprocessor list Names, functions, countries, notice period, objection right and liability allocation.
Security schedule Encryption, key custody, privileged access, vulnerability management, logging and testing.
Audit reports and certifications Report period, system boundary, exact service and region, exceptions and complementary customer controls.
Incident and government-request terms Notification timing, cooperation, challenge commitments, disclosure limits and communication channels.
Portability and exit Export format, egress charges, assistance, deletion verification, transition period and termination effects.

Ask for independent audit reports that cover the exact service and region, not merely the provider’s corporate program. A report describes controls tested during a defined period; it does not certify your configuration or future operation. Record exceptions, complementary customer controls and the date on which the report stops being current.

8. Follow a repeatable comparison workflow

  1. Classify the workload. List data categories, sensitivity, retention, users, processing purposes and recovery requirements.
  2. Write the legal-scope statement. Identify jurisdictions, regulators, roles and transfer restrictions before reviewing vendor claims.
  3. Draw every data flow. Include content, metadata, backups, logs, support, control plane, subprocessors and your own outbound connections.
  4. Identify each transfer mechanism. For every route, record adequacy, SCCs, binding rules, certification or another lawful tool, plus any supplementary safeguards.
  5. Verify the service boundary. Match region promises, exclusions, support locations, keys, identity and disaster recovery to the exact SKU and configuration.
  6. Assess access and jurisdiction. Review corporate control, government-request procedures, notice and challenge rights, encryption and privileged-access evidence.
  7. Collect assurance evidence. Obtain current contracts, subprocessor lists, audit reports, certifications, penetration-test summaries where available and customer-control matrices.
  8. Score residual risk. Document gaps, compensating controls, accountable owners, deadlines and the risk acceptance authority.
  9. Test exit and change management. Confirm export, deletion, migration assistance, region changes, subprocessor notices and the process for reassessing a material service change.
  10. Recheck before signing and during use. Refresh adequacy status, provider terms, service-region details, subprocessors, reports and relevant local law at purchase, renewal and major architecture changes.

9. Compare providers with a decision matrix

Use a weighted matrix only after the evidence is normalized. A provider should not receive a high score for a control that applies to a different service or region.

Criterion Evidence-based question Suggested decision rule
Legal fit Does the proposed use satisfy the laws and sector rules identified for this workload? Reject if a mandatory requirement cannot be met or documented.
Transfer fit Is every cross-border route covered by a current mechanism and supplementary safeguards where needed? Require a documented route for each exporter, importer and service.
Residency precision Do contractual commitments cover content, metadata, backups, support and keys as required? Score only the covered elements; mark exclusions explicitly.
Jurisdiction and access Are control, notice, challenge, encryption and privileged-access arrangements acceptable? Escalate unresolved legal-control or plaintext-access risks to counsel and security leadership.
Assurance Do current reports cover the purchased service, region and relevant controls? Discount generic badges and expired or out-of-scope reports.
Operations Can the provider meet availability, support, latency, resilience and recovery needs? Use service-level evidence and a tested architecture, not a brand reputation.
Exit Can you retrieve, delete and migrate the data within the required time and cost? Do not approve a service whose exit plan is theoretical or technically untested.

Record “not established” when a provider will not state a comparable fact. That is more useful than treating an unverified claim as a favorable score.

“A non-U.S. company eliminates U.S. legal exposure.”

Why it fails: Ownership, subprocessors, personnel, infrastructure and legal control can cross borders.

Correction: Identify the contracting and operating entities, custody and control, access routes and government-request process.

“The DPF makes the whole workload GDPR-compliant.”

“A certification proves our compliance.”

Why it fails: Certifications and attestations cover defined provider controls and periods, while your purposes, settings, identities and data flows remain your responsibility.

11. When a local or isolated provider is justified

A locally owned provider or isolated sovereign environment may be appropriate when a law, regulator, contract or risk appetite requires local control that a global service cannot document. It is not automatically superior. Verify beneficial ownership, subcontractors, administrator locations, support coverage, resilience, cryptographic design, audit evidence, service maturity and portability.

If the requirement is only that personal data be stored in a particular geography, a global provider with enforceable region controls may satisfy it. If the requirement concerns foreign legal control, operational access or public-sector sovereignty, storage alone is insufficient and an isolated design may be necessary. State the requirement precisely so you do not pay for isolation that does not address the actual rule—or select a local label that leaves the critical control plane abroad.

12. Keep the assessment current

Cloud services, subprocessors, transfer frameworks and laws change. Set review triggers for a new region, feature, support model, subprocessor, corporate transaction, legal decision, incident or contract renewal. At each trigger, revisit the flow map, transfer mechanism, residency wording, key design, audit scope, government-request commitments and exit assumptions.

The practical conclusion is straightforward: choose the provider and service that can prove the required controls for your exact workload, then operate those controls consistently. U.S. and non-U.S. labels can help you form questions, but they cannot answer them.
