After a layoff, compare three separate decisions: what your written severance offer provides, whether you qualify for state unemployment insurance, and how to keep health coverage without a costly gap. Severance does not automatically settle your unemployment eligibility, and COBRA is only one of several ways to insure your household. The right choice depends on your state, the terms of your severance, your employer’s plan, and your household’s coverage options.
Start with the terms and dates, not the headline amounts
A severance figure or a monthly premium by itself cannot show whether an option works for you. Put the cash flow, conditions, coverage dates, and deadlines side by side. The comparison below is a framework; exact premiums, eligibility, and unemployment treatment depend on your state and plan.
As an Amazon Associate I earn from qualifying purchases.
| Decision | What to establish | What to compare |
|---|---|---|
| Severance | Gross amount, payment schedule, payment dates, conditions, release language, and any health-premium subsidy | Cash available and when; conditions attached; possible state unemployment treatment |
| Unemployment insurance | State eligibility, claim date, separation reason, weekly certifications, work-search requirements, and reporting instructions | Potential weekly benefit, start date, duration, any state offset, and ongoing obligations |
| COBRA | Eligibility, election notice, exact premium, any employer subsidy, and date current coverage ends | Continuity with the existing plan and providers versus premium cost and limited duration |
| Spouse or other group plan | Special-enrollment rules, application deadline, effective date, premium, network, and prescriptions | Household cost, benefits, and continuity of care |
| Marketplace plan | Local plan choices, eligibility for financial help, enrollment deadline, deductible, network, and drug coverage | Premium after any available assistance, out-of-pocket exposure, providers, and effective date |
| Medicaid or CHIP | State and household eligibility, application, and effective date | Who in the household qualifies, cost, and access to needed care |
Before estimating your budget, obtain the severance agreement, the date employer coverage ends, the COBRA election notice, and the exact continuation premium. Then ask your state unemployment agency how it wants severance reported. These steps replace assumptions with the information that drives each decision.
Do these 3 things before closing this tab:
1Repair Windows errors before they cause bigger problems2Fix the driver behind crashes, sound loss and screen glitches3Clear out junk files and repair common Windows errorsThink of the choices as connected, but not interchangeable. Severance is a payment governed by its written terms; unemployment is a state-administered benefit with its own eligibility and reporting rules; health coverage is a separate enrollment decision with its own deadlines. A severance offer does not, by itself, tell you whether you qualify for unemployment, whether COBRA applies, or which insurance option will cost less over time.

For each option, write down four concrete items: when money or coverage begins, when it ends, what you must do to keep it, and what you will pay. This makes it easier to spot a mismatch, such as a coverage end date that comes before a new plan’s effective date, or a premium due before an expected severance installment. Verify those dates with the documents or agencies rather than assuming the options line up automatically.
What a severance offer does—and does not—guarantee
The U.S. Department of Labor says the Fair Labor Standards Act does not require severance pay; severance is generally a matter of agreement between employer and employee, or their representatives. That federal rule does not resolve whether you have a right under a contract, collective bargaining agreement, employer plan, or another law. Your written terms and the documents governing your employment matter.
Read the complete written package
Identify the gross amount and whether it will arrive as a lump sum or installments. Note payment dates, any conditions such as signing a release, and whether the employer will pay some or all of your health premium for a period. A temporary COBRA subsidy may be included, but it is not automatic. Ask the plan administrator how any subsidy affects the premium and enrollment process.
For budgeting, map each expected payment to the month it will arrive and use the amount you expect to have available after applicable deductions. Do not treat the offer’s headline amount as money immediately in hand if payments are spread over time or depend on a condition. The agreement’s language—not a verbal description—should guide your understanding of what is promised.
Separate the financial terms from the conditions attached to them. Record what the agreement says about the amount, payment schedule, date or dates, and any release language. If the document describes an employer-paid health premium, note the amount or period it covers and whether it identifies the coverage as COBRA or another arrangement. No standard severance package is established here, so do not assume another former employee’s terms—or a customary number of weeks—apply to you.
If anything is unclear, direct questions to the employer or plan administrator and keep the written answer with your agreement. In particular, confirm whether a stated subsidy pays all or only part of the premium, how long it lasts, and how to complete the plan’s enrollment process. A subsidy changes the cost comparison only for the amount and period actually promised; it does not eliminate the need to check eligibility, the election deadline, or the coverage dates.
Does severance affect unemployment benefits?
There is no single nationwide rule in this guidance that determines how severance affects unemployment benefits. Unemployment insurance is a joint federal-state program administered through separate state programs. Eligibility commonly depends on being unemployed through no fault of your own and meeting state wage or work requirements, but each state sets its own rules.
The Department of Labor’s claimant guidance identifies severance as income that may need to be reported. Timing and whether the payment is a lump sum or scheduled over time can matter when the state reviews a claim. Do not assume that a lump sum automatically makes you ineligible, or that installments have the same effect in every state.

Report the arrangement and ask how the state will treat it
- Tell the agency what was paid or will be paid, when it is paid, and which period the agreement says it covers.
- Follow the agency’s instructions for reporting income on the initial claim and in weekly certifications.
- Ask the agency directly how your particular payment structure affects your claim and estimated benefit timing.
- Keep the agreement and payment records available if the agency requests details.
Those steps are important even if the employer calls the payment a separation package or describes it as a lump sum. The state agency—not the employer’s label—determines how the payment fits its rules.
When you contact the agency, distinguish what you know from what you are asking it to decide. Give the actual payment structure and dates, and explain whether the agreement assigns the money to a particular period. Ask what to report on the initial claim and on later certifications, and follow the agency’s response. This avoids relying on a general statement about severance when your state may look at timing or payment form.
Keep a simple record of the claim date, instructions received, weekly certification deadlines, and any documents you submit. Unemployment benefits should not be put into a household budget as a guaranteed amount until the state has determined eligibility and explained the applicable timing. The federal overview supplies no nationwide weekly benefit amount, duration, or offset formula. Those figures depend on your state and circumstances, so verify them before using them to decide what coverage you can afford.
How to file for unemployment insurance
Apply promptly after becoming unemployed. Claims are generally filed with the state where you worked. If you now live elsewhere or had wages in more than one state, the agency where you live can direct you to the right program or explain how out-of-state wages are handled.
- Find the responsible state program. Start with the state where you worked; if you live in another state or worked across state lines, ask your current state agency where to file.
- Submit a claim promptly. Provide the information the agency requests about your work and separation, and answer questions accurately.
- Disclose severance as directed. Give the payment amount, schedule, dates, and covered period when requested. Ask how the agency requires you to report it.
- Continue weekly certifications. Meet the state’s deadlines and work-search or other ongoing requirements, even while a claim is being reviewed.
- Read agency notices and respond. Follow any requests for documents or clarification, and use the state’s appeal process if you disagree with a determination.
The amount, start date, duration, and any severance-related offset are not established nationally by the federal overview; obtain those figures from your state agency before relying on them in a cash-flow plan.
Filing promptly and continuing to follow instructions are separate tasks. A submitted claim is not the same as an approved claim, and the state may require weekly certifications or work-search steps while reviewing your eligibility. Read the instructions for your state, keep track of response dates, and do not stop certifying simply because a determination is pending unless the agency tells you otherwise.
Can you afford COBRA after a layoff?
COBRA can let eligible former employees continue the existing group health plan for a limited period. It generally applies to private-sector and state or local government group plans when the employer meets the federal coverage threshold; some employers and plans are excluded. State mini-COBRA laws may provide similar continuation rights for certain smaller insured plans, depending on state law.

For most people, the central cost issue is that the former worker usually pays the full premium. The Department of Labor says the charge is generally capped at 102% of the plan’s total cost—the combined employer and employee contributions, plus 2%. An employer may agree to cover some or all of the premium as part of severance, so check both the election notice and the agreement rather than assuming the offer includes a subsidy.

Check the deadline and the coverage period
The general federal guidance gives 60 days to elect COBRA, measured from the later of the date job-based coverage ends or the date the election notice is received. Job-loss continuation is usually available for up to 18 months, with extensions possible in certain circumstances. These are general rules; confirm your eligibility and exact dates in the election notice and plan materials.
Ask the plan sponsor or administrator for the exact premium and the date your active employee coverage ends. Compare the amount you would owe under COBRA—including any period for which you would pay the full premium—with the actual cost and effective date of each alternative. A subsidy can change the calculation, but only for the period and amount the written terms provide.
To assess whether COBRA is affordable, use the premium you would actually owe, not an estimate based only on what was deducted from your paycheck while employed. The former worker usually pays the full plan cost, up to the 102% limit, so the employer contribution that was not visible in a paycheck can matter to the new price. Ask for the exact premium, whether it is for individual or family coverage, when it is due, and whether a written severance subsidy applies.

A plan that keeps the existing network may be valuable if you rely on particular providers or prescriptions, but its premium and cost-sharing still need to fit your budget. An alternative with a lower premium could have different providers, drug coverage, deductibles, or effective dates. No universally cheapest choice is established here: the comparison depends on the plan and household details.
Keep the COBRA notice and envelope or delivery information so you can confirm when the election window starts. The general 60-day period is measured from the later of coverage ending or receipt of the election notice, but your specific notice and plan materials control the dates to verify. Do not leave the decision until the last moment; use the window to request premiums and compare alternatives, then confirm the actual deadline and submission instructions.
Compare COBRA with other health coverage
The Department of Labor identifies a spouse’s or another group plan, the Health Insurance Marketplace, Medicaid, and CHIP as alternatives to investigate after losing job-based coverage. A lower premium is not necessarily a better fit if a plan excludes a needed provider or prescription, or shifts costs to a deductible and coinsurance you cannot manage.
Spouse or other employer group plan
Losing job-based coverage generally creates a special-enrollment opportunity in another group plan. The federal guidance describes a generally 30-day period to request enrollment. Confirm the application deadline and effective date with that plan, then compare the premium for your household, covered providers, prescriptions, and cost-sharing.

Marketplace plan
Loss of job-based coverage generally opens a 60-day Marketplace enrollment window. Available plans, premiums, and networks depend on where you live. Depending on household eligibility, premium tax credits or cost-sharing reductions may be available. Compare the premium after any assistance, deductible, copays and coinsurance, annual out-of-pocket exposure, provider network, prescription coverage, and effective date.
Do not compare a Marketplace plan’s headline premium with the full COBRA premium without checking whether financial help may apply and what the plan covers. Premium tax credits or cost-sharing reductions depend on household eligibility; no particular household’s eligibility or assistance amount is established here. Check available local choices, the resulting premium, and the plan’s effective date before deciding. The general 60-day enrollment window after loss of job-based coverage makes it important to establish the relevant dates promptly.
Medicaid or CHIP
You can apply for Medicaid or CHIP at any time if you may qualify. Eligibility and effective dates depend on the household and state. Check whether one or more household members qualify and whether the coverage meets their care needs; do not assume every family member must choose the same option.

Because Medicaid and CHIP eligibility depends on state and household circumstances, use the relevant state program to check whether anyone in your household may qualify and when coverage could begin. They are options worth comparing, not an assumed outcome. If different members of the household have different eligibility or coverage needs, assess the options member by member and consider the total household cost.
Make an apples-to-apples plan comparison
- Monthly premium: Include any employer subsidy and any Marketplace assistance for which the household qualifies.
- Care costs: Compare deductibles, copays, coinsurance, and annual out-of-pocket exposure, not just the monthly premium.
- Access: Verify doctors, hospitals, pharmacies, and prescriptions against the specific plan network and formulary.
- Household fit: Check who can enroll, what the total family premium is, and whether different household members may have different options.
- Timing: Confirm the current plan’s end date and each alternative’s application deadline and effective date so you can assess any potential coverage gap.
For a useful comparison, collect the same facts for each candidate: monthly premium, deductible, copays and coinsurance, annual out-of-pocket exposure, participating providers, covered prescriptions, covered household members, and effective date. If an employer will subsidize COBRA or another premium, show the subsidized period separately from the period after the subsidy ends. This gives you a clearer view of both near-term cost and the longer comparison.
Check the actual provider network and prescription coverage rather than assuming a plan with a familiar insurer includes your current doctor or medication. If continuity of care is important, identify the providers and prescriptions you need and ask each plan or enrollment program to verify coverage. The guidance here supports comparing access and costs; it does not identify a specific plan or provider as best for every reader.

- Gather the controlling documents. Obtain the written severance offer and applicable plan materials, confirm the active coverage end date, and request the COBRA notice and exact premium.
- File for unemployment promptly. Use the state program for the state where you worked, or contact your current state agency for direction if your work or residence crossed state lines. Disclose severance and follow weekly instructions.
- Get real coverage quotes and eligibility answers. Check COBRA, spouse or other group enrollment, Marketplace options, Medicaid, and CHIP as relevant to your household.
- Put every deadline on a calendar. Track the generally 60-day COBRA election period, the generally 60-day Marketplace window, and the generally 30-day group-plan special-enrollment period. Confirm the dates that apply to your situation in each notice or with the plan or agency.
- Build a month-by-month cash and coverage view. Match expected severance payments and potential unemployment benefits to premium due dates and other expenses. Use the state agency’s answer—not a national assumption—to estimate unemployment cash flow.
- Choose based on total exposure and access to care. Compare premiums, cost-sharing, providers, prescriptions, household eligibility, effective dates, and the conditions attached to severance before deciding.
For that month-by-month view, list expected severance payment dates, unemployment claim status and any state-provided timing information, premium due dates, and the coverage effective and end dates. Mark figures that are confirmed separately from estimates. If the agency has not decided a claim or a plan has not confirmed an effective date, treat those items as uncertain rather than counting on them as settled income or coverage.

What can change the answer
This is a federal overview, not a determination of a particular unemployment claim, severance right, or insurance eligibility. State law can change unemployment treatment and mini-COBRA availability. Employer size and plan type can affect continuation rights. The severance agreement may set conditions or subsidize coverage, while household eligibility and medical needs shape the value of alternative plans. Confirm each decision with the relevant state agency, plan administrator, or enrollment program using your own documents and dates.
The federal guidance supplies broad decision rules and general windows, not an individual eligibility determination or a price quote. No national severance average, unemployment approval rate, or universally cheapest coverage choice is established by this overview. State, employer, plan, household, payment structure, and health needs can all change the outcome. If a deadline, subsidy, or reporting instruction is unclear, ask the responsible agency or plan administrator rather than filling the gap with a nationwide assumption.
Frequently Asked Questions
Does severance affect unemployment benefits?
It may affect how a state reviews or calculates a claim, but there is no single nationwide rule. Report the amount, payment dates, whether it is a lump sum or installments, and any period it covers. Follow your state agency’s reporting instructions and ask how your specific arrangement applies.

Check your notice and plan materials for your actual deadline and eligibility. Job-loss continuation is usually available for up to 18 months, with extensions possible in some circumstances.
Can I afford COBRA after a layoff?
Get the exact premium from the plan administrator. Former workers usually pay the full premium, generally capped at 102% of the plan’s total cost, though an employer may subsidize some or all of it under a written severance agreement. Compare the amount you would owe with other plans’ premiums, cost-sharing, providers, prescriptions, household coverage, and effective dates.
What health insurance options do I have after losing my job?
Compare COBRA with a spouse’s or other group plan, Marketplace coverage, Medicaid, and CHIP. Losing job-based coverage generally creates a 60-day Marketplace enrollment window and a generally 30-day period to request special enrollment in another group plan. Medicaid and CHIP applications can be made at any time by people who qualify; confirm eligibility and effective dates with the relevant program.
The Bottom Line
After a layoff, treat severance, unemployment, and health coverage as separate decisions with connected dates and costs. Read the written severance terms, file promptly for state unemployment and report payments as directed, and compare COBRA with group-plan, Marketplace, Medicaid, or CHIP options using exact premiums, benefits, and deadlines. Verify the rules and dates that apply to your state, plan, and household before relying on an estimate.
