Neither a 401(k) nor an IRA is automatically cheaper, offers better investments, or provides stronger creditor protection. The answer depends on your actual plan and IRA, the services and investments each offers, what you would do with the money, and which creditor-protection rules apply. Compare the accounts using their current disclosures and terms before deciding whether to leave a former employer plan in place, move it to a new plan, or roll it into an IRA.
What to compare before choosing
Evaluate the specific accounts, not the labels “401(k)” and “IRA.” A 401(k) is an employer-sponsored plan whose costs, investment menu, services, and distribution rules depend on the plan. An IRA is an individual account whose provider and account terms determine its offerings and charges. In either case, the relevant details are in the plan disclosures, account documents, and current fee schedules.

A comparison that examines only a headline expense ratio or the number of funds can miss important costs, service differences, and legal consequences.
How to compare fees and services
There is no universal fee winner. The Internal Revenue Service explains that plan administration and investment fees may be charged directly to an account or indirectly through lower investment returns. Plans may also charge for individual services, such as processing a loan or a qualified domestic relations order. Whether a particular charge applies depends on the account and the service.

Compare the fees alongside what each account provides. A lower-cost account may not include a service you value, while a charge in another account may be irrelevant if you would never use that service. The goal is to understand the likely cost of the arrangement you would actually have, not to add every possible charge as if it applied to everyone.
Collect the documents for both accounts
- For the 401(k), obtain the participant fee disclosure, fund or investment expense information, and any plan materials that describe additional service charges. If you no longer work for the employer, ask the plan administrator or recordkeeper how to access current materials and which fees apply to former employees.
- For the IRA, obtain the provider’s current account fee schedule and the expense information for the investments you are considering. Confirm whether charges depend on account type, balance, transactions, or particular services.
- For both, identify any one-time or conditional charges that matter to your plans, such as a transaction, distribution, loan, or account-related service fee. Do not assume a fee exists—or does not exist—without checking the applicable terms.
Build a like-for-like comparison
List the categories below, then record the charge, how it is assessed, and what it covers. If a category does not apply or a charge is not stated in the documents you have, ask the provider or plan administrator rather than treating it as zero.
| Category | What to check | How to compare |
|---|---|---|
| Administration or account charges | Whether there is a recurring account or plan-administration charge, how it is collected, and whether the amount or method varies by participant or account. | Compare the charge and its frequency, and note any administrative services included. |
| Investment expenses | The expense information for the particular funds or other investments you would use. | Compare the investments you would actually choose, not a plan’s cheapest option with an IRA investment you would not hold. |
| Transactions and trading | Whether transactions or trading carry charges, and which transactions are affected. | Consider how often you expect to trade or make the relevant transactions; do not treat a possible charge as a cost you will necessarily incur. |
| Individual services | Charges for services you might need, such as loan or qualified domestic relations order processing in a plan. | Include a service only if it is relevant to your situation, and compare both availability and cost. |
| Other account terms | Any additional charges or conditions in the current plan or IRA documents. | Record the terms and ask for clarification where the documents do not make the application clear. |
Account for indirect costs
A fee does not always appear as a separate deduction from your account. The IRS notes that investment and administration costs can also be reflected indirectly through lower investment returns. That is why a review of explicit account charges alone may understate the cost of an arrangement. Read the investment expense information as well as the plan’s participant fee disclosure.
For employer plans, the IRS says plan fiduciaries have an obligation to use a prudent process to evaluate providers, expenses, investment alternatives, diversification, and continuing suitability. Plan fees should be reasonable in light of the level and quality of services. That obligation does not tell an individual participant which of two particular accounts will cost less; the actual charges and services still need to be compared.

How to compare investment choices
A 401(k)’s menu is specific to the plan. Participant-directed plans provide information about each option’s investment goals and risk-and-return characteristics, as well as fees and investment restrictions. The IRS describes a rule under which certain participant-directed plans must offer at least three diversified choices with different risk-and-return factors. This is not a guarantee that a given plan offers three choices that suit a particular participant, or that every plan is subject to that rule.
An IRA’s available investments depend on the provider and the account terms. A broader menu is not automatically better: the useful question is whether you can choose and manage suitable investments, with appropriate diversification and costs, within the account’s rules.

For each account, identify the investments you would realistically consider and compare them on these points:
- Risk and return characteristics: Review the stated goals and risks of each option rather than relying on its name alone.
- Diversification: Consider whether the available choices can support a diversified approach that fits your circumstances.
- Costs: Compare the investment expenses for the options you might hold, as well as account-level charges.
- Restrictions and access: Check limits on transactions or investments, and whether those limits affect your intended approach.
- Practical fit: Consider whether the menu gives you choices you understand and can use consistently, rather than treating a larger menu as a benefit by itself.
Federal tax rules also restrict certain holdings. The IRS says that both IRAs and participant-directed accounts cannot invest in collectibles as defined by the tax rules, and that IRAs cannot invest in life insurance. Do not assume that a provider’s apparent breadth of offerings overrides federal restrictions.

Creditor protection: distinguish bankruptcy from other collection
“Protected from creditors” is too broad to be a reliable comparison. Bankruptcy protection and protection from collection outside bankruptcy are separate questions, and the answer can depend on the account’s legal status, applicable state law, and the facts of a claim.
Qualifying ERISA plans in bankruptcy
In Patterson v. Shumate (1992), the U.S. Supreme Court held that an interest in an ERISA-qualified plan with the required anti-alienation provision could be excluded from the bankruptcy estate under 11 U.S.C. § 541(c)(2). The holding concerns qualifying ERISA plans and bankruptcy. It should not be generalized into a claim that every 401(k) is protected from every creditor or every type of claim.
Do these 3 things before closing this tab:
1Repair Windows errors before they cause bigger problems2Fix the driver behind crashes, sound loss and screen glitches3Clear out junk files and repair common Windows errorsIRAs in bankruptcy
IRAs are addressed through Bankruptcy Code § 522’s retirement-fund exemptions, rather than by assuming the same ERISA-plan rule applies. Section 522 includes conditions for qualifying retirement funds and an aggregate $1 million limit for specified IRA assets. Certain rollover contributions and their earnings are excluded from that calculation, and the statute allows an increase when the interests of justice so require.
That statutory framework is not an across-the-board cap on every retirement account or every creditor remedy. The treatment depends on the assets and circumstances covered by the statute, and state exemption elections can matter. A person considering bankruptcy should not infer an outcome for a particular account from the federal framework alone.

Collection outside bankruptcy and state law
The federal bankruptcy rules do not settle the rules for every state’s nonbankruptcy creditor exemptions. If your concern is a lawsuit, judgment, or another collection effort outside bankruptcy, check current law for your state and the specific account and claim. Do not use the bankruptcy distinction between a qualifying ERISA plan and IRA funds as a substitute for that state-specific analysis.
Because the consequences can turn on the jurisdiction and facts, consult a qualified attorney for advice about a particular creditor claim, bankruptcy filing, or exemption. An account comparison cannot determine legal protection without that context.
What a rollover changes
A rollover is not just a transfer between containers. The receiving plan or IRA’s rules determine the investments, fees, and rights that apply to the assets after the move. A new employer plan is not required to accept rollovers, so confirm that it will accept the particular assets before initiating a transaction. Compare its terms with the existing plan and any IRA you are considering.
The IRS explains eligible rollover distributions, direct transfers, and withholding. A direct rollover can avoid the mandatory 20% withholding that generally applies when an eligible distribution from a plan is paid to the participant. Withholding is not the same thing as the final tax treatment of a distribution; do not treat avoidance of withholding as proof that every transaction is tax-free. Eligibility and transaction details matter.

Plan administrators must provide written information about rollover options for eligible distributions. The IRS also describes notice and direct-transfer facilitation requirements for eligible rollovers of $200 or more. The precise requirements depend on the distribution and account facts.
Check these details before initiating a move
- Confirm the receiving account will accept the funds. Ask the new employer plan whether it accepts rollovers and whether the particular distribution is eligible.
- Get current terms from both sides. Compare fees, investment options, services, restrictions, and distribution rights for the account you would leave and the account that would receive the money.
- Review the written distribution and rollover information. Ask the plan administrator what options apply to your distribution and what forms or instructions are required.
- Understand the payment route. Confirm whether the transaction will be handled as a direct rollover or paid to you, and ask how withholding applies to that route.
- Verify before submitting instructions. Check that the receiving account is open and that its instructions match the sending plan’s process. Keep the confirmations and transaction records.
These checks help identify account and processing issues; they do not establish that a particular rollover is eligible or appropriate. If the tax consequences or eligibility are unclear, get individualized tax guidance before moving the funds.
A practical decision process
- Define your alternatives. Compare leaving the assets in the existing 401(k), moving them to a new employer plan if it accepts the rollover, and rolling them to an IRA if eligible. The available alternatives depend on the accounts and distribution rules.
- Gather current documents. Use the 401(k)’s participant fee disclosure and investment expense information, the IRA provider’s current fee schedule and investment details, and any relevant distribution or rollover materials.
- Compare total costs for your likely use. Record recurring administration or account charges, investment expenses, applicable transaction charges, and service costs you might actually incur. Include indirect investment costs, and distinguish possible charges from charges you expect to pay.
- Compare the investments you would select. Assess risk, diversification, cost, restrictions, and whether the options make sense for your approach. Do not decide based only on the count of available investments.
- Identify the legal question you need answered. If you are concerned about bankruptcy, analyze the relevant federal framework and the account’s status. If you are concerned about collection outside bankruptcy, investigate the applicable state law and claim.
- Check rollover eligibility and mechanics. Confirm acceptance, distribution options, the payment route, and withholding treatment before authorizing a transaction.
- Make the decision on the whole comparison. Weigh costs, investment fit, services, account terms, and legal considerations that apply to you. If a key fee, right, or protection remains unclear, ask the plan administrator or provider for written clarification rather than filling in the gap with a general rule.
For a personal recommendation involving a substantial balance, complex rollover, or creditor concern, an optional next step is to consult a fiduciary financial professional for an individualized account and fee review, and a qualified attorney for legal questions. Neither is a substitute for checking the actual account documents and applicable law.
