Paying IGST and obtaining an automated refund through the shipping bill is not a universal alternative after the section 16 amendment effective 1 October 2023; it is available only to notified classes of persons or notified goods or services. Before filing, verify the product classification, export-duty treatment, export date, ITC records and any current notification that applies to your shipment.
This guide explains both statutory routes, the evidence to assemble, the calculation, deadlines, common causes of delay and the checks that matter specifically for medicine and formulation exports.

Start with the route decision
Use this sequence before preparing an invoice or refund application:
- Confirm that the exporter is GST-registered and that the transaction meets the legal definition of export of goods.
- Check the medicine or formulation’s HSN or tariff classification and whether the goods are subject to export duty. Goods subject to export duty are excluded from the relevant export-refund routes.
- For a general claim, choose export under LUT or bond without payment of IGST and claim eligible unutilized ITC.
- Choose the IGST-paid route only after confirming that the exporter or goods fall within a class notified under the current section 16 framework.
- Reconcile invoices, shipping bills, export reports and GST returns before filing or relying on an electronic refund process.
The title of a product as a pharmaceutical does not by itself establish eligibility. The exact formulation, tariff heading, export date, destination and tax treatment control the result.

What zero-rated pharmaceutical exports mean
Section 16 of the Integrated Goods and Services Tax Act treats eligible exports as zero-rated supplies. Zero-rating permits an exporter to use eligible ITC, subject to the conditions of the Central Goods and Services Tax Act and Rules, while seeking a refund under the route that the law permits. It is different from an exemption: an exempt supply generally does not provide the same entitlement to input-tax credit.
Section 16 was amended with effect from 1 October 2023. The amended framework limits export with payment of IGST followed by a refund to notified classes of persons or notified goods or services. An older sector FAQ may describe payment of IGST and refund as an alternative in broad terms, but that wording does not establish present eligibility. The amended statute and current notifications must govern the decision.
Compare the two refund routes
| Decision point | LUT or bond, no IGST | IGST paid, Rule 96 mechanism |
|---|---|---|
| Current availability | General statutory route for eligible zero-rated exports, subject to conditions | Only for notified classes of persons or goods or services; confirm the current notification |
| Tax charged on export invoice | No IGST is charged on the export supply | IGST is paid on the export, subject to legal eligibility |
| Refund application | Electronic FORM GST RFD-01 claim for eligible unutilized ITC | Shipping bill is treated as the refund application for IGST paid, when Rule 96 conditions are met |
| Main evidence | ITC ledger and calculation, purchase invoices, returns, export invoices and shipping records | Shipping bill, export and invoice data, export manifest or report and a valid GST return |
| Export-duty restriction | No refund where the exported goods are subject to export duty | The same export-duty restriction applies |
| Typical processing risk | Officer examination of completeness, eligibility and the prescribed formula | Electronic data mismatch, missing manifest or risk-based withholding can delay credit |
Route A: export under LUT or bond and claim unutilized ITC
1. Confirm registration and transaction eligibility
Use this route only if the supplier is registered and the shipment qualifies as an export of goods. Confirm that the buyer is outside India, the goods leave India and the export documentation supports the transaction. Eligibility to claim ITC still depends on the normal CGST Act conditions; an invoice merely labelled as a pharmaceutical export is not enough.
Do these 3 things before closing this tab:
1Repair Windows errors before they cause bigger problems2Fix the driver behind crashes, sound loss and screen glitches3Clear out junk files and repair common Windows errors2. Put the correct endorsement on every export invoice
The export invoice should carry the prescribed wording: SUPPLY MEANT FOR EXPORT UNDER BOND OR LETTER OF UNDERTAKING WITHOUT PAYMENT OF IGST. The invoice must also contain the required foreign recipient name and address, delivery address, destination country, and export-removal application number and date. Check that the legal name, address and values agree with the shipping bill and the return data. A mismatch can prevent the system or officer from matching the claim.
3. Furnish the LUT or bond before relying on the no-IGST route
Submit the applicable LUT or bond through the current GST portal process and retain the acknowledgement and the version applicable to the export period. Portal labels and validations can change, so follow the live instructions shown for the exporter’s registration rather than an old screenshot or an undated checklist. If a bond, bank guarantee or other security is required for the exporter’s circumstances, keep evidence that the requirement was met before export.

4. Complete export and preserve the export trail
Keep the commercial invoice, shipping bill or bill of export, export manifest or report evidence and the carrier or customs records that show departure. Reconcile the invoice number, date, taxable value, quantity, shipping-bill number and port details with the information reported in GST returns. For a pharmaceutical shipment, retain the product description and classification used for customs as well as any export authorisation or regulatory record relevant to that product.
5. File FORM GST RFD-01 electronically
For a refund of unutilized ITC on zero-rated supplies made without payment of tax, submit the applicable RFD-01 category on the common portal. Attach or report the prescribed statement of export invoices and shipping-bill particulars and the supporting evidence requested by the current portal. The claim period, return filing status and invoice data must be internally consistent. Do not assume that uploading a shipping bill alone completes an ITC refund application; RFD-01 and the prescribed statement are the operative claim route.

6. Calculate the claim using the statutory formula
The refund is limited by the formula in the rules, not by the total GST appearing on all purchase invoices. In broad terms, the formula applies the relevant period’s turnover of zero-rated supplies to eligible Net ITC and the adjusted total turnover. Net ITC and turnover have defined meanings and exclusions. Separate eligible inputs and input services, remove credits that the rules exclude, and retain a reconciliation from the electronic credit ledger to the amount claimed.
Illustrative calculation: if an exporter has ₹30 lakh of eligible Net ITC for the period, ₹1 crore of zero-rated turnover and ₹1.5 crore of adjusted total turnover, the formula would cap the refund at ₹20 lakh before any other statutory adjustment (₹1 crore × ₹30 lakh ÷ ₹1.5 crore). This is only a mathematical illustration; the exporter must use the definitions and figures applicable to its own period.
7. Debit the electronic credit ledger for the claim
The amount claimed is debited from the electronic credit ledger as required by the refund rules. Ensure that sufficient eligible balance exists and that the ledger, purchase register, filed returns and RFD-01 statement agree. A claim based on gross input GST, without this reconciliation, is likely to be reduced or questioned.

Route B: pay IGST and use the shipping-bill refund mechanism
Check that the route is legally open
Do not select this route simply because an older FAQ describes it. Under the current section 16 framework, payment of IGST and refund of that tax is restricted to notified classes of persons or goods or services. Verify the notification in force for the export date and the exporter’s category. If no notification covers the shipment, use the LUT or bond route if otherwise eligible.

Pay and report the export correctly
Charge and pay the applicable IGST on the export invoice, file the relevant GST return and provide complete shipping-bill data. Rule 96 treats the shipping bill as the application for refund of IGST paid on exported goods, but the mechanism depends on export-manifest or report data and a valid return. Customs and GST data must transmit and match electronically.
Understand how payment reaches the exporter
When the conditions are met, the system processes the matched shipping-bill information and credits the payable refund to the bank account recorded in the exporter’s GST registration particulars. Check that the account and registration details are current before export. A bank-account error can delay an otherwise eligible payment.
Know the withholding conditions
Rule 96 contains circumstances in which the refund can be withheld. Risk-based verification described in CBIC Instruction No. 04/2022-GST may place an exporter’s credentials or transaction under review. A held amount is not automatically a final rejection; read the notice or order, supply the requested records and correct any data mismatch.
Evidence checklist for a defensible claim
- GST registration details and the LUT or bond record applicable to the export period.
- Export tax invoices carrying the correct LUT or bond endorsement where no IGST was charged, plus recipient, destination and export-removal details.
- Shipping bills or bills of export, export manifest or report evidence and an invoice-to-shipping-bill mapping.
- Filed GST returns and a reconciliation of export values reported in returns with customs data.
- Purchase invoices, input and input-service ITC working papers, the electronic credit ledger and the period-wise refund calculation.
- Product description, HSN or tariff classification and evidence of the export-duty check.
- Records of any concession used for imported or domestic inputs, because the concession may affect the credit or refund treatment.
- Bank-account details maintained in the GST registration for an IGST-paid claim.
Export-duty and product-classification checks
Section 54 does not permit an unutilized-ITC refund where the exported goods are subject to export duty, and section 16 carries the corresponding restriction for the relevant zero-rated refund routes. There is no blanket pharmaceutical answer: active ingredients, formulations, vaccines, devices and other products can fall under different tariff treatment. Obtain the classification used on the shipping bill and verify the duty position for the actual export date.

The shipment records should also identify whether an input concession, exemption or other benefit was used. Do not claim an incompatible refund or drawback benefit for the same tax or credit. Review section 54 and the current rules for the particular supply before selecting overlapping incentives.
Deadlines and statutory processing periods
Two-year filing limitation
Section 54 generally requires a refund application within two years from the relevant date. For goods exported by sea or air, the cited Act defines the relevant date as the date the ship or aircraft leaves India. For land exports, it is the date the goods pass the frontier. Compute the deadline shipment by shipment and retain evidence of the actual departure or frontier crossing.
Sixty-day order period
For an application complete in all respects, section 54(7) states that the proper officer shall issue the order within 60 days of receipt. This is a statutory order period, not a guarantee that money will reach the bank within 60 days. Deficiency memos, eligibility review, withholding, risk verification or other proceedings can interrupt or delay payment.

Invoice and shipping-bill mismatch
Compare invoice number, date, value, currency conversion, port, destination and shipping-bill details. Correct the source return or customs record through the permitted process and preserve both the original and corrected mapping.
Manifest or export-report data missing
For the Rule 96 route, ask the carrier, customs broker or customs authority to confirm that the export manifest or report was filed and accepted. The shipping bill cannot complete the electronic application when departure data has not reached the system.

GST return not valid or not filed
Rule 96 depends on a valid return and successful data transmission. Complete the relevant return, resolve errors and allow the systems to reflect the filing before expecting automatic processing.
Insufficient or ineligible ITC under the LUT route
Rebuild Net ITC from purchase invoices and the ledger for the exact refund period. Remove blocked or otherwise ineligible credits and check that the claim does not exceed the formula-based ceiling.
Export-duty or notification problem
Recheck the tariff classification and duty status. For an IGST-paid claim, recheck the notification that covers the exporter or goods on the shipment date. If the legal route is unavailable, an electronic mismatch cannot be solved by repeatedly resubmitting the same claim.

Read the notice or order carefully, identify each requested document and respond within the stated period. Provide registration records, contracts, bank information, shipping evidence, purchase invoices and reconciliations that address the stated risk. Escalate through the available statutory remedy if an adverse order is issued; do not treat a hold as proof that the goods were ineligible.
Pharmaceutical-specific controls that reduce disputes
- Use one consistent product description and HSN or tariff classification across the tax invoice, shipping bill, packing list and customs declaration.
- Keep batch, dosage-form and quantity records that let an officer connect the exported formulation to the invoice and shipping documentation.
- Separate export sales from domestic sales in the turnover and ITC working papers used for the refund formula.
- Map each export invoice to its shipping bill and departure evidence before submitting RFD-01.
- Document whether imported or domestic inputs received a concession, because that fact can affect the credit available for refund.
- Check destination-country and Indian export-control records where the product is regulated; a customs or regulatory hold can delay evidence needed for the GST claim.
A practical filing calendar
- Before invoicing: confirm registration, classification, export-duty status and the legally available route.
- Before dispatch: ensure the LUT or bond is in place if exporting without IGST, and verify invoice endorsement and required fields.
- At customs filing: match the shipping bill to the final invoice and preserve the export-removal and manifest references.
- During the return cycle: report exports accurately and reconcile GST data with customs data.
- After the period closes: calculate Net ITC and the statutory cap, then file RFD-01 with the prescribed statement for the LUT route.
- For an IGST-paid shipment: monitor Rule 96 matching, manifest acceptance and the bank account recorded in GST registration.
- Until payment or order: monitor notices, deficiency communications and the two-year limitation date for every shipment or claim period.
When professional help is sensible
A GST practitioner or chartered accountant experienced in export refunds can help when the exporter has multiple formulations, mixed domestic and export turnover, amended shipping bills, input concessions, export-duty uncertainty or a risk-based hold. Professional assistance does not guarantee eligibility or payment. The exporter remains responsible for the accuracy of classification, records and declarations.
Bottom line for exporters
For an eligible Indian pharmaceutical export, start with LUT or bond export without payment of IGST and a properly calculated RFD-01 claim for unutilized ITC. Treat the IGST-paid shipping-bill refund as an exception that requires a current notification, not as an automatic second choice. Confirm export-duty status, preserve a complete invoice-to-customs trail, file within two years of the relevant date and allow the statutory 60-day order period only for a complete application—not as a promise of immediate payment.
