How to Claim an Indian GST Refund: Eligibility, Documents and Filing Steps

Indian GST refunds generally use Form GST RFD-01, but eligibility, claimant, documents, and filing conditions depend on the refund category.

In India, most GST refund claims are filed electronically in Form GST RFD-01 through the GST Common Portal, but the correct route and evidence depend on why you are claiming. First identify the refund category and eligible claimant; then assemble the records required for that category and follow the relevant filing route. An acknowledgement confirms receipt of an application, not approval of the refund.

This guide covers India. GST and VAT refund rules differ by country: for example, Canada has GST/HST rebate procedures, while the UK uses VAT repayment rules. Do not apply the Indian steps below to a claim in another jurisdiction.

Am I eligible for an Indian GST refund?

Eligibility depends on the legal ground for the refund, the person making the claim, and any conditions attached to that category. The Central Board of Indirect Taxes and Customs (CBIC) refund rules provide for claims involving tax, interest, penalty, fees, or other amounts paid, subject to statutory exceptions and category-specific requirements. Being out of pocket, having a credit balance, or submitting a form does not by itself establish eligibility.

Start by identifying what amount you want refunded and why it is refundable under the applicable rule. The rules include several distinct grounds, and they are not interchangeable: the claimant, filing prerequisite, timing, and supporting records can all differ. Confirm the requirements for the exact claim against the applicable rule, notifications, and current portal prompts.

In other words, the first question is not simply “Do I have a GST balance?” but “What legal ground applies to this amount, and does that ground permit me to claim it?” The rules refer to refunds of different kinds of amounts, but that does not mean every payment or balance can be reclaimed in the same way. For example, unutilized input tax credit is refundable only in specified circumstances, while a refund tied to an order depends on the relevant order and payment circumstances.

Common refund grounds in the rules

  • Amounts arising from an order: A refund may be claimed where the relevant order and payment circumstances support it. Prepare the order reference and copy, or the specified payment reference where relevant.
  • Exports of goods or services: Export claims have transaction-specific conditions and records. For export of goods, the application follows delivery of the export manifest or export report.
  • Supplies to a Special Economic Zone (SEZ): The supplier’s filing is tied to evidence that the supply was admitted or received for authorized operations. This is a distinct route from an ordinary export claim.
  • Deemed exports: These claims have a specified claimant route and evidence requirements. Confirm who may claim in the particular transaction rather than assuming the supplier and recipient can file interchangeably.
  • Unutilized input tax credit (ITC): Refunds of unutilized credit are available only in specified circumstances. They are not a general right to withdraw any unused credit.
  • Finalization of provisional assessment: A claim may arise from the final assessment; the final assessment order is relevant evidence.
  • Specified cash-ledger balances: Some refunds of electronic cash-ledger balances may be claimed through applicable returns instead of the general RFD-01 application route.

This is a set of examples from the CBIC rules, not a complete list of every possible current refund situation. Specific categories can also be affected by statutory exceptions or notifications.

Which refund route applies to my claim?

Form GST RFD-01 is the general electronic application route described by the rules. However, specified cash-ledger refunds may be made through applicable returns, and particular claim grounds have their own prerequisites and evidence. Choose the route only after identifying both the reason for the refund and the person permitted to claim it.

CBIC’s refund rules state that a person, except a person covered under a notification issued under section 55, claiming a refund of tax, interest, penalty, fees or another amount paid may apply electronically in Form GST RFD-01 through the Common Portal, directly or through a Facilitation Centre notified by the Commissioner. That general wording should be read with its exception and the rules for the particular type of claim. It is not a promise that any applicant or any amount will qualify.

Compare routes using six questions: What is the reason for the refund? Who is entitled to apply? Is the general RFD-01 route or a return-based route relevant? Is there a timing condition or prerequisite? Which records support this category? Does a declaration or professional certificate concerning whether the tax incidence was passed on apply? Answering these questions before opening the portal helps prevent a mismatch between the claim and its supporting material.

Claim ground Who or what determines the path Key prerequisite or evidence identified in the rules
Refund resulting from an order The person entitled to seek the amount under the relevant order and circumstances Order reference and copy, or the specified payment reference where relevant
Export of goods Claimant and conditions applicable to the export transaction Delivery of the export manifest or export report; shipping bill or bill of export details and related invoices
Export of services Claimant and conditions applicable to the export transaction Invoice details and relevant Bank Realization Certificates (BRCs) or Foreign Inward Remittance Certificates (FIRCs)
Supply to an SEZ Supplier’s filing and the conditions for the particular supply Evidence of admission or receipt for authorized operations; service claims also require the applicable receipt and payment evidence
Deemed exports The claimant route specified for the transaction Invoice details and other evidence as notified
Specified unutilized ITC Whether the claim falls within a circumstance for which refund is permitted Invoice statement in Annex 1 of Form GST RFD-01
Finalized provisional assessment The final assessment and resulting refund entitlement Final assessment order reference and a copy
Specified electronic cash-ledger balance The applicable return-based route Use the applicable return process rather than assuming RFD-01 is required

The table is a way to orient your preparation, not a substitute for the current rule or the claim-specific portal requirements. In particular, export, SEZ, and deemed-export categories have conditions beyond simply holding an invoice.

The key distinction is between a general form and a category-specific entitlement. RFD-01 is the common application form for many refunds; it does not erase a claim’s prerequisites. A cash-ledger balance may follow the relevant return route, while an export claim may depend on export records and a stated event such as delivery of the export manifest or report. A deemed-export claim raises a separate question about the permitted claimant. Use the category, not convenience, to select the path.

What documents do I need for a GST refund?

There is no single document bundle for every applicant. Build it from the category-specific requirements, and submit only the evidence that applies to your claim. The examples below are identified in the CBIC refund rules; the current rules, notifications, and portal prompts govern the actual filing.

Match evidence to the claim

  • Refund arising from an order: Keep the order reference and a copy of the order. Where relevant, include the specified payment reference.
  • Export of goods: Prepare a statement with shipping bill or bill of export numbers and dates, together with the related export invoices. The application is tied to delivery of the export manifest or export report.
  • Export of services: Prepare invoice details and the relevant BRCs or FIRCs.
  • Supply to an SEZ: Prepare invoice details and the required endorsement. For services, also prepare evidence of receipt for authorized operations, payment details, and proof of payment.
  • Deemed exports: Prepare invoice details and the other evidence notified for the relevant claim.
  • Specified unutilized ITC: Prepare the invoice statement in Annex 1 of Form GST RFD-01.
  • Finalization of provisional assessment: Prepare the final assessment order reference and a copy.

Do not submit every item on this list merely because it appears here. For example, an export-of-services claimant should use the service evidence relevant to that claim, not a goods-export shipping bill list unless it also applies to the transaction.

Think of the records as proof of different parts of the claim rather than as interchangeable paperwork. An order-related application needs material identifying the order and, where relevant, the specified payment reference. Goods-export records identify the shipping bill or bill of export and connect it to invoices; for services, the listed records are invoice details and relevant remittance certificates. For an SEZ supply, the required endorsement and evidence of admission or receipt for authorized operations address that category’s particular conditions. Keep the records grouped by ground so the application and supporting statement tell a consistent story.

Declaration or professional certificate on tax incidence

For specified claims, the rules distinguish claims up to ₹2 lakh from claims above ₹2 lakh. The former may require a declaration that the tax incidence was not passed on to another person; the latter may require a certificate in Annex 2 from a chartered accountant or cost accountant. These requirements have stated exceptions, so the threshold is not a universal rule for every refund. Check whether the declaration or certificate applies to your specific ground and circumstances before filing.

The threshold is a rule-based distinction about evidence, not a refund limit or an indicator of likely approval. Do not assume that a claim below ₹2 lakh automatically avoids documentation, or that every claim above that figure needs the certificate regardless of category: the rules contain exceptions and apply the requirement to specified claims. If a certificate is required, the rules assign that role to a chartered accountant or cost accountant. A professional can also help interpret a complex claimant route or evidence requirement, but the underlying entitlement still depends on the applicable rules.

How do I file an Indian GST refund claim?

  1. Confirm the country and refund ground. Make sure the claim is under Indian GST rules, then identify why the refund is sought and who is eligible to apply. Record the specific category rather than treating all GST refunds alike.
  2. Check for a special filing route or prerequisite. Form GST RFD-01 is the general electronic application. Verify whether your claim instead uses an applicable return, or whether a condition such as delivery of an export manifest or report, evidence of an SEZ supply’s admission or receipt, or a specified claimant route applies.
  3. Assemble the relevant evidence. Use the claim-specific records described above and check current rule and portal requirements for your category. Prepare any applicable incidence declaration or professional certificate, taking account of the stated exceptions.
  4. File electronically through the GST Common Portal. Submit the applicable electronic application, generally Form GST RFD-01, with the supporting details and documents required for the chosen ground. The rules also allow filing through a Facilitation Centre notified by the Commissioner.
  5. Retain the application acknowledgement. The rules describe acknowledgements in Form GST RFD-02 for relevant applications. Keep the acknowledgement and a copy of the submitted material so you can identify the filing in later correspondence.
  6. Act on any deficiency communication. If deficiencies are communicated in Form GST RFD-03, address them and rectify and refile as applicable under the rules. Do not assume that an initial submission remains complete if the officer has identified a deficiency.
  7. Follow the claim through examination and decision. The rules provide for an officer’s examination and, in applicable cases, refund orders and payment advice. Monitor the claim and respond to any further requirements through the applicable process.

Before submission, reconcile the amount and category you intend to claim with the records you are attaching. Check that the claimant matches the route for that ground, that the listed evidence belongs to the relevant transaction, and that a special prerequisite has occurred where the rules require it. The application is not stronger merely because it includes more documents; irrelevant records do not replace the evidence required for the actual ground.

What happens after filing?

An acknowledgement is a procedural confirmation, not a decision that the claim is eligible or that payment has been approved. The application is examined under the rules. If a deficiency is communicated, the applicant must take the relevant corrective action and refile as applicable; if the claim proceeds, the rules provide for refund orders and payment advice in applicable cases.

The rules include scrutiny periods, but those procedural provisions are not a guarantee of when a particular applicant will receive money. Avoid relying on a promised approval or payment date based only on the fact that an application was filed or acknowledged.

Keep a record of what you submitted, the acknowledgement, and any later communication. If Form GST RFD-03 identifies deficiencies, read it against the claim category and correct the issues as required before refiling as applicable. Do not treat an acknowledgement in Form GST RFD-02 as a sanction, and do not treat a deficiency notice as proof that the claim is finally rejected; it signals that the application needs the specified response under the process.

Common mistakes that can delay or derail a claim

  • Using rules from the wrong country: GST/HST rebate instructions in Canada and VAT repayment instructions in the UK are not interchangeable with Indian GST procedures.
  • Choosing a form before identifying the claim ground: RFD-01 is the general application, but certain cash-ledger claims use applicable returns and special categories have distinct conditions.
  • Assuming every claimant can apply: Deemed exports and other special categories may specify who can claim. Verify the claimant route for the transaction.
  • Sending a generic document bundle: Evidence differs by category. An invoice alone may not establish export, SEZ receipt for authorized operations, payment, or another required condition.
  • Treating ₹2 lakh as a universal cutoff: The declaration and certificate rules apply to specified claims and include exceptions. Check the rule for your category.
  • Confusing receipt with approval: Form GST RFD-02 is an acknowledgement in relevant cases, not a refund sanction. Follow any deficiency communication and await the applicable decision.
  • Assuming unused ITC is always refundable: Refunds of unutilized credit are available in specified circumstances, not automatically whenever credit remains unused.
  • Overlooking a timing or evidence prerequisite: For example, a goods-export application follows delivery of the export manifest or report, and an SEZ claim is linked to evidence of admission or receipt for authorized operations.

Before you submit: a claim-specific checklist

  • Have I confirmed that the claim is governed by Indian GST rules?
  • Can I state the precise refund ground and identify the person entitled to apply?
  • Have I checked whether this claim uses RFD-01 or an applicable return, and whether a special prerequisite applies?
  • Have I prepared the records required for this category rather than a universal checklist?
  • Have I checked whether a declaration or Annex 2 professional certificate applies, including the stated exceptions?
  • Can I retain the submission and acknowledgement and respond if Form GST RFD-03 or another communication is issued?

CBIC’s refund rules are the appropriate starting point for the Indian procedure, but the applicable category-specific provisions and current portal requirements control an individual claim. When the claimant route, evidence, or exception is unclear, confirm it before submitting rather than assuming that a general RFD-01 filing establishes entitlement.

Frequently Asked Questions

Am I eligible for an Indian GST refund?

Possibly, if an applicable refund ground covers the amount and you are the permitted claimant under that category. The rules identify grounds such as certain amounts arising from orders, exports, SEZ supplies, deemed exports, specified unutilized ITC, and finalization of provisional assessment. Eligibility is not established simply by having a balance or filing an application.

What documents do I need for a GST refund?

It depends on the claim. Examples include order references and copies for order-based claims; shipping bill or bill of export numbers, dates, and invoices for goods exports; invoice details and relevant BRCs or FIRCs for service exports; and category-specific endorsements or receipt and payment evidence for SEZ supplies. Check the rule and portal requirements for your exact ground rather than submitting a universal bundle.

How do I file a GST refund claim in India?

Identify the refund ground and eligible claimant, check for a special route or prerequisite, and assemble the matching evidence. The general electronic application is Form GST RFD-01 through the GST Common Portal, with specified cash-ledger refunds potentially made through applicable returns. Retain the acknowledgement and respond to any deficiency communication.

Does filing Form GST RFD-01 mean my refund is approved?

No. An acknowledgement such as Form GST RFD-02 confirms receipt in relevant cases; it is not approval or a payment order. The application is examined under the rules, and deficiencies may be communicated in Form GST RFD-03. The rules provide for refund orders and payment advice in applicable cases, but filing does not guarantee approval.

Do I need a chartered accountant certificate for a GST refund?

Some specified claims above ₹2 lakh may require a certificate in Annex 2 from a chartered accountant or cost accountant; specified claims up to ₹2 lakh may require a declaration about whether the tax incidence was passed on. The rules include exceptions, so verify whether either requirement applies to your category and circumstances.

How long does an Indian GST refund take?

The rules contain procedural scrutiny periods, but those provisions do not guarantee a payment date for an individual claim. Timing and next steps depend on the applicable process, including examination and any deficiency communication. Do not treat filing or acknowledgement as a promise of when money will arrive.

The Bottom Line

For an Indian GST refund, first identify the legal ground and permitted claimant, then choose the applicable filing route and prepare only the evidence required for that category. Form GST RFD-01 is the general electronic route, but some cash-ledger claims use returns and special claims have their own prerequisites. An acknowledgement is not approval, and no filing alone guarantees payment.
