How to Choose the Right GST Registration State for an Online Business

For an online business in India, GST registration follows actual operations and legal liability, not simply customer location. Map your places of business, identify the principal place, and verify current rules for your supplies and marketplace model.

Choose the State or Union territory (UT) where your business is genuinely carried on and where it has a qualifying place of business—not simply where its customers live. Identify the principal place from your actual operations, document your right to use that premises, and check whether your locations and type of supply create registration obligations elsewhere. The answer can depend on current rules for your specific goods or services, marketplace arrangement, and other facts.

How do I choose the right GST registration state for my online business?

Start with your operating footprint, then apply GST registration rules to your business and supplies. A website’s registered address or the location of most customers does not, by itself, determine the right GST registration State or UT.

CBIC’s general framework is that a person liable to register must apply in each State or UT where the person is liable. The Central Goods and Services Tax (CGST) Act’s general default is one registration in each such State or UT. The Act text cited here is CBIC’s updated version dated 31 August 2021; later amendments, rules, and notifications may affect a current case.

Keep two questions separate: where your business is required to register and the place of supply for a particular transaction. Place-of-supply rules help determine how an individual supply is treated; customer location alone does not establish that you have a place of business or a registration obligation in that customer’s State.

What counts as the principal place of business?

The GST Portal’s Apply for Registration – Normal Taxpayer guide describes the principal place of business as “the primary location within the State where a taxpayer’s business is performed.” It says this is generally where books and records are kept and often where the head of the firm or top management is located. That is an operational description, not a requirement that every business locate senior management at the address.

Map the places where the business is actually carried on before selecting the principal place. CBIC’s explanation of “place of business” includes where business is ordinarily carried on, where goods are stored, where books are maintained, and places where business is conducted through an agent.

  • Where are business decisions and day-to-day operations handled?
  • Where are books, records, and business documents maintained?
  • Where do employees or agents conduct business?
  • Where is inventory stored, including at a warehouse or fulfilment location?
  • What premises do you own, rent, lease, or use with the owner’s consent?

Can I register from my home address?

A home address may be relevant if business is genuinely carried on there, but an address is not automatically acceptable or unacceptable just because it is residential. Consider what work, record-keeping, or other operations take place there, your right to use the premises for the business, and whether you can provide the applicable evidence requested by the GST Portal.

The same practical test applies to coworking and virtual-office arrangements. The portal guide describes types of premises evidence, but the material cited here does not settle every home, coworking, or virtual-office fact pattern.

Does a warehouse or marketplace decide my GST state?

Warehouses and other operating locations

A warehouse can matter because the place-of-business explanation includes goods-storage locations. List stock and fulfilment sites alongside offices, record-keeping locations, and places where staff or agents work. Then assess the registration position for each relevant State or UT under the rules that apply to your facts. A customer address is not a substitute for this location analysis.

Marketplaces and online sales

Do not rely on a blanket claim that every online seller must register in every customer State, or that selling through a marketplace can never affect the analysis. For a specific business, check whether it sells goods or services, how the e-commerce operator is involved, where inventory and other premises are located, whether it makes inter-State taxable supplies, and whether a current exemption or special rule applies.

CBIC FAQs contain general explanations, but some are old and do not establish the complete current set of rules and exceptions for every online business model. Use the current statute, rules, and notifications for a filing decision; seek advice from a qualified GST practitioner if your model or locations make the answer uncertain.

What if my business operates in more than one State or UT?

Assess the facts State by State rather than choosing one registration to cover every operating location. The CGST Act text cited provides for registration in each State or UT where the person is liable. It also allows separate registrations for multiple places of business within a State or UT, subject to prescribed conditions. The Act requires a separate registration for an SEZ unit or developer relative to the same person’s non-SEZ place in that State or UT.

Registrations held or required in one or more States are treated as distinct persons under the Act. That has practical consequences for transactions and input-tax-credit administration between registrations; a shared PAN does not make them a single GST account.

What premises evidence should I prepare?

The GST Portal registration guide describes the application as asking for the State or UT and district, principal-place details, and information about other places of business. It lists examples of premises evidence; the live application may change, so check its current instructions before filing.

  • Owned premises: ownership evidence, such as the documents described in the portal guide.
  • Rented or leased premises: a valid rent or lease agreement and evidence of the lessor’s ownership, as applicable.
  • Premises used with consent: a consent letter and ownership evidence, including the consent approach described for shared property.

Match the proposed address to the actual arrangement and make sure the evidence supports your right to use the premises. Follow the portal’s live instructions for the exact documents and fields required at the time of application.

How to check your registration position before filing

  1. Map your locations. Record every office, home workspace, warehouse, stock location, records location, and other premises where staff or agents conduct business.
  2. Identify the principal place in each relevant State or UT. Use the primary operating location and consider where records are kept and management is based.
  3. List additional places and identify any SEZ location. Check whether you need to consider a separate registration for another place or the SEZ-specific rule.
  4. Check liability for your exact model. Review current rules for your goods or services, inter-State supplies, marketplace arrangement, locations, and any applicable exemptions or special provisions.
  5. Gather premises evidence and complete the live application. Ensure the State or UT, district, principal-place information, other locations, and supporting documents match your real setup.

CBIC’s CGST Act text cited for the registration framework is dated 31 August 2021, while portal field descriptions and upload guidance can change. Check current primary legal materials and the GST Portal before submitting; the older CBIC FAQs are explanatory rather than a final answer for every taxpayer’s current liability.
